About this file
This document is a Request Form to the Idaho Division of Purchasing (DOP) from the Idaho Division of Juvenile Corrections (IDJC) requesting an exemption from competition for the purchase of Prescription Filling & Pharmacy Services and Enhanced Clinical Services. IDJC is seeking to extend a current approved One-Time Exemption (OTE) that is set to expire on September 30, 2023, in order to allow the DOP time to establish a contract with Correct Rx through the Idaho MMCAP program. IDJC requires these services on an ongoing basis for juveniles in its Juvenile Correction Centers, and cannot go without them. The requested extension is for six months or until the DOP can establish the new contract, whichever is shorter.
The total anticipated cost for these services is $66,000. IDJC has an interim contract in place with Correct Rx, which includes the base Prescription Filling & Pharmacy Services as well as the Enhanced Clinical Services at an additional $1,000 per month. IDJC does not have the in-house capability to perform these services and requires the exemption due to the impracticality and unreasonableness of conducting a competitive procurement process without service interruption.

IDAPA 38.05.01.042.10 provides that the administrator may exempt an acquisition from competitive procurement if the administrator determines that bidding is impractical, disadvantageous or unreasonable under the circumstances. Examples include, but are not limited to: special market conditions; property requiring special contracting procedures due to uniqueness; and services for which competitive solicitation procedures are impractical.

Describe the circumstances
This is a request to extend the current approved OTE, which is approved through September 30, 2023, to allow Purchasing time to get an Idaho MMCAP contract with Correct Rx for Prescription Filling and Pharmacy Services (and Enhanced Clinical services) in place. With this request OTE request, we ask that it be for six (6) months, or however long it takes for Purchasing to get a contract in place, whichever is shorter.
IDJC has an on-going need for Prescription Filling and Pharmacy Services. We have been anticipating that a PADD under the new MMCAP contract for such would have been awarded by now, but, per communications with Michael Piccono with the Division of Purchasing, some difficulties with MMCAP have been encountered.
We currently have an interim contract with Correct Rx (attached). It was written for 1 month (January 2023), but allows for 1-month renewals.

Notes
Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?
IDJC cannot go without these services for juveniles within its Juvenile Correction Centers. IDJC does not have staff at those facilities to perform these services. We also do not have sufficient time to competitively bid these services without service interruption. We anticipate that the Division of Purchasing will eventually work through the difficulties with MMCAP, and that we can then work through the process to identify the company to whom a PADD will be awarded, and our needs will then be contractually covered long-term.
Describe the extent to which competition is possible
Please see the information in the above Background and Justification.
This is also an LDPA request because we only have $50,000 in delegated purchasing authority.
Included in the interim contract are Enhanced Clinical services (a.k.a., chart review services). It costs approximately an additional $1,000.00 per month.
(Attached to this request is IDJC's interim contract and all amendments, and the previous two approved OTE requests.)
The information provided above is true and accurate to the best of my knowledge, and supports the need for a direct procurement of the described goods or services, in the best interest of the State:
