About this file
This document is a Request Form to the Division of Purchasing (DOP) from the Idaho Department of Juvenile Corrections (IDJC) seeking a one-time exemption from competitive procurement for Prescription Filling and Pharmacy Services. IDJC has an ongoing need for these services but has been unable to secure a new contract through the MMCAP purchasing consortium before the expiration of their current interim contract with Correct Rx Pharmacy Services, Inc. IDJC is requesting a 5-month extension of the interim contract to avoid service interruption for juvenile offenders in their Correction Centers, as IDJC does not have the in-house staff to provide these services.
The request outlines that competition would be impractical and unreasonable under the circumstances, as IDJC cannot go without these critical pharmacy services and does not have sufficient time to competitively bid a new contract before the current interim agreement expires. IDJC anticipates that the Division of Purchasing will eventually resolve the issues with MMCAP and be able to award a new long-term contract, at which point IDJC's needs would be covered through that process. The total anticipated cost for the 5-month interim contract extension is $55,000, which exceeds IDJC's $50,000 delegated purchasing authority, necessitating the DOP exemption request.

IDAPA 38.05.01.042.10 provides that the administrator may exempt an acquisition from competitive procurement if the administrator determines that bidding is impractical, disadvantageous or unreasonable under the circumstances. Examples include, but are not limited to: special market conditions; property requiring special contracting procedures due to uniqueness; and services for which competitive solicitation procedures are impractical.

Describe the circumstances
IDJC has an on-going need for Prescription Filling and Pharmacy Services. We have been anticipating that a PADD under the new MMCAP contract for such would have been awarded on or before January 1, 2023, but, per communications with Michael Piccono with the Division of Purchasing, some difficulties with MMCAP have been encountered.
We currently have an interim contract with Correct Rx (attached). It was written for 1 month (January 2023), but allows for 1 month renewals.
Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?
IDJC cannot go without these services for juveniles within its Juvenile Correction Centers. IDJC does not have staff at those facilities to perform these services. We also do not have sufficient time to competitively bid these services without service interruption. We anticipate that the Division of Purchasing will eventually work through the difficulties with MMCAP, and that we can then work through the process to identify the company to whom a PADD will be awarded, and our needs will then be contractually covered long-term.

Describe the extent to which competition is possible
Please see the information in the above Background and Justification.
This is also an LDPA request because we only have $50,000 in delegated purchasing authority.
And, we would like to add the chart review service to this interim contract described in the attached document with “Provision of Enhanced Clinical Services” on the first page. It will cost approximately an additional $1,000.00 per month. If we’re allowed to do this, we will further edit the draft amendment to include this.
