About this file
This document is a request form submitted to the Idaho Division of Purchasing (DOP) by the Idaho Department of Juvenile Corrections (IDJC) seeking an exemption from competitive procurement for the purchase of Prescription Filling and Pharmacy Services. IDJC requires these services on an ongoing basis for its Juvenile Correction Centers, but does not have the internal staff capacity to provide them. Due to difficulties encountered in securing a new contract through the MMCAP purchasing consortium, IDJC is requesting a three-month extension of its current interim contract with Correct Rx Pharmacy Services, Inc. to allow time for the MMCAP contract to be finalized.
The total anticipated cost for the three-month extension is $33,000. IDJC has also included a chart review service in the interim contract that is not covered under the MMCAP agreement, which adds approximately $1,000 per month to the cost. The DOP has the discretion to approve or deny IDJC's request for an exemption from competitive procurement, and suppliers are invited to provide information that may support or contradict IDJC's claim that competition is impractical or unreasonable under the circumstances.

Describe the circumstances
This is a request to extend the current approved OTE through September 30, 2023 to allow Purchasing time to get an Idaho MMCAP contract with Correct Rx for Prescription Filling and Pharmacy Services in place.
IDJC has an on-going need for Prescription Filling and Pharmacy Services. We have been anticipating that a PADD under the new MMCAP contract for such would have been awarded by now, but, per communications with Michael Piccono with the Division of Purchasing, some difficulties with MMCAP have been encountered.
We currently have an interim contract with Correct Rx (attached). It was written for 1 month (January 2023), but allows for 1-month renewals.

Notes
Why would the competition be impractical, unreasonable, or disadvantageous under the circumstances?
IDJC cannot go without these services for juveniles within its Juvenile Correction Centers. IDJC does not have staff at those facilities to perform these services. We also do not have sufficient time to competitively bid these services without service interruption. We anticipate that the Division of Purchasing will eventually work through the difficulties with MMCAP, and that we can then work through the process to identify the company to whom a PADD will be awarded, and our needs will then be contractually covered long-term.
Describe the extent to which competition is possible
Please see the information in the above Background and Justification.
This is also an LDPA request because we only have $50,000 in delegated purchasing authority.
Included in the interim contract is a chart review service which is not offered under MMCAP. It costs approximately an additional $1,000.00 per month.
The information provided above is true and accurate to the best of my knowledge, and supports the need for a direct procurement of the described goods or services, in the best interest of the State:

This exemption will be sent for posting before final approval
The Agency is authorized to issue a contract for an amount up to the anticipated total cost and for a period not to exceed the duration identified above.
DOP will issue and administer a contract pursuant to this Exemption.
The Agency must engage in competition to the greatest extent possible, while meeting Agency needs (specific requirements may be detailed below).
The procurement is exempted from the formal sealed procedure, but the Agency must obtain at least 3 quotes from vendors with a significant Idaho economic presence.
Any agreement resulting from this Exemption must be in writing, must comply with Idaho laws and policies, and must comply with best practices in contracting to the greatest extent practical. It is recommended that the Agency consult with its legal counsel.
