About this file
This is a Questions and Answers document issued by the State of Maryland's Department of Budget and Management regarding Project No. BPM054797 for Third-Party Administrator (TPA) Services for Flexible Spending Accounts. The solicitation covers TPA services for the State of Maryland's Healthcare Flexible Spending Account (HCFSA) and Dependent Daycare Flexible Spending Account (DCFSA) plans, serving approximately 125,000 eligible employees across all subgroups. The current contract began on January 1, 2017, and expires on December 31, 2026, with the new contract expected to commence in 2027. The Q&A document addresses 38 questions submitted by potential offerors and clarifies requirements related to enrollment system capabilities, claims data integration, debit card substantiation, reporting methodologies, performance guarantees, and technical proposal submission requirements. Key clarifications include confirmation that the current enrollment system will capture enrollment and deductions for Commuter Benefits if implemented, that letters regarding unsubstantiated debit card transactions and claim errors are released quarterly with typically fewer than 100 sent annually, and that performance guarantees are non-negotiable with no flexibility permitted.
The State currently conducts satisfaction surveys in-house at no charge, though offerors will share costs if the survey is outsourced and billed annually. Current administrative fees are confidential and cannot be shared. The State uses Workday as its HRIS system and is interested in service enhancements available over the past seven years, with Commuter/Transit services not anticipated for implementation before 2028. The RFP includes an 18% overall Minority Business Enterprise (MBE) goal with 15% in subgoals, permitting the remaining 3% to be allocated to any certified MBE partner of any category. Digital and electronic signatures are acceptable on all Word and PDF documents. The non-compete clause prohibition (Section 3.19) is not mandatory but requires waiving any non-compete clause during transfers if applicable. No bid bond is required for this solicitation. Offerors must submit technical proposals addressing each RFP Section 2 requirement with cross-references and explanations of how proposed services will meet or exceed requirements, with supporting attachments submitted according to specifications in Table A of Section 5.3.

February 19, 2026
Ladies/Gentlemen:
This List of Questions and Responses, questions #1 - 38, is being issued to clarify certain information contained in the above-named solicitation.
In most instances the Department’s response to the submitted questions merely serves to clarify the existing requirements of the solicitation. Sometimes, however, in submitting questions potential Offerors may make statements or express interpretations of contract requirements that may be inconsistent with the
Department’s intent. To the extent that the Department recognizes such an incorrect interpretation, the provided answer will note that the interpretation is erroneous and either state that the question is moot once the correct interpretation is explained or provide the answer based upon the correct interpretation. No provided answer to a question may in and of itself change any requirement of the solicitation. If it is determined that any portion of the solicitation should be changed based upon a submitted question, the actual change may only be implemented via a formal amendment to the solicitation. In this situation the answer provided will reference the amendment containing the change.
