About this file
This is a Questions and Answers document from the Florida Department of Transportation (FDOT) dated August 22, 2024, regarding RFP DOT-RFP-25-3002-CS for Cultural Resources Assessment Services. The document addresses four key questions from potential proposers about team composition, subcontractor arrangements, and contractual terms.
The document clarifies several important procurement details: Project Managers can technically come from either prime or subconsultant firms though typically are employed by the Prime; companies are permitted to submit proposals as both a prime contractor and a subcontractor on different teams; and there is a liquidated damages clause of $100 per day for late deliveries that cannot be waived or modified. The agency explicitly states that any conditions placed on proposal aspects may result in rejection as a conditional proposal, and submission of a proposal constitutes acknowledgment and acceptance of all RFP terms and conditions.

Date: August 22, 2024 To: All Proposers RE: Questions and Answers 1 Proposal ID: DOT-RFP-25-3002-CS Description: Cultural Recourses Assessment Services
1. There appears to be no restrictions in the RFP about key personnel belonging to the prime or subconsultant firm. Is this accurate? For example, in a true teaming situation, could the Project Manager come from either firm?
Response: Yes, typically the Project Manager would be employed by the Prime. In either case, the proposed Project Manager will be evaluated based upon the requirements in the Request for Proposal and Scope of Services documents.
2. The RFP specifies that subcontractors may appear in more than one proposal
(21.2). But it is not clear whether a company can submit as both a prime contractor as well as join a team as a subcontractor. Is this allowable?
Response: Yes.
3. Are consulting firms permitted to pursue as a Prime and also as a sub from another Prime firm?
Response: Yes.
4. In section 37 on page 25 of the RFP, there is a statement that contains a liquidated damages clause of $100/per day for each calendar day that we are late in delivery.
Because it's against our company policy, which would prevent us from submitting a proposal on this contract - if we request to waive Liquidated Damages, would this disqualify us from winning this work?
Response: Per the Price Proposal Form, submittal of a proposal for this procurement constitutes acknowledgement and willingness to abide by all terms and conditions outlined in the Request for Proposal documents. In addition, Section 20, Additional Terms and Conditions, of the RFP states, “No conditions may be applied to any aspect of the RFP by the proposer. Any conditions placed on any aspect of the proposal documents by the proposer may result in the proposal being rejected as a conditional proposal (see
“RESPONSIVENESS OF PROPOSALS”).”
