About this file
This document is a memorandum from the Florida Department of Transportation (FDOT) containing questions and responses regarding a Request for Proposal (RFP) for Cultural Resources Assessment Services, Proposal ID: DOT-RFP-25-3002-CS. The RFP allows for teaming arrangements, where the Project Manager can be employed by either the Prime or a Subconsultant firm. Additionally, consulting firms are permitted to pursue as both a Prime and a Subcontractor. The RFP includes a liquidated damages clause of $100 per calendar day for late delivery, which the respondents are required to acknowledge and accept as part of the proposal submission.
The memorandum clarifies that while subcontractors may appear in more than one proposal, the inclusion of any conditions by the proposer on any aspect of the proposal documents may result in the proposal being rejected as a conditional proposal. The RFP does not specify any set-asides, incumbents, or funding requirements, and the term of the contract, including any renewal options, is not provided.

Date: August 22, 2024 To: All Proposers RE: Questions and Answers 1 Proposal ID: DOT-RFP-25-3002-CS Description: Cultural Recourses Assessment Services
1. There appears to be no restrictions in the RFP about key personnel belonging to the prime or subconsultant firm. Is this accurate? For example, in a true teaming situation, could the Project Manager come from either firm?
Response: Yes, typically the Project Manager would be employed by the Prime. In either case, the proposed Project Manager will be evaluated based upon the requirements in the Request for Proposal and Scope of Services documents.
2. The RFP specifies that subcontractors may appear in more than one proposal
(21.2). But it is not clear whether a company can submit as both a prime contractor as well as join a team as a subcontractor. Is this allowable?
Response: Yes.
3. Are consulting firms permitted to pursue as a Prime and also as a sub from another Prime firm?
Response: Yes.
4. In section 37 on page 25 of the RFP, there is a statement that contains a liquidated damages clause of $100/per day for each calendar day that we are late in delivery.
Because it's against our company policy, which would prevent us from submitting a proposal on this contract - if we request to waive Liquidated Damages, would this disqualify us from winning this work?
Response: Per the Price Proposal Form, submittal of a proposal for this procurement constitutes acknowledgement and willingness to abide by all terms and conditions outlined in the Request for Proposal documents. In addition, Section 20, Additional Terms and Conditions, of the RFP states, “No conditions may be applied to any aspect of the RFP by the proposer. Any conditions placed on any aspect of the proposal documents by the proposer may result in the proposal being rejected as a conditional proposal (see
“RESPONSIVENESS OF PROPOSALS”).”
