About this file
This document is a Question and Answer (Q&A) Set #1 related to an Invitation For Bid (IFB) issued by the State of California, Department of General Services, Procurement Division (DGS-PD) for Electric Vehicle Supply Equipment (EVSE). The IFB covers the sale and distribution of EVSE products, as well as installation/removal services and network management systems and services. The IFB is divided into 11 groups, with specific requirements for Group 11 related to network management systems and software. The IFB has a Bidders Conference, and clarifies that joint bids and joint ventures are not acceptable. The IFB contains detailed requirements around customer references, licensing, product specifications, product refreshes, pricing, and catalog offerings.
The IFB requires that all EVSE products have a California Type Evaluation Program (CTEP) Certificate of Approval, and provides specific details on the requirements for Group 11 chargers. The IFB also addresses topics such as the waiving of diagnostic fees, the inclusion of non-core catalog items, and the ability to bid multiple manufacturers. The contract resulting from this IFB will be for the State of California, as well as Sacramento County and Sacramento City.

State’s Response
1-1
Can a Bidder’s Customer References include international customers?
IFB Section 38, Customer References states, “Customer References must be for the Bidder. Customers are defined as end-users of the product. References from a contractor for which the Bidder did sub-contract work are not acceptable.
Customer references shall:
· Be for work performed within the last five (5) years prior to bid submission due date.
· Be for similar product (i.e., sale and distribution of EVSE) to that requested in this IFB.
· In total, must be valued at or above $500,000.00 for Groups 1-4 and $2,000,000.00 for Group 11. An accumulation of orders from a single customer or multiple references from different customers totaling the applicable minimum value is acceptable.
· Confirm that the Bidder’s overall performance of contract requirements was, at minimum, satisfactory.
References from the DGS-PD are not acceptable. References for transactions against California Statewide Contracts or other Leveraged Procurement Agreements must be from an ordering department.”
Answer: Yes. The IFB does not prohibit references from international customers.

For the Customer References, can they be for product lines that are different than what is being bid as long as they are still EV chargers?

1-6
There are a number of important products that are "in process" for CTEP but not yet finalized. Can these qualify?
Attachment 2A, Bid Specification 6115-0308580 Section 4.1.1 states, “Must have California Type Evaluation Program (CTEP) Certificate of Approval (COA).”
Answer: No.
1-7
What happens if a Bidder submits a bid for a product that is later replaced by a next generation product before the end of the contract term?
IFB Section 56, Product Refresh states, “The State expects EVSEs and associated products to be periodically updated as technology changes, which can be estimated to take place approximately every year, as technology may need to stay compliant with Federal and State regulations. Contractor is required to:
· Support this effort throughout the life of the resulting contract.
· Maintain the blanket discounts at the levels in the contract, even as configurations evolve.
· Proactively report to the State Contract Administrator at least every twelve (12) months, or as needed, on changes in technology and make recommendations for model changes for each configuration based on product life cycles.
· Notify the State Contract Administrator regarding product replacement at end of product life cycle or End of Life (EOL) at least 60 calendar days prior to the EOL date.
· At the time of refresh notification, Contractor shall provide to the State Contract Administrator the following:
· Description of items going EOL and their replacements.
· A side-by-side comparison of the proposed product to the product being replaced and its corresponding configuration specifications.
· An up-to-date Road Map of the products proposed to refresh the configurations.
· An OEM price list containing the items offered in the proposed refreshed line items.
If no substitute product is available that meets or exceeds the specifications due to fundamental technology or market change, the State may alter the configuration requirements to meet the updated marketplace standards. Obsolescence of a configuration may be determined at the State’s discretion.
The Contractor shall not substitute products or configurations or modify catalog information without written approval from the State Contract Administrator.”
Answer: Please see IFB Section 56, Product Refresh.
1-8
For the Diagnostic fee, if waived, do Bidders put 0s in the Pricing Workbook for that line item?
IFB Section 25, Repair Services states, “The Diagnostic Fee proposed on Attachment 1 – Pricing Workbook may be assessed to determine the scope of needed repairs on damaged EVSEs. The Diagnostic Fee will be waived if the ordering agency approves repairs to the EVSE or if damage is significant enough that the EVSE is approved for replacement.”
Answer: The Diagnostic Fee will be waived under the conditions outlined in the IFB. The Diagnostic Fee line item in the Pricing Workbook is to be provided by the Bidder. If the Bidder chooses to waive the Diagnostic Fee for any and all conditions, the Bidder would indicate $0 to show the Diagnostic Fee is always free of charge no matter the circumstances. If the Bidder indicates $0 cost for the Diagnostic Fee, the Bidder must not charge ordering agencies a Diagnostic Fee under a resulting contract.
1-9
Can a Bidder’s non-core catalog include additional product lines that are different than the core products bid?
IFB Section 32, Pricing Structure states, “Items outside of the scope of the IFB shall not be allowed. Only products within the scope of an awarded Group may be sold under a resulting contract. Non-Core items shall not infringe on products offered through other awarded Groups.”
IFB Section 54, Non-Core Catalog states, “The Bidder must provide a Non-Core Catalog which includes options and accessories for each EVSE proposed.”
Answer: No.
1-10
CTEP certification is required for Group 11, but there are very few choices on the market that are already certified. However, we know of a number of products from well-known manufacturers that are in process. Given this situation, can Bidders bid with equipment that is in the process of certification and still qualify if the Bidder provides evidence that the process has started?
Attachment 2A, Bid Specification 6115-0308580 Section 4.1.1 states, “Must have California Type Evaluation Program (CTEP) Certificate of Approval (COA).”
Answer: No.
1-11
Can a Bidder bid multiple manufacturers in the same group?
IFB Section 33, Pricing Workbook states, “Attachment 1 – Pricing Workbook contains the price sheets that the Bidders shall use to enter pricing/discounts for the IFB. In order to be considered for award, all line items in a Core Group in Attachment 1 – Pricing Workbook must be bid.”
The intent of this question is not clear. Two potential answers are below however you may submit another question to clarify the intent of this question if needed.
If asking whether a Bidder can include multiple manufacturers in the various line items for a Group: Answer: Yes.
If asking whether a Bidder can offer a complete Group with one manufacturer and a complete Group with another manufacturer: Answer: Yes. To bid multiple manufacturers, a Bidder must submit an entire bid per each manufacturer. All required documents would need to be provided for each Bid. Partial Bids will not be accepted.
1-12
Will Bidders receive a copy of the Bidders Conference slides?
N/A
Answer: Copies of the Bidders Conference slides are available on CaleProcure. Interested parties must review the IFB documents and attachments in their entirety and not rely on the high level information provided in the Bidders Conference.
1-13
