361 G.5.2 Section G.5.2 Associated Government Fee. This section contains the only reference to un-priced CLINs and states in pertinent part that “any equipment, travel, or per diem not priced under the contract for a task order is to be priced at expense, exclusive of any profit.” Since this language is inconsistent with the provisions of FAR related to Labor Hour/Time and Materials treatment of costs and is really extraneous to a discussion of the AGF, we suggest that the GSA amends the solicitation to remove the phrase.
This will also fix another inconsistency caused by this language which gave OCO the ability to make a determination of price reasonableness
“Un-priced CLINs” has been changed to “un-priced items” in Amendment 5. Section G.5.2 has been amended to clarify the intent regarding AGF.
New language:
“Materials provided under a Time and Materials task order, as defined in FAR 52.232-7, shall reflect the contractor's actual expense for the item and will include the Associated Government Fee for Contract Access.”
G.3.1(e) does give the OCO the ability to make a determination of price reasonableness for un-priced items.
362 B.1.2.3 The solicitation states, “A one-time charge that may be incurred when a service or item of equipment is cancelled within 5 business days of the scheduled due date.” In commercial practice, a cancellation charge may be made 15 or 30 days before the scheduled due date. An even longer time may be used for orders of construction materials and similar bulky products.
Will the government amend this provision to allow the contractor to charge a cancellation fee within 15 or 30 days of the scheduled due date?
An amendment will be made to B.1.2.3 to add the wording "or as otherwise provided in the task order. The cancellation charge shall not exceed the installation charge for the order or as otherwise provided in the task order".
363 B.1.2.3 It may be that equipment will already be in transit when the cancellation is received by the Contractor. How may the Contractor be compensated for shipping costs in this case?
