ELECTRIC & ELECTRIC EXTENDED-RANGE VEHICLES
QUESTIONS AND ANSWERS #2 – 7/18/2012
Q1. Is the Emissions Tab only for entering information on the base engine? Or should optional engine information be entered on the Emissions Tab as well?
A1. All emissions statements applicable to the base or optional engines should be on the Emissions Tab for each line item being offered. There is sufficient space to make entries for all engines. Offerors are instructed to indicate for the base engine as well as optional engines if the vehicle is 50-state certified in this section. If certain states cannot receive delivery of a particular engine, this information should be clearly identified on the Emissions Tab along with the engine/emissions to be provided in those states. “Green states” and “non-green states” are not valid descriptions. Specific states should be identified.
Q2. Is the subject solicitation funded under the American Recovery and Reinvestment Act of 2009? The SF 1449 does not reference the ARRA.
A2. Contract clause 52.204-11 American Recovery and Reinvestment Act – Reporting Requirements, is incorporated by reference on page 51 of the solicitation under section D.7 – 52.215-5 Contract Terms and Conditions Required to Implement Statutes of Executive Orders – Commercial Items (May 2012) (Alternate II – Dec 2010). This contract as a whole is not funded exclusively by Recovery Act funds. However, any purchase orders funded in whole or in part by the Recovery Act will be clearly identified as part of the agency order number upon transmission to the vendors. At this time, GSA does not anticipate additional Recovery Act-funded purchase orders; however this clause is incorporated should circumstances change.
If an offeror does not wish to accept orders funded by the Recovery Act, offerors should submit the request on page 1 of the Vendor Response Document – “Exceptions to Terms and Conditions”. No exception shall be granted until approved by the contracting officer.
References:
4.1501 Procedures.
(a) In any contract action funded in whole or in part by the Recovery Act, the contracting officer shall indicate that the contract action is being made under the Recovery Act, and indicate which products or services are funded under the Recovery Act. This requirement applies whenever Recovery Act funds are used, regardless of the contract instrument.
4.1502 Contract clause.
Insert the clause at 52.204-11, American Recovery and Reinvestment Act—Reporting Requirements in all solicitations and contracts funded in whole or in part with Recovery
Act funds, except classified solicitations and contracts. This includes, but is not limited to, Governmentwide Acquisition Contracts (GWACs), multi-agency contracts (MACs), Federal Supply Schedule (FSS) contracts, or agency indefinite-delivery/indefinite-quantity (ID/IQ) contracts that will be funded with Recovery Act funds. Contracting officers shall ensure that this clause is included in any existing contract or order that will be funded with Recovery Act funds. Contracting officers may not use Recovery Act funds on existing contracts and orders if the clause at 52.204-11 is not incorporated.
Q3. Please clarify or provide guidance on what would be considered emerging technology that would require vehicle inspection for conformity with contract specifications (reference Section D.50 – First Production Vehicle).
A3. Emerging technology is defined in Section B.6 under Statutory Price Limitations:
“Provided further, that the limits set forth in this section shall not apply to any vehicle that is a commercial item and which operates on emerging motor vehicle technology, including but not limited to electric, plug-in hybrid electric, and hydrogen fuel cell vehicles.”
If an offeror takes exception to this requirement, offerors should submit the request on page 1 of the Vendor Response Document – “Exceptions to Terms and Conditions”. No exception shall be granted until approved by the contracting officer.
