About this file
This is a Question and Answer (Q&A) Set #2 document for Event ID 0000000179 regarding Herbicides and Insecticides procurement, dated February 19, 2016. The document addresses questions about returnable/refillable containers and blending fee items (Items 46 and 47) across tabs A through F. Key specifications include a 60-gallon minimum order requirement for returnable/refillable containers and blending services, which was added through Addendum 2. The document clarifies that there are no specific container size requirements for blends beyond industry standards, though various container sizes from 5-gallon to 330-gallon are discussed.
The Q&A addresses operational requirements including that only contract items are allowable for blending orders, with non-contract items being outside scope. The document also clarifies insurance requirements, stating that successful bidders must maintain all appropriate insurance and licensing for the sale, storage, and transportation of contract items. This includes business liability insurance for pesticide sales, vehicle insurance for herbicide transport on state property, and coverage for agricultural chemical handling.

Question and Answer (Q&A) Set #2
1 02/19/2016
Item Question State’s Response 2-1 Questions on Returnable/Refillable containers and Blending
Fee Items — Items 46 and 47 on all tabs A, B, C, D, E, and F: Is there a minimum quantity required to use these services? The contractor we currently use to provide these services requires a 60-gallon minimum order in order to make their pumping and mixing equipment function properly. Since these are custom orders, not kept in inventory, can this minimum order be added to the bid?
A 60 gallon minimum order will be added for Returnable, Refillable containers and Blending, line items 46 and 47 on all tabs. Please refer to Addendum 2 for revision of IFB Section 26 - Minimum Order.
2-2 Questions on Returnable/Refillable containers and Blending Fee Items — Items 46 and 47 on all tabs A, B, C, D, E, and F:
Are there container size specifications on blends? While simple re-packs of a single herbicide can be done in 15, 30, 120, and 330-gallon containers, blends have the possibility of separating and need agitation. Thus blends, such as a 50:50 blend of Garlon 4 Ultra with Hasten-EA, are usually packed in 15-gallon drums. Blends of multiple materials, such as four herbicides and two adjuvants for pre-emergent control, are usually blended in 5-gallon plastic “cubes” for ease of handling. There would thus be a 12 x 5-gallon minimum order to process this order. Can this process be added to the bid specification?
There are no container size specifications on blends other than what is available as standard in the industry. Please refer to item 2-1 of this Q&A document.
2-3 Questions on Returnable/Refillable containers and Blending Fee Items — Items 46 and 47 on all tabs A, B, C, D, E, and F: If agencies making two or more small orders could wait until these total equals 60 or more gallons (usually in 5-gallon increments), smaller orders could be processed. Could this be added to the specifications?
Please refer to item 2-1 of this Q&A document.
2-4 Questions on Returnable/Refillable containers and Blending Fee Items — Items 46 and 47 on all tabs A, B, C, D, E, and F:
What happens when a bid order includes, for example, six materials, two of which are not on the contract, e.g., Portfolio 4F California, and an agency item sold directly by the manufacturer to the end user, such as Esplanade 200 CS? These mixes are very commonly recommended by Pest Control Advisers, so guidance would be appreciated.
Only contract items are allowable on the purchase order. Purchases of blends that include non-contract items would be considered outside the scope of the contract.

Item Question State’s Response 2-5 California’s general provisions, section 21, requires the contractor to maintain appropriate insurance policies (GSPD- 401Non-IT Commodities) Assuming you intend to enforce this:
• Will you require a certificate of business liability insurance to extends coverage's regarding the sale of pesticides (herbicides) to the state?
• What are the insurance requirements for vehicles, moving herbicides, operating on state property?
• Will you require business liability policy that covers the sale, storage and delivery of Ag Chemicals aka herbicides?
• Will an errors and omissions [E&O] policy be required for the Pest Control Advisor?
The state requires the successful bidder to have and maintain all appropriate insurance and licensing for the sale, storage and transportation of contract items.
