About this file

This is a Question and Answer (Q&A) document (Set #1) for Event ID 0000000179 regarding a Herbicides and Insecticides contract solicitation from an unnamed state agency. The document addresses questions about product specifications, certifications, and small business participation requirements.

The Q&A clarifies several key points: the state does not intend to restrict participation regarding OEM and reseller relationships; explains that EcoWise certification, while not required, is a third-party certification program that identifies pest management professionals who practice prevention-based pest control; and addresses the application of Small Business and DVBE preferences. The document indicates that there are six different contract segments available, with total preferences not to exceed $100,000 pursuant to Government Code 14838(b). The solicitation requires bidders to have or employ/subcontract with individuals holding valid Pesticide Control Adviser's (PCA) licenses.

State’s Response

At least some of these products appear to be agency only products [Syngenta, DuPont-Bayer]. There are at least two problems with these.

1. Small business are not allowed to sell these, by requiring “all or Nothing” this bid precludes any small business participation.

Is that your intention? I am certain it is not, but the result is only the agents of Syngenta and Bayer can quote on this bid. Sonar is also an agency product but the manufacture may allow small business participation.

It is not the intent of the State to restrict participation. The State cannot dictate relationships between Original Equipment Manufacturers (OEMs) and resellers.

What is the Eco-Wise certificate? It is not issued by the state of California (unlike the PCA license) and I understand this certificate is designed for ‘For-Hire Termite Control’ companies. How is it pertinent to this bid for herbicides?

In section 16 of the Solicitation, titled Pesticide Control Adviser’s (PCA) License requires Bidders to have a valid PCA or employ or subcontract with an individual that does have a valid PCA. Furthermore Section 17. Pest Control Adviser’s (PCA) and Ecowise Practitioner Services asks the Bidder to identify PCA who are also EcoWise Certified Practitioner. But it is not required.

EcoWise Certified is an independent, third-party certification program that distinguishes knowledgeable, leading-edge licensed pest management professionals who practice prevention-based pest control. EcoWise Certified practitioners employ a variety of common sense techniques to control pests effectively, minimizing the need to use pesticides.

The use of EcoWise certification ensures that agencies that require PCA services can identify PCAs who are trained in Integrated Pest Management and strive to minimize the use of pesticides, which align with California’s environmentally preferable purchasing goals.

I'm curious how the Small Business and or DVBE preference would be applied for this bid. There is actually 6 different contracts available. There should be the total preference (up to 100k) available for each of the 6 segment, correct?

Pursuant to Government Code 14838(b), and Attachment 7 - California Disabled Veteran Business Enterprise (DVBE) Bid Incentive Instructions, total preferences for the entire bid shall not exceed $100,000. Preferences will be applied, to the extent possible, to maximize participation of small businesses in the contract award.
