About this file
This document is a Purchasing Affidavit form required by the State of West Virginia Purchasing Division for all vendors and prospective vendors bidding on state contracts. The affidavit mandates compliance with W. Va. Code 5A-3-10a, which prohibits contract awards to vendors or related parties that owe debts exceeding one thousand dollars in aggregate or are in employer default status. The form requires the vendor's authorized representative to sign and swear under penalty of law that neither the vendor nor any related party meets these debt or default criteria. The document specifies that debt includes any assessment, premium, penalty, fine, tax, or other amounts owed to the state or its political subdivisions due to judgment, license violations, workers' compensation issues, or other delinquent obligations with accrued interest or penalties.
The affidavit includes an exception for vendors who have contested taxes, workers' compensation premiums, permit fees, or environmental assessments that have not become final, or who have entered into a payment plan and remain in compliance. The form defines "related party" as any individual, corporation, partnership, or other entity connected to the vendor through blood, marriage, ownership, or contract where the party receives or controls a portion of benefits or profit representing five percent or greater of the total contract amount. Execution of this affidavit must occur before a notary public, who must affix their seal and record their commission expiration date. This form serves as a certification document applicable to all state and political subdivision contract opportunities in West Virginia.
