About this file

This file contains bid bond preparation instructions issued by the State of West Virginia's Department of Administration for use in responding to requests for quotations or proposals. The document provides a standardized bid bond template and detailed instructions for completing each required field. Bidders must submit a bid bond as part of their proposal submission to the Purchasing Section of the Department of Administration. The bond serves as a guarantee that the bidder will enter into a contract if their bid is accepted and will furnish any additional bonds and insurance required by the solicitation documents.

The minimum acceptable bid bond amount is five percent of the total bid value, which may be expressed either as a percentage or as a specific dollar amount. The surety executing the bond must be licensed in West Virginia to transact surety insurance, must affix its corporate seal, and must attach a dated power of attorney with the surety's seal affixed. The principal and surety must execute the bond with proper signatures and seals, with the principal signature requiring authorization from a president, vice president, or duly authorized agent. The surety's liability is capped at the penal amount stated in the bond, and the surety waives notice of any extension of time granted by the State for bid acceptance.
