About this file
This is a Purchasing Affidavit form issued by the State of West Virginia Purchasing Division, required for vendor participation in state and political subdivision contracts. The affidavit mandates that no contract or renewal may be awarded to any vendor or related party that owes a debt exceeding one thousand dollars in aggregate or is in employer default, as defined under W. Va. Code 5A-3-10a. The document establishes definitions for "debt," "employer default," and "related party," with "related party" defined as any individual, corporation, partnership, or other entity related to a vendor by blood, marriage, ownership, or contract that receives or controls a portion of benefit, profit, or consideration from the vendor contract at five percent or greater of the total contract amount. An exception applies when a vendor has contested a tax, workers' compensation premium, permit fee, or environmental fee and the matter has not been finalized, or when the vendor has entered into a payment plan and remains in compliance.
The vendor's authorized signatory must affirm under penalty of law for false swearing that neither the vendor nor any related party owes prohibited debt or is in employer default unless permitted under the established exception. The affidavit requires notarization and must be executed before a notary public with official seal affixed. The form includes fields for the vendor name, authorized signature, date of execution, state and county jurisdiction, notary commission expiration date, and RFQ number reference, establishing a binding legal declaration of the vendor's financial and compliance standing with the State of West Virginia.
