About this file
This is a Public Construction Bond form template issued by the City of St. Petersburg, Florida, County of Pinellas, for use in construction manager contracts with a guaranteed maximum price (GMP). The bond serves as a performance and payment guarantee document for construction-phase activities, with the principal contractor and surety jointly and severally binding themselves to the City for faithful performance of the construction contract. The bond conditions require the principal to comply with all contract terms and conditions for the original contract term and any extensions granted by the City, promptly pay all claimants supplying labor, materials, or supplies used in the work, pay the City for any losses, damages, liquidated damages, and related costs resulting from principal default, and fulfill all guarantee and warranty obligations for work and materials furnished. The bond is designed to comply with Section 255.05 of the Florida Statutes and incorporates all surety duties and notice and time limitation provisions required by that statute, with any claimant action under the bond subject to the notice and time limitations set forth in Florida law.
The surety waives notice of any changes, extensions of time, alterations, or additions to contract terms, work specifications, or work scope, and agrees that such modifications shall not affect its bonding obligations. The surety executing the bond must be an attorney-in-fact with a valid Florida license, and a copy of the power of attorney attested by the corporate secretary must be attached. Both the principal and surety must provide notarized acknowledgments with appropriate identification, and the City Attorney (or designee) must approve the bond as to form prior to execution. The bond penal sum amount is left blank for completion based on the specific contract's GMP, and the bond applies specifically to the Police K-9 Compound project located in St. Petersburg, which is estimated at $10,600,000 for construction management services.
