About this file

This is a Professional Services Supplemental document effective July 2024 for a COVID PCR Testing contract at Spring Grove Hospital Center in Maryland. The supplemental establishes additional requirements under Section 2 of the solicitation and applies security, personnel, and compliance protocols to contractor personnel working on the contract. Key requirements include mandatory employee identification badges displayed at all times on State premises, cooperation with State site requirements including potential escort requirements and badge issuance procedures, and State authority to remove personnel who fail to adhere to security requirements. The State reserves the right to conduct criminal background checks and refuse work authorization based on specified criminal convictions. Personnel may be subject to random security checks, physical searches, tool and equipment inventories at facility entrances and exits, fingerprinting, photography, and identification card issuance, particularly at Department of Public Safety and Correctional Services facilities and State General Hospital Center (SGHC) premises. Any designated personnel substitutions after contract commencement require prior written approval from the Contract Monitor, with unauthorized substitutions subject to contract termination for default.

The solicitation does not require a Department of Human Services Hiring Agreement or Location of the Performance of Services Disclosure. However, if the State determines that contract functions constitute Business Associate functions under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the recommended awardee must execute a Business Associate Agreement within five business days of proposed award notification or risk withdrawal of the award recommendation. The document recommends that contractors complete and submit the Business Associate Agreement with their bid or proposal to expedite processing. Contractor personnel must comply with Maryland Code Annotated Criminal Law Articles 9-410 through 9-417 and applicable agency security policies, with non-compliance constituting grounds for immediate contract termination for default.
