About this file
This is an addendum to a Request for Proposal (RFP) issued by the City of Tucson's Environmental Services Department for processing and marketing of recyclable materials collected through the City's Single Stream Recycling Program, Neighborhood Recycling Centers, and commercial recycling programs. The solicitation presents two operational scenarios: a Material Recovery Facility (MRF) sited at the City's Los Reales Landfill or a contractor-owned and operated facility located within two miles of Tucson city limits. The City collected approximately 23,577 tons of recyclable materials in fiscal year 2024, including plastics, aluminum, tin, cardboard, paper, and glass. A mandatory pre-submittal meeting is scheduled for December 17, 2025, at 10:00 AM at the Los Reales Sustainability Campus. The question submission deadline is January 29, 2026, at 5:00 PM, with proposals due February 5, 2026, at 2:00 PM local Arizona time. The contract will commence July 1, 2027, and continue for fifteen years through June 30, 2042, with options for up to five additional one-year renewal periods at the City's discretion.
Evaluation criteria are weighted in the following order of importance: price proposal, method of approach, qualifications and experience, and history of performance. The contractor must establish a processing fee structure with revenue sharing based on commodity sales, maintain a $2,500,000 initial performance surety, and pay a $5 per ton host fee for non-city materials delivered to the facility. The contractor is responsible for all capital costs, construction, equipment acquisition, facility operations, and marketing of recyclable materials, with residuals and contamination disposal required at the City's Los Reales Landfill. For Scenario 1 (City landfill location), the building and site improvements transfer to the City upon contract expiration, while the contractor retains processing equipment and rolling stock. The contract includes liquidated damages provisions ranging from $500 to $10,000 per day for various performance failures, annual CPI-U adjustments to processing fees not to exceed 5 percent, and comprehensive insurance requirements including commercial general liability of $2,000,000 and environmental and hazardous waste coverage of $5,000,000 annually. The contractor must comply with all federal, state, and local regulations, maintain adequate staffing, provide public education and outreach programs with a viewing gallery, and submit monthly operations reports and audits of material composition.

B. INTRODUCTION
B.1. Summary
The City of Tucson's (City) Environmental Services Department (ES) is soliciting proposals from qualified entities for processing and marketing of Recyclable Materials collected through the City’s Single Stream Recycling Program, Neighborhood Recycling Centers, and the City commercial provided recycling programs. The City is evaluating two potential ownership, operating, and siting scenarios for a Material Recovery Facility (MRF):
• Scenario 1: A MRF sited at the City’s Los Reales Landfill, located at 5300 E Los Reales Rd, Tucson, AZ 85756, which may be City-owned or operated under a public-private partnership.
• Scenario 2: A Contractor-owned and operated MRF, in which the Contractor is responsible for siting, constructing, owning, and operating the MRF.
The City will select the proposal that is determined to be most advantageous based on established evaluation criteria. The City’s current agreement for processing and marketing of Recyclable Materials is set to expire on June 30, 2027; however, the City has the right to negotiate an extension of the current agreement.
Note that definitions for certain terms used in this RFP are provided in the Scope of Work and Instructions to Offerors Sections.
B.2. Background
At the completion of the evaluation process, the City may enter negotiations with the top ranked Offeror regarding any portion of the Contract, as deemed necessary by the City. If the City is unable to negotiate successfully with the top ranked Offeror, the City may cease negotiations with that Offeror and either begin negotiations with the next ranked Offeror or choose to cancel the solicitation in its entirety. If the City is unable to negotiate successfully with the next ranked Offeror, the City may cease negotiations with that Offeror and either begin negotiations with the third ranked Offeror or choose to cancel the solicitation in its entirety.
Offerors are encouraged to suggest Contract revisions that would more efficiently allocate risk, improve the parties’ understanding of risk allocation, or improve clarity of any contract terms where ambiguities or uncertainties may arise. The City is not obligated to accept any of the suggested revisions by Offeror(s) when negotiating and finalizing the Contract. The City may request additional revisions during negotiations and before finalizing the Contract.

C.2. GENERAL OVERVIEW
The City of Tucson's (City) Environmental Services Department (ESD) is requesting responses to this RFP from potential Offerors where the selected Offeror, also referred to as Contractor, will process and market recyclables collected from the City's Single Stream residential, commercial and Neighborhood Recycling Center (NRC) collection programs (collectively referred to as “Program Recyclable Material”).
The selected Offeror shall be responsible for performing all services as outlined in the specifications herein and shall provide and furnish all labor, materials, equipment, supplies, and vehicles for the proper execution and completion of processing the material received from the City. The capacity of the Offeror’s equipment must be capable of handling all current and projected tonnages Offeror anticipates.
Through this RFP process, the City is considering two different ownership, operating, and siting scenarios including:
Scenario 1: MRF at Los Reales Landfill
Under this scenario, the MRF would be sited at the City of Tucson’s Los Reales Landfill, located at 5300 E Los Reales Road, Tucson, AZ 85756. The selected Offeror would be responsible for designing, constructing, and operating the facility on a designated tract of land provided by the City.
The Offeror would enter into a processing agreement with the City for the handling and processing of Recyclable Materials generated through the City's Single Stream Recycling Program, Neighborhood Recycling Centers, and commercial recycling operations. The Contractor will be required to perform all site development, construct the building, install necessary processing equipment and rolling stock, and
BUSINESS SERVICES DEPARTMENT Page 10 of 73 provide a scale house along with any other infrastructure or resources necessary to fulfill the requirements outlined in the Request for Proposals (RFP).
The entire project, including the construction of the MRF, installation of equipment, and provision of operational infrastructure will be financed solely by the Contractor. Upon expiration or termination of the contract, ownership of the processing equipment and rolling stock will remain with the Contractor, while the City will retain ownership of the building, site improvements, and all other permanent assets.
SCOPE OF WORK, SECTION "ADDITIONAL REQUIREMENTS FOR MRF AT CITY'S
LANDFILL" includes additional requirements specific to Scenario 1.
Scenario 2: Contractor-Owned and Operated MRF
Under this scenario, the MRF will be owned and operated by the Contractor and may either be an existing facility or a newly constructed facility developed by the Contractor. The facility must meet all requirements outlined in this Request for Proposals (RFP) by the Commencement Date of operations.
The facility must be located within a distance not exceeding two (2) miles outside the Tucson City Limits, and the proposed location must be subject to review and approval by the City.
This scenario allows for flexibility in siting, provided that the selected Contractor ensures the facility, whether existing or newly developed, fully complies with the City’s operational, environmental, and service requirements as specified in the RFP.
C.3. BACKGROUND
The City’s current processing and marketing agreement expires June 30, 2027; however, the City has the option to extend the current agreement for additional years.
The City is seeking proposals from qualified entities to provide processing and marketing of Recyclable Material collected via the City Single Stream Recycling Program, the Neighborhood Recycling Centers and the City provided commercial front-end load Recycling program. The City provides Single Stream collection of Program Recyclable Material to approximately 147,000 carts within the City via the City Single Stream Recycling Program. Currently, the City Single Stream Recycling Program includes the collection of the following Program Recyclable Material:
A. Plastic 1, 2, & 5 (beverage bottles, cleaning bottles and containers, personal care items, and plastic clamshell/ takeout containers)
B. Aluminum & Tin (beverage cans, canned food, disposable cooking pans, tin containers)
C. Cardboard & Paper (cardboard boxes, food cartons, drink cartons, office paper, mail, craft paper, magazines and newspapers, paper bags and containers)
The City is incorporating as part of the new service agreement the recycling and processing of glass through the City’s Single Stream Recycling Program.
In addition to the City’s Single Stream Recycling Program, the City provides Recycling via the Neighborhood Recycling Centers and commercial frontend load Recycling program. As part of the Neighborhood Recycling Center (NRC) program, the City currently operates five (5) Neighborhood Recycling Centers. The number of NRC’s operated by the City may fluctuate during the term of this Contract. Through its commercial front-end loader Recycling program, the City collects materials Single

The Commencement Date (and corresponding end date) may be adjusted, as needed, based on the Successful Offeror’s proposed timeline and through a commensurate extension of the City’s current agreement. At the option of the City and with the concurrence of Contractor, the Contract may be renewed for up to five (5) additional one (1) year periods. The City shall notify Contractor of its intent to exercise this renewal option or allow the Contract to terminate. For the avoidance of doubt, this Contract is binding on the parties as of the date of the last required signature below.
C.5. EXCLUSIVE AND NON-EXCLUSIVE PROCESSING AND MARKETING OF
RECYCLABLE MATERIAL
A. Exclusive Processing and Marketing
1. The Contractor shall be the exclusive provider of processing and marketing of Program Recyclable Material collected by the City for the term of a Contract. However, the City makes no guarantees regarding the minimum or maximum tons to be delivered to the MRF.
B. Non-exclusive Processing and Marketing
1. Various Recycling programs are offered throughout the Tucson Metropolitan Area. The Contractor awarded a Contract for exclusive processing and marketing of Program Recyclable Material may provide Recycling services to other entities within or outside the City as long as such services do not impact the Contractor’s ability to provide the Scope of Work to the City as set forth herein.
2. The Contractor will be responsible to pay the City a minimum host fee of $5 per every ton delivered to this facility that was not delivered by the City.
C. Cooperative Purchasing
1. The Contractor may provide services to other public and nonprofit agencies that have entered into a Cooperative Purchasing Agreement with the City of Tucson's Department of Procurement as provided in the Special Terms and Conditions of this Request for Proposals as long as such services do not impact the Contractor’s ability to provide the Scope of Work to the City as set forth herein.
BUSINESS SERVICES DEPARTMENT Page 14 of 73
C.6. ACCEPTABLE RECYCLABLE MATERIAL
A. Minimum Acceptable Recyclable Material
1. The City is seeking to expand its recycling programs and, as part of this solicitation, requests that the successful Contractor provide comprehensive processing and marketing services for all acceptable recyclable materials. The City encourages the inclusion of as many recyclable commodities as possible in the proposed solution.
2. Offerors are encouraged to identify Recyclable Materials, such as scrap metal, textiles, and other Recyclable Materials, beyond those defined as Acceptable Recyclable Materials to be processed and marketed by the successful Contractor. The definition of Acceptable Recyclable Material located in the Definitions of this Request for Proposal lists the Recyclable Materials required to be defined as Acceptable Recyclable Material. In addition to those Recyclable Materials defined as Acceptable Recyclable Material in Definitions of this Request for Proposal, the City is interested in considering other Recyclable Material to be included as Acceptable Recyclable Material as opportunities to further expand Recycling within the City. The City reserves the right to define Program Recyclable Material to include any or all Recyclable Material identified by the Contractor in their proposal as Acceptable Recyclable Material.
B. Addition/Removal of Acceptable Recyclable Material
1. The City understands that market conditions can affect the recyclability of materials. If the Contractor is unable to sell the total quantity of a specific commodity generated within an individual month for three consecutive months after the Contractor made every reasonable effort to market the commodity with documentation, and by mutual agreement of the parties, the unsalable quantity of that commodity may be re-classified as material with no market value. Under such circumstances, the monthly revenue share calculations will need to be adjusted and reconciled to reflect any resultant reduction in the overall commodity value of the recycled materials.
2. During the term of the Contract, the selected Offeror and the City shall cooperate to change Acceptable Recyclable Materials on the City's list of Program Recyclable Materials based on changes to markets, changes to City programs, and Processing technologies. During the term of the Contract, it is likely that there will be many changes in both packaging and recycling machinery. The Offeror, with concurrence and approval with the City of Tucson, shall make equipment changes/upgrades to ensure their processing technologies are meeting industry best practices. The City of Tucson may initiate a change to the Program Recyclable Materials list of accepted items by notifying the Contractor in writing of the potential need to remove an item from or opportunity to add an item to the Program Recyclable Materials list. Each party will work diligently and in good faith in implementing these changes to the Program Recyclable Materials list. The City reserves the right to make all decisions on changes to the Program Recyclable Materials list.
C. Disposal of Program Recyclable Material as Solid Waste Prohibited
1. The Contractor is prohibited from disposing any Accepted Recyclable Material (and/or processed Recycled Materials) as any portion of this Contract as Solid Waste. The Contractor will not market any Accepted Recyclable Material marketed as a result of this
BUSINESS SERVICES DEPARTMENT Page 15 of 73
Contract to markets that the Contractor knows or reasonably should have anticipated will dispose of the Accepted Recyclable Material as Solid Waste except when authorized in writing by the City Contract Representative.
C.7. LOCATION OF MRF
The Offeror must propose a MRF at the City’s landfill property or on property owned or managed by the Offeror. Preferably, the property shall be located within the City of Tucson City Limits, but in no event will the property be located more than 2 miles outside City of Tucson City Limits. The proposed location is subject to review and must be deemed acceptable by the City.
C.8. ENCLOSED MRF
The City is requesting that the proposed MRF be enclosed to address the following:
A. Prevention of the release of material or litter on the Contractor’s property;
B. Prevention of the release of material or litter onto the public or other Person’s private property;
C. Protection of Recyclable Material from depreciation in value due to exposure to weather; and
D. Prevention of other nuisances including, but not limited to noise and odor.
The City, to address the above items, prefers for any MRF proposed to provide services to the City to be enclosed at all access points. As part of the proposals, Offerors shall provide a detailed description of the means for enclosing Recyclable Material accepted by the MRF.
C.9. FACILITY GENERAL REQUIREMENTS
A. Safety and Environmental Compliance
1. The selected Offeror shall be solely responsible to provide and maintain adequate security at the MRF and during transport of Recyclable Materials by, or on behalf of the Offeror. The Offeror agrees and acknowledges the Offeror is solely responsible for security of Recyclable Materials delivered and accepted at the MRF. Facility design, construction, and operation shall comply with all local, state, and federal requirements, including those required by OSHA and industry standards. Dust control shall be provided to ensure a comfortable work environment, to minimize danger from long-term exposure, and to prevent other hazards including the potential for explosive conditions. The Offeror shall avoid those practices that create a perception of nuisance to citizens such as odors, noise, and litter. Noise levels shall be below OSHA standards. The Offeror is responsible for the onsite safety and security of its employees and visitors at all times, including providing the appropriate personal protective equipment (PPE) for all laborers onsite and visitors to the site.
B. Fire Protection
1. A fire protection system shall be provided throughout the MRF, including material storage areas, and other buildings in accordance with all applicable fire code regulations, and best industry practice. Sprinklers must comply with City code. Hot spot detection and suppression are required. Offerors shall include a description of their fire prevention and
BUSINESS SERVICES DEPARTMENT Page 16 of 73 safety plan in its proposal, including the specific approach to hot spot detection and suppression. The selected Offeror will be required to submit for review by the City prior to the start date of processing and implement a Fire Prevention and Response Plan and a Safety Plan. The selected Offeror will be required to submit a “Will Serve” letter from the appropriate fire district if the property is to be located outside the City of Tucson, City Limits.
C. Construction Requirements
1. The Contractor shall have exclusive responsibility for providing all construction means, methods, techniques, sequences, start-up, and acceptance testing, as well as all procedures necessary and desirable for the correct, prompt and orderly construction of the site, MRF and other buildings.
2. The Contractor will submit a construction plan prior to initiating development of the MRF. It is the Contractor’s responsibility to ensure compliance with the construction plan throughout the construction process.
3. The Contractor’s exclusive responsibility to provide all construction means shall include, but is not limited to, providing the following construction requirements: temporary power, light and other utilities, including potable water and sanitary facilities; telephone and portable two-way communication; temporary offices and construction trailers, with a room for on-site project review meetings with the City; required design certifications and other required approvals; field document control and filing system for the control of all submittals and project communications; quality control and testing; independent laboratory testing services; site cleanup and housekeeping; drainage and erosion control; construction trade and subcontractor management, coordination and control; temporary parking; safety and first aid facilities; correction or compensation for defective work or equipment; equipment and materials storage area, with weather protection; workshops and warehouses;
temporary fire protection for the construction site; site security; receipt and unloading of delivered materials and equipment; erection rigging; temporary supports, and coordination of all construction activities.
4. During construction, the Contractor shall maintain the site in a safe manner and satisfactory condition. The Contractor shall fully cooperate with the City and its designated representatives to allow the City to monitor and review construction progress, design documents, and any proposed changes to design. The City will have the right to provide reasonable comments to design and construction documents.
5. For Scenario 1, Construction shall be scheduled and conducted, as practical, to minimize impacts and disruptions to existing operations at the City’s landfill.
D. Building and Site Inspections
1.
