About this file

This document outlines procurement preferences established by the Illinois Abandoned Mine Land (AML) Division for AML reclamation projects, specifically the AML 2304 Wee Ma Tuk Dams project involving modifications to four dams: Long Lake, Stevens Lake, Hanks Lake, and McCamey Lake. The policy implements requirements from Section 40701 of the Bipartisan Infrastructure Law (P.L. 117-58) and applies to AML construction projects with a total value exceeding $100,000. Contractors interested in bidding must be aware that priority consideration may be given to projects providing employment for current and former coal industry employees. The AML Division's standard practice is to award contracts to the lowest responsible bidder; however, alternative qualified bidders who can demonstrate employment of at least two former coal mine employees may receive preference if their bid does not exceed 2% above the low bid amount.

At the time of bid submission, qualified bidders seeking preference must provide documentation proving that at least two current employees are former coal mine employees and commit to utilizing these employees on the awarded AML Reclamation project or commit to employing at least two former coal mine employees for project fulfillment. This preference policy reflects the Infrastructure Investment and Jobs Act's emphasis on supporting economic transition in coal-dependent regions while maintaining competitive procurement practices based on price and contractor responsibility.

Text version

Preference to Contractors that Employ Current and/or Former Employees of the Coal Industry In accordance with the requirements of Section 40701 of the Bipartisan Infrastructure Law (also known as the Infrastructure Investment and Jobs Act). P.L. 117-58, priority may also be given to reclamation projects described in subsection (b)(1) that provide employment for current and former employees of the coal industry.

Potential bidders of an Abandoned Mine Land (AML) construction project with a total value of more than $100,000 are eligible to utilize Procurement Code 30 ILCS 500/45-110.

It is the policy of the AML Division to award a contract to the lowest responsible bidder. If another qualified bidder can fulfill the contract through the use of at least 2 former coal mine employees, then this bidder may be given preference over other bidders if the bid is not more than 2% greater than the low bid.

At time of bid, Qualified bidders will need to provide proof that at least 2 current employees of the bidder are former coal mine employees and that all such declared former coal mine employees in the bid shall be used in the fulfillment of the awarded AML Reclamation project or commits to employing at least 2 former coal mine employees.
