18. FOREIGN NATIONALS

As used in this article, the term “Foreign National” is defined to be a person who was born outside the jurisdiction of the United States, is a citizen of a foreign nation and has not been naturalized under U.S.

law.)

18.1. The Subcontractor shall obtain the approval of Procurement Representative, in writing, prior to any visit to a DOE or Contractor Operated facility by any Foreign National in connection with work being performed under this Subcontract, in accordance with the requirements of DOE Order 142.3, Unclassified Foreign Visits and Assignments Program. Visits are normally for the purpose of technical discussions, orientation, observation of projects or equipment, training, Subcontract service work, including delivery of materials, or for courtesy purposes. The term visit also includes officially-sponsored attendance at a DOE or Contractor event offsite from DOE/SRR facility, but does not include offsite events and activities open to the general public. Subcontractor should be aware that required forms and documents necessary for approval of visits by Foreign Nationals should be submitted to the Contractor Procurement Representative at least four (4) to six (6) weeks prior to the visit, depending on the nationality of the individual and the areas to be visited. Forms can be obtained from the Procurement Representative.

18.2. In addition, the Subcontractor shall obtain the approval of the Contractor Procurement Representative, in writing, prior to the employment of, or participation by, any Foreign National in the performance of work under this Subcontract or any lower tier Subcontract at off-site locations. Such approvals will be processed in accordance with the requirements of DOE Order 142.3.

18.3. In the performance of offsite work, Foreign Nationals only incidentally involved with the Subcontract knowledge that their activities are associated with the Subcontract work, are exempt from the above provisions.

19. SECURITY AND SITE ACCESS, APPLICABLE FOR ONSITE WORK

19.1 All persons on the LLCC project site are required to have a DOE identification badge and a General Employee Training (GET) badge. These badges are required for access through the DOE security gate and must be worn, visible at all times while on DOE property.

19.2 There are no known radiological hazards on the LLCC site; therefore, no other badges or training are required at this time for general access to the LLCC site.

19.3 DOE identification Badge – Subcontractor employees will be photographed when they first report to work.

At the present time it takes approximately two weeks for the badge to be issued after the picture is taken.

Contractor is attempting to shorten this turn-around time. Subcontractor employees and visitors who do not have a DOE badge may be escorted onto the LLCC site by Subcontractor employees who are

SUBCONTRACTOR

PO 0000262– Off-site Analytical Laboratory Services — Master IDIQ Agreement Date _8_/9 /_2018_

Form 9096, Rev. 1, (06/21/18) properly badged. Each escort is allowed to escort up to three unbadged individuals at one time. The individuals being escorted must remain within the escort person’s field of view at all times.

19.4 There is no charge for issuing DOE Badges. However, since unauthorized possession of a DOE identification badge is a serious security issue, the Subcontractor will be assessed an administrative fee of $250.00 for each DOE identification badge which is not returned at the completion of the Subcontractor’s task or upon Subcontractor employee termination.

19.5 GET and Site Access Badging - When Subcontractor employees first report to work at the LLCC site they will be required, in addition to being photographed for the DOE identification badge, to attend a site orientation lecture, followed by a computerized test (approximately two (2) hours in total). After attending the orientation lecture and successfully completion of the test, the Subcontractor employee will be issued a GET and Site Access badge. This badge attests that the Subcontractor employee has received the basic safety and security training required for access to the site. Unlike the identification badge, the GET badge is transportable between subcontractors on the LLCC site and is valid for two years from the date of issue. Subcontractor employees must retake the orientation lecture and test prior to the expiration date of their badge or if their badge is rescinded for safety/security violations. A certificate of completion of GET is also provided to the Subcontractor employees. If the GET badge is lost, this certificate may be used as evidenced of GET certification pending issuance of a new badge.

20. FAIR OPPORTUNITY PROCEDURES

20.1 The Contractor will give all subcontractors that were awarded a similar subcontract a fair opportunity to be considered for each task order, except as otherwise provided in Section (20.5) of this clause.

20.2 When giving subcontractors a fair opportunity the Contractor may consider technical approach, past performance, management approach, personnel experience, and cost/price factors. However, the Contractor might not consider all of those factors together.

20.3 The Contractor 's objective is to keep task order selection procedures simple and inexpensive for all parties to the subcontract. Thus, as a general rule, the Contractor will consider subcontractors based on

(1) information already in its files, (2) price quotations, and (3) past performance under prior orders. The Contractor reserves the right to use more formal procedures when it considers them to be necessary.

20.4 After it selects a subcontractor for a task order, the Contractor may discuss the details of task plans and procedures and negotiate prices with the subcontractor before issuing the task order. If the Procurement Representative is not satisfied with the progress or outcome of those discussions or negotiations, the Contractor may reconsider its task order selection decision and then select a different subcontractor.

20.5 The Contractor shall give every awardee a fair opportunity to be considered for a delivery-order or task-order exceeding $10,000 unless one of the following exceptions applies:

20.5.1 The Contractor need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.

20.5.2 Only one awardee is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized.

20.5.3 The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the subcontract.

20.5.4 The Owner, a policy, or a regulation expressly authorizes or requires that the purchase be made from a specified source.

20.5.5 Contractor may, at its discretion, set aside orders for any of the small business concerns identified in FAR 19.000(a)(3).

1.0 INTRODUCTION AND BACKGROUND

This Exhibit D sets forth the requirements for off-site analytical services to be provided by a multi-services laboratory (SUBCONTRACTOR). Multi-services means the SUBCONTRACTOR has the capability to perform general inorganic, organic, and radiochemical analyses. Samples obtained for chemical analysis in support of CONTRACTOR activities may consist of any type of environmental media including, but not limited to, soil, waste, groundwater, surface water, domestic supply water, air filters, demolition debris, biota, sludge, organic liquids, swipes, gas canisters, and bioassay samples. Samples may also be acquired for airborne-asbestos and bulk-asbestos testing. Most samples are also routinely screened for radiological contaminants per U.S. Department of Transportation regulations. The SUBCONTRACTOR must be qualified to handle radioactive samples (many samples will contain low levels of radioactivity).

Expected isotopes are Pu, Am, U, Th, 90Sr, and 3H, although others are occasionally present. The maximum level of radioactivity expected is 100 nCi/g, although the vast majority of samples have levels much lower than 2 nCi/g.

The following sections detail specific quality assurance (QA) protocols, analytical practices and procedures, analytical quality control (QC) requirements, deliverable formats, and schedule requirements.

Collectively, these conventions have been established to ensure CONTRACTOR data-quality objectives

(DQOs) are met and the data obtained from the analytical SUBCONTRACTOR are derived using consistent guidelines. The SUBCONTRACTOR is to conduct work under the SUBCONTRACTOR’S approved Quality Assurance Program.

2.0 STATEMENT OF WORK

2.1 Sample Throughput Requirements

The SUBCONTRACTOR shall have the capacity to process up to 1200 samples per week without missing specified turnaround time or data-quality requirements of this subcontract. The CONTRACTOR

Sample Management Office (SMO) will determine what samples are shipped to which

SUBCONTRACTOR based on volume and the analytical needs of the CONTRACTOR.

2.2 Electronic Data Deliverable and Analytical Data Package Deliverables

2.2.1 Deliverable Levels

The SUBCONTRACTOR shall provide a U.S. Environmental Protection Agency– (EPA-) defined Level IV report that includes raw data; or a Department of Defense (DOD)/Department of Energy (DOE) Quality Systems Manual (QSM)

Stage 4 report, where applicable. The SUBCONTRACTOR meets turn-around time when the SUBCONTRACTOR successfully loads the electronic data deliverable (EDD) into the CONTRACTOR database. The CONTRACTOR must receive the analytical data package PDF deliverable at the same time as the EDD has been loaded under normal turn-around time. Both of these deliverables and the transmittal form are fully described in Section 5.

Examples of analysis for which Level IV (or Stage 4) doesn't apply are bioassays, particle size analyses, and industrial hygiene samples.

Each NEW SUBCONTRACTOR’s first complete set of deliverables as defined in Section 5.0 will undergo CONTRACTOR QA/QC review and comment prior to consent to proceed with additional work.

2.2.2 Corrections to EDD and Analytical Data Package Deliverables

Corrections to any EDD and analytical report PDF deliverable must be performed within 48 hours of formal request for correction. Corrective actions requiring a longer time period shall be addressed by a formal

Subcontract No. 250953 corrective action plan submitted to the CONTRACTOR Subcontractor Technical Representative (STR) within 4 days of formal request for correction by the CONTRACTOR STR. Content of the corrections and re-submissions are fully described in Section 5.3.3.

2.3 Radioactive Materials License Requirement

The SUBCONTRACTOR shall have a current Radioactive Materials License for handling at least 1.5 Ci that is appropriate to the materials expected to be received under this subcontract.

2.4 Analysis Requests

2.4.1 Work Orders, Standard Analyses Requests

The CONTRACTOR SMO will schedule the shipment and analysis of samples, grouped in a work order, directly with the SUBCONTRACTOR or approved Secondary SUBCONTRACTOR. In the event samples are sent directly to the Secondary SUBCONTRACTOR, the Secondary SUBCONTRACTOR shall notify the SUBCONTRACTOR by phone or email when it has received samples from the CONTRACTOR. The analytical request form that accompanies the samples will include the CONTRACTOR’s request number and other information that details the samples submitted and the analyses requested. If the

SUBCONTRACTOR does not receive the samples on the next business day, if any discrepancies are found between the samples received and the analytical request, if any sample containers are broken, if the chain-of-custody seal has been broken, or if insufficient sample volumes are available for analysis, the SUBCONTRACTOR shall notify the CONTRACTOR SMO and STR immediately by phone or e-mail of any such occurrences and document the occurrence in the case narrative of the hard-copy data package. Attachment 5 describes the analytical sample flow.

2.4.2 Secondary SUBCONTRACTOR Laboratory

If, for any reason, the SUBCONTRACTOR finds it necessary on occasion to utilize a Secondary

SUBCONTRACTOR to perform analyses, the Secondary SUBCONTRACTOR must meet all the qualifications stated within this document.

The SUBCONTRACTOR must:

(1) Contact the CONTRACTOR STR (email is acceptable) and describe the reason necessitating a

Secondary SUBCONTRACTOR Laboratory.

(2) Obtain prior approval for the change from the CONTRACTOR STR.

(3) Submit the SUBCONTRACTOR Deviation Disposition Request Form 2178.

2.4.3 Requests for Reanalysis

2.4.3.1 Incomplete Reports and Errors

If a suspected analytical error is identified by comparison with historical data, if QC data are either missing or outside the control limits, or if the data are unusable for any reason, the CONTRACTOR STR reserves the right to request delivery of the missing documentation or the reanalysis of any or all samples within the work order. If some results in a sample have met the acceptance criteria, reanalysis requests will be for the affected parameters only, rather than the entire analytical suite.

Subcontract No. 250953

2.4.3.2 Reimbursement for Reanalysis Costs

The CONTRACTOR STR will request reanalyses by telephone and confirm the request in writing (e-mail is acceptable). Payment for reanalyses requested by the CONTRACTOR STR shall be made according to the following guidelines (see Exhibit “C,” Form A, Schedule of Quantities and Prices):

(a) The CONTRACTOR shall not pay for requested reanalyses due to reported QC data failures.

(b) Reanalyses that are requested because of a suspected significant error, and that confirm the original results within reasonable analytical error, shall be paid for by the CONTRACTOR. The

CONTRACTOR STR will seek input from the SUBCONTRACTOR regarding reanalysis confirmation in light of sample inhomogeneity or other special considerations.

(c) Reanalyses that are requested because of a suspected significant error, and that indicate that an analytical or reporting error was made in the first analysis, shall be paid for by the

SUBCONTRACTOR.

2.5 Nonstandard Analyses

The CONTRACTOR STR may find it necessary on occasion to request an analysis that is not listed in

Exhibit C but is still within the Scope of work of this subcontract.

2.6 Time Definitions

References to days, weeks, or months are defined as calendar days, weeks, and months. Turnaround times shall be considered as all calendar days, inclusive of weekends and holidays, and commences upon date of receipt by SUBCONTRACTOR. This applies to all turnaround time agreements, including rushed or accelerated analysis. Turnaround times ending on a national holiday shall be delivered the following absolute calendar day.

2.7 Personnel Requirements

Group leaders of the laboratory group shall have the following required minimum qualifications: B.A. or

B.S. in a science, technology, engineering, or mathematics field and at least three years of direct analytical experience in the discipline that they are managing (organic or inorganic or radiological).

Analytical instrument operators shall have two years of experience operating the equipment they are using.

2.8 Primary Contacts and Communication

2.8.1 SUBCONTRACTOR Primary contact person

The SUBCONTRACTOR shall assign a project manager to be the primary contact person for issues relating to…
