About this file
This fact sheet provides requirements and procedures for Project Labor Agreements (PLAs) mandated by the City of Toledo for all construction projects valued at $100,000 or greater, regardless of funding source, unless explicitly excluded. The PLA applies to all contractors and subcontractors performing construction work on-site or adjacent to the worksite. Following bid award notification, a pre-job conference must be held within fifteen (15) days between the successful bidder and the Northwest Ohio Building and Construction Trades Council (NWOBTC). An executed PLA must be submitted to the Division of Purchases and Supplies within fifteen (15) working days from the pre-job conference and requires signatures from both the lead contractor and the Executive Secretary of NWOBTC to be valid. There are no exemptions from the pre-job meeting requirement, even for companies already signatory to collective bargaining agreements. Manufacturing and fabrication work are excluded from PLA requirements.
The PLA mandates that wages and fringe benefits comply with applicable local collective bargaining agreements during project performance. The agreement strictly prohibits strikes, lockouts, slowdowns, picketing, sympathy strikes, or any work stoppages by the union, its members, agents, representatives, or employees; violations constitute a breach of the PLA. Grievances and disputes are addressed through Article VI of the PLA. The PLA does not supersede or diminish any requirements under the Toledo Municipal Code, including the Minority Business Enterprise Program, which requires 15% MBE participation on standard projects and 21% on HUD-assisted projects.

What is the timeframe on execution of a Project Labor Agreement?
Once the successful bidder is notified of bid award, a pre-job conference shall be held within fifteen (15) days of the award notification between the Bidder and the Northwest Ohio Building and Construction Trades Council (“NWOBTC”). An executed Project Labor Agreement must be delivered to the Division of Purchases and Supplies within fifteen (15) working days from pre-job conference with NWOBTC. Does the Project Labor Agreement affect the City’s Minority Business Enterprise Program?
No, all successful bidders are required to comply with the Toledo Municipal Code and Toledo Administrative Policy No. 13, which creates a goal-oriented program to meet and/or exceed a level of 15% Minority Business Enterprise participation in construction projects and a level of 21% Minority Business Enterprise participation in HUD-assisted projects.
Can the Project Labor Agreement affect the bidder’s duties under the Toledo Municipal Code?
No, all requirements of the Toledo Municipal Code must be obeyed regardless of any terms in a Project Labor Agreement.
How do I get the Northwest Ohio Building and Construction Trades Council to sign my Project Labor Agreement?

If my company is already a signatory to collective bargaining agreement, are we exempt from the pre-job meeting?

Does this impact manufacturing and fabrication work?
No.
How will Project Labor Agreements affect wages and fringe benefits?

Will there be any strikes or lockouts?
