About this file
This is a Project Labor Agreements Fact Sheet issued by the City of Toledo, Ohio, detailing requirements and procedures for construction projects funded by the City or other non-excluding funding sources. The document outlines that Project Labor Agreements are mandatory for all construction projects valued at $100,000 or greater and apply to all contractors and subcontractors performing construction work on-site or adjacent to the worksite. Following notification of bid award, a pre-job conference must be held within fifteen (15) days between the successful bidder and the Northwest Ohio Building and Construction Trades Council (NWOBTC). An executed Project Labor Agreement, bearing signatures from both the lead contractor and the Executive Secretary of NWOBTC, must be delivered to the Division of Purchases and Supplies within fifteen (15) working days from the pre-job conference. The document emphasizes that all successful bidders are required to comply with the Toledo Municipal Code and Toledo Administrative Policy No. 13, which establish a 15% Minority Business Enterprise participation goal for construction projects and 21% for HUD-assisted projects, regardless of Project Labor Agreement terms.
The Project Labor Agreement does not exempt signatory contractors from pre-job meetings and does not impact manufacturing and fabrication work. Wages and fringe benefits under the agreement shall be paid in accordance with applicable local collective bargaining agreements. The agreement explicitly prohibits strikes, lockouts, slowdowns, picketing, sympathy strikes, and other work stoppages by unions and their members for any cause. Grievances and disputes are handled through Article VI of the Project Labor Agreement. The fact sheet clarifies that Project Labor Agreement requirements do not conflict with existing Toledo Municipal Code requirements, which must be obeyed regardless of agreement terms.
