About this file
This is a Performance and Payment Bond template issued by the City of St. Petersburg, Florida, designed for use in conjunction with the RFP No. 26-178 for a Citywide Digital Accessibility Compliance Platform. The bond document establishes a binding agreement between a Principal (contractor), Surety (bonding company), and the City to guarantee faithful performance of the contract, compliance with all contract terms and conditions, and timely payment to all labor and material suppliers. The bond requires the Principal to fulfill all obligations related to guarantees and warranties of work and materials furnished under the contract for the original term and any extensions granted by the City. The Surety waives notice of any changes, extensions of time, alterations, or additions to the contract terms or specifications and remains obligated regardless of such modifications. The bond must be executed by an Attorney-in-Fact representing the Surety with proper power of attorney documentation attached, and requires notarization of both the Principal and Surety acknowledgments. The document includes signature blocks for the Principal, Surety, City Attorney, and witnesses, along with space to indicate whether the Principal has a corporate seal or requires witness signatures.
The bond amount is left blank to be completed based on the contract value, and the document specifies that the Surety's obligations include covering all losses, damages, liquidated damages, expenses, costs, and attorneys' fees incurred by the City due to the Principal's default under the contract. The bond serves as a guarantee mechanism for the digital accessibility compliance platform procurement, which has an estimated first-year cost of $75,000 with anticipated annual maintenance costs of approximately $70,000 for subsequent years, funded through Operating Fund 5019. This standard bond form ensures contractor accountability and protects the City's interests in the performance and financial obligations associated with the selected vendor for the one-year initial contract term with two optional one-year renewal periods.
