About this file

This is a Performance Bond template document issued by Washington County, Oregon, for use in construction contracts. The bond serves as a financial guarantee that contractors will faithfully perform all work in accordance with contract terms, conditions, plans, specifications, and authorized modifications. The bond covers an approximately 22,037 square foot office suite tenant improvement project on the 3rd floor of the Washington County Public Services Building, involving selective demolition, partition wall construction for five new offices and five new phone rooms, surface patching and painting, carpet and rubber base replacement, acoustical ceiling modifications, and updates to mechanical, electrical, low voltage, and fire detection/suppression systems. The project includes two bid alternates for new acoustical ceiling tiles in offices and phone rooms and an additional gypsum board layer on walls dividing phone rooms and offices. The scope also encompasses systems furniture reconfigurations with associated power and data connections, with the contractor responsible for coordination, provision of new connections, modifications to existing power and data, and final connections to workstations.

The performance bond requires the principal contractor and surety to be jointly and severally liable to Washington County in a specified sum for faithful performance of all contract work. The bond remains in full force and effect unless the contractor complies with all terms and conditions and performs all work according to law and contract specifications. The surety waives notice of any contract alterations, time extensions, or modifications that affect work scope or contract amount. Should Washington County require legal collection action, both the principal and surety agree to pay the County's reasonable collection costs and attorney fees. The bond must be executed with authorized official signatures from both the contractor and surety, include the surety's seal, and include a power of attorney for any attorney-in-fact representative. The template was approved as to form by the Assistant County Counsel on November 29, 2017.
