About this file

This addendum to a public bid solicitation for Palm Beach County Department of Airports (PBCDOA) modifies and supplements the proposal documents for Project PB 20-1, the Palm Beach International Airport Public Address System Replacement. The project scope includes the replacement of the existing PA system with new hardware, software, amplifiers, speakers, paging microphone stations, noise sensors, and associated cabling, followed by demolition of the existing system and repair of all affected work areas. The work encompasses 1,809 Type A recessed ceiling mount 4-inch speakers, 32 Type B 8-inch speakers, 28 Type C outdoor-rated 8-inch speakers, 14 Type D outdoor weather-resistant surface mount speakers, 9 Type E surface mount speakers, 74 microphone paging stations, and 81 ambient noise sensors distributed across three levels of the terminal and concourse areas. The pre-bid conference was held on February 12, 2020, with sealed bids due on February 27, 2020, at 2:00 PM at the PBCDOA main office. The total contract duration is 635 calendar days from Notice to Proceed, consisting of a 60-day procurement phase, 365-day commissioning/installation phase, 180-day demolition phase, and 30-day final acceptance period. Work is primarily scheduled for nighttime hours (varying by area between 1:00 AM and 9:30 AM) with some daytime work (Monday-Friday, 7:00 AM to 3:30 PM) permitted in non-public areas for electrical infrastructure and IT room installation.

Contractor qualifications require a minimum of five years' experience selling, installing, and maintaining similar systems at large international airports, current manufacturer certification as a contractor and installer, and a minimum of three operational reference sites using the same or similar solutions for at least twelve months. A 15 percent Disadvantaged Business Enterprise (DBE) participation goal applies, with the prime contractor required to self-perform a minimum of 20 percent of the total contract cost. All contractor employees require Security Identification Display Area (SIDA) badges obtained at contractor expense, involving a ten-year background check and FBI fingerprinting. Liquidated damages are assessed at $500 per calendar day during the procurement phase, $1,500 per day during commissioning, $500 per day during demolition, and $500 per day during final acceptance. The contract will be administered directly by the PBCDOA with oversight from the Consultant/Engineer of Record (AECOM); the project includes a Drawing Index Sheet TI-001 and a comprehensive set of demolition and installation drawings, electrical site plans, and system diagrams. The deadline for written bidder questions was February 20, 2020, with the final addendum due February 24, 2020.

BID REQUIREMENTS

DBE Schedules

Completed DBE Schedules must be submitted as a part of the bid response. Failure to complete the forms will result in the disqualification of your bid.

Ø Schedule 1- List of Proposed DBE Firms

Ø Schedule 2- Letter of Intent to Perform as a DBE

Ø Schedule 3- Demonstration of Good Faith Efforts to Achieve DBE Goal (Note: This form has been substantially revised.)

Ø Schedule 6- Bidder’s & Subcontractor’s Information

Ø For this Project:

l Base Bid with a 15% goal

Common Mistakes Ø The amounts listed in Schedule 1 for each DBE Firm must be supported by the price included on Schedule 2 in order to be counted toward attainment of the DBE goal. Schedule 2 must be signed by the DBE firm.

Ø Firms must be certified by the Unified Certification Program for the State of Florida as a “DBE”. Information regarding DBE certification status may be found through the Florida Department of Transportation Equal Opportunity Office’s website at:

http://www3b.dot.state.fl.us/EqualOpportunityOfficeBusinessDirectory/;

or by contacting the Palm Beach County Department of Airports’ DBE Office at (561) 471-7403.

Ø Certification as a SBE/MWBE or by any other program SHALL NOT count toward achievement of the DBE goal.

Verifying DBE Certification Status

Ø Although a DBE firm may perform work in categories for which it is not certified, only work to be performed in the DBE’s certified categories will be counted toward attainment of the DBE goal.

Ø DBE firms are certified for certain categories of work in accordance with the North American Industry Classification System (NAICS). Information regarding NAICS can be found at:

http://www.census.gov/eos/www/naics/.

Materials and Supplies – Counting DBE Participation

Ø DBE Manufacturer -100% of the cost of the materials or supplies may be counted.

Ø DBE “Regular Dealer” – 60% of the cost of the materials or supplies may be counted.

Ø Brokers – DBE participation is limited to the amount of the fees or commissions charged; provided that the fees are reasonable and the broker is performing a commercially useful function.

Good Faith Efforts - Generally Ø The bidder is required to demonstrate that it has made good faith efforts to achieve participation with DBE firms if the DBE goal is not achieved. Failure to demonstrate good faith efforts to achieve the DBE goal shall result in disqualification of your bid in the event that the DBE goal is not achieved.

Ø Determinations of good faith efforts are intrinsically fact-specific and are made taking into consideration the evidence provided by each bidder as to its documented efforts.

Ø Demonstration of good faith efforts include, but are not limited to, the actions identified in Schedule 3. Actions constituting evidence of good faith efforts are described in Appendix A to 49 CFR Part 26.

Schedule 3 Demonstration of Good Faith Efforts

Ø Schedule 3 form has substantially changed and requires submission of additional information. Bidders should read the revised form carefully. In the event the DBE goal is not achieved, Schedule 3 must be completed in its entirety.

Ø Complete required contact log, including the name of each DBE firm contacted, method of initial and follow up contact, dates of efforts and results of contact.

Ø Include copies of backup documentation supporting your contact log.

Ø Include method of solicitation for all subcontracting categories identified on Schedule 3 for DBE participation. Do not list categories where little or no efforts were made to obtain participation.

Schedule 3 Demonstration of Good Faith Efforts

Ø Include copies of advertisements; however, advertising alone is not sufficient to satisfy good faith efforts.

Ø List all quotes from DBE firms. If a non-DBE firm is selected over a DBE firm, the bidder is required to include the actual copies of the quotes submitted by the DBE firm and non-DBE firm. Failure to include the required quotes shall cause the bid to be nonresponsive.

Ø Schedule 3 provides specific examples of actions that raise the question of whether the bidder has used good faith efforts and actions that may cause a bid to be found nonresponsive. This information may be used as a general guide; however, the list is not exhaustive or exclusive.

Examples of actions that do not constitute good faith efforts

Ø Making mere pro forma efforts such as sending blanket e-mails with no documented follow up efforts.

Ø Rejecting DBE firms as being unqualified without sound reasons.

Ø Failing to make portions of the work available consistent with the available DBE firms.

Ø Failing to negotiate in good faith with interested DBE firms.

Ø Providing the Department with inaccurate or misleading information regarding good faith efforts.

Schedule 3 – Attachment 10 15% or greater DBE participation

If 15% or more DBE Participation is proposed:

(1) Check the top box;

(2) Enter the percentage

(3) Sign & Date

(4) There is no need to complete the remainder of the form.

Schedule 3 – Attachment 10 Less than 15% DBE participation

If less than 15% DBE Participation is proposed:

(1) Check the second box;

(2) Enter the percentage proposed

(3) Sign & Date

(4) The remainder of the form must be completed and demonstrate the Bidder’s good faith efforts to achieve at least 15% participation.
