About this file

This is a Contractor's Payment Surety Bond document for the City of Palo Alto, California, required as a condition of contract performance for the tennis court resurfacing project at Hopkins and Hoover locations. The bond secures payment obligations to laborers, materialmen, and subcontractors involved in the public improvement work. The payment surety bond must equal 100 percent of the total contract amount as mandated by California Civil Code Section 9554 and must be filed by the selected contractor within ten business days of award, prior to commencing work on the project scheduled for completion by December 31, 2026. The bond protects claimants identified under California Civil Code Section 9100, including workers and suppliers, and extends coverage to any amendments, changes, change orders, or modifications to the original agreement without requiring notice to the surety.

The bond requires a surety company incorporated and authorized to conduct business in California to jointly and severally bind itself with the principal contractor for payment of all labor, materials, and employment-related obligations covered under the agreement and the California Unemployment Insurance Code. The surety agrees to pay reasonable attorney's fees if suit is brought upon the bond and waives provisions of California Civil Code Sections 2845 and 2849. The instrument must be executed by authorized representatives of both the principal contractor and the surety company, notarized in accordance with California law, and submitted to the City of Palo Alto as a condition precedent to contract performance.
