About this file
This is a Performance Bond sample document associated with the City of Orange Beach, Alabama's Invitation for Bid (IFB) for Tennis Court Resurfacing and Cabana Installation at the Orange Beach Tennis Center. The project encompasses complete resurfacing of eight tennis courts using the Acrytech Acrylic Surface System, including pressure washing, crack filling and repair, leveling, and application of three coats of acrylic materials with white pickleball line painting, along with installation of four cabanas featuring black powder-coated steel frames and 8-foot canopy lengths. Bidders must demonstrate a mandatory minimum of ten years' experience in court construction and resurfacing, with evidence of at least fifteen major court projects completed within the past five years, and must hold Certified Tennis Court Builder status with the American Sports Builders Association. A mandatory pre-bid meeting is scheduled for March 16, 2026 at 2:00 p.m. at City Hall with strongly encouraged site inspections coordinated through Kevin Lapointe, Tennis and Pickleball Manager. Sealed bids are due April 2, 2026 at 11:30 a.m. through the City's eProcurement Portal, with public bid opening at the same date and time. All work must be completed by August 7, 2026, with liquidated damages of $500 per calendar day assessed for work incomplete beyond 30 days from Notice to Proceed.
The City of Orange Beach requires Performance and Labor and Materials Payment Bonds equal to 100% and 50% of the contract amount, respectively, for winning bids exceeding $50,000, with bids exceeding $50,000 also requiring a certified check or bid bond equal to 5% of the bid amount not to exceed $10,000. The contractor must maintain comprehensive insurance coverage including Commercial General Liability of at least $1,000,000 each occurrence and $2,000,000 annual aggregate, Business Automobile Liability of $1,000,000 each occurrence, Worker's Compensation as required by Alabama law, and Commercial Umbrella/Excess Liability of at least $1,000,000 each occurrence and aggregate. The City offers preference to resident bidders located within Baldwin County whose bids are no more than 5% greater than the lowest bid, and requires a resident business license to operate within corporate limits. All contractors must be licensed in Alabama, comply with E-Verify requirements, and guarantee all labor, materials, and workmanship for one year from final billing. The award will be made to the lowest responsive qualified contractor, with no specific budget or award value disclosed in available procurement documentation.
