About this file

This is a Labor and Materials Bond sample form required for state and local public works contracts in Alabama, specifically applicable to the Tennis Court Resurfacing and Cabana Installation project at the Orange Beach Tennis Center. The bond serves as a financial guarantee that the principal contractor and all subcontractors will promptly pay all laborers, material suppliers, and service providers involved in the project. The bond document establishes the penal sum amount (to be filled in by the parties) and outlines the contractor's obligation to complete the work as specified in the underlying contract, with the surety company providing financial backing should the contractor default on payment obligations.

The bond grants direct rights of action to any person, firm, or corporation that supplies labor, materials, or supplies for the project, allowing claimants to pursue claims against both the principal and surety within one year after final settlement of the contract. Claims must be asserted in the county where the work is performed or where the principal or surety conducts business. The surety's liability is capped at the bond's penalty amount and is not responsible for damages recoverable under Workers' Compensation or Employer's Liability statutes. The bond must be executed under Alabama legislation (Act of February 8, 1935) and requires proper identification of all parties, corporate seals where applicable, and execution by authorized representatives, with the bond date not predating the contract date.
