About this file
This is a Performance Bond sample document for use in the Tennis Court Resurfacing and Cabana Installation project solicited by the City of Orange Beach, Alabama. The bond serves as a guarantee that the selected contractor will faithfully perform all work outlined in the contract, satisfy all claims and demands, and fully indemnify the City from costs and damages resulting from contractor default. The project encompasses complete resurfacing of eight tennis courts using the Acrytech Acrylic Surface System, including pressure washing, crack repair, leveling, and application of three coats of acrylic materials, along with installation of four powder-coated steel frame cabanas. A mandatory pre-bid meeting is scheduled for March 16, 2026 at 2:00 p.m. at City Hall with site inspection strongly encouraged. Sealed bids are due April 2, 2026 at 11:30 a.m. through the City's eProcurement Portal, with public bid opening on the same date and time. All work must be completed by August 7, 2026, with liquidated damages of $500 per calendar day assessed for delays exceeding 30 days from Notice to Proceed. The contractor shall guarantee all labor, materials, and workmanship for one year from final billing.
Performance and Labor and Materials Payment Bonds equal to 100% and 50% of the contract amount, respectively, are required for winning bids exceeding $50,000, with a certified check or bid bond of 5% of the bid amount (not to exceed $10,000) required for bid submissions exceeding $50,000. Contractors must possess an Alabama State General Contractor's License, demonstrate a minimum of ten years' experience in court construction and resurfacing with at least fifteen major court projects completed within the past five years, and maintain American Sports Builders Association Certified Tennis Court Builder status with approved applicator designations. The City of Orange Beach offers preference to resident bidders within Baldwin County whose bids do not exceed 5% of the lowest bid, and requires comprehensive insurance coverage including Commercial General Liability of at least $1,000,000 each occurrence and $2,000,000 annual aggregate. No budget or award amount is specified in the procurement documentation. The award will be made to the lowest responsive qualified contractor, with the City reserving the right to reject any and all bids.
