About this file
This Notice to Proceed is a sample template issued by the City of Orange Beach, Alabama, for a Tennis Court Resurfacing and Cabana Installation project at the Orange Beach Tennis Center. The contractor is required to commence work on or before a specified date and complete all work within thirty consecutive calendar days from the Notice to Proceed date. The project encompasses the complete resurfacing of eight tennis courts using the Acrytech Acrylic Surface System, including pressure washing, crack filling and repair, leveling, and application of three coats of acrylic materials with white pickleball court line painting, as well as the installation of four cabanas with black powder-coated steel frames and 8-foot canopy lengths. A mandatory pre-bid meeting was scheduled for March 16, 2026, at 2:00 p.m. at City Hall with site inspection and walkthroughs coordinated through Kevin Lapointe, the Tennis and Pickleball Manager. Sealed bids were due April 2, 2026, at 11:30 a.m. through the City's eProcurement Portal at https://procurement.opengov.com/portal/orangebeachal, with public bid opening on the same date and time. All work must be completed by August 7, 2026, with liquidated damages of $500 per calendar day assessed for each day work remains incomplete beyond thirty days from the Notice to Proceed.
Bidders must demonstrate a minimum of ten years' experience in court construction and resurfacing with at least fifteen major court projects completed within the past five years, American Sports Builders Association membership and Certified Tennis Court Builder status, approval as an applicator for the Acrytech Surface System and FaultLine Crack Repair System, and an Alabama State General Contractor's License. Bids exceeding $50,000 require a certified check or bid bond equal to 5% of the bid amount not to exceed $10,000, and winning bids exceeding $50,000 require Performance Bonds of 100% and Labor and Materials Payment Bonds of 50% of the contract amount. The City offers preference to resident bidders located within Baldwin County whose bids are no more than 5% greater than the lowest bid. The contractor must guarantee all labor, materials, and workmanship for one year from final billing, excluding new cracks, and maintain comprehensive insurance including Commercial General Liability of at least $1,000,000 each occurrence and $2,000,000 annual aggregate, Business Automobile Liability of $1,000,000 each occurrence, Worker's Compensation as required by Alabama law, and Commercial Umbrella/Excess Liability of at least $1,000,000 each occurrence and aggregate. The award will be made to the lowest responsive qualified contractor, and the City reserves the right to reject any and all bids.
