JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION

(BRAND NAME DETERMINATION)

Simplified Acquisition of Base Engineering Requirements (SABER)

ESTIMATED VALUE OF R.S. MEANS COSTWORKS SOFTWARE LICENSE: $3,600.00 PER LICENSE

1.) Based on the justification provided herein, I recommend that an acquisition be made by other than full and open competition for the contract action described below:

2.) This contract action is for the acquisition of a software license for the R.S.Means CostWorks software license. The software will be used by the SABER contractor to develop SABER Task Order cost proposals. NASA KSC uses the R.S.Means CostWorks license as an estimating standard for SABER Task Orders.

3.) Contracting without full and open competition is permitted pursuant to 10 U.S.C. 2304 (c) (1) because the equipment required by KSC is only available from one source and no other type of equipment will fully satisfy the requirements.

4.) There is a reasonable basis to conclude that KSC’s minimum requirements can only be satisfied by the unique equipment available from R.S. Means CostWorks software license. This single manufacturer requirement is based on software compatibility issues as described below:

a. R.S. Means is the standard construction cost estimating resource utilized throughout the design and construction industry. The CostWorks software license is exclusively by NASA KSC Project Engineers to develop task order cost estimates.

b. NASA KSC has over 20 internal Costworks software licenses in use by Civil Servant personnel to conduct task order cost estimates.

5.) The software license requirement for R.S. Means Costworks is written to fully into the government’s requirements and included in the solicitation. Additionally, this Brand Name Determination will be posted with the solicitation on the Federal Business Opportunities website www.fbo.gov.

6.) It is determined that the price of the software license will be fair and reasonable. This determination is based on the belief that the competitive nature of this low price technically acceptable procurement will entice bidders to seek the most advantageous pricing from R.S. Means Costworks software license.

7.) Future actions to remove barriers to competition will include continued efforts to investigate compatible cost estimating software platforms with the Government standard R.S. Means CostWorks.

Pursuant to FAR 6.303-2(c), I hereby certify that the supporting data furnished in support of contracting by other than full and open competition, under 10 U.S.C. 2304(c) (1), for the purchase of one R.S. Means CostWorks software license is complete and accurate to the best of my knowledge and belief.
