QUESTIONS RESPONSES TO QUESTIONS

1. I am writing to obtain clarification on the services defined in the subject solicitation. I note that you are requesting the services of CQM be performed by a “credentialed contractor” under NAICS code 236220.

We are a SDVOSB A/E/C firm with extensive experience performing CM and QA services on medical facilities for DoD. Typically, we perform these services under NAICS code 541330, Engineering Services. Our engineers, inspectors, PMs and CMs are experienced in providing a wide range of Engineering and Construction Phase Services including:

Pre-design phase Facility Planning & Feasibility Studies Space Planning Statements of Work (SOW) Full Requests for Proposals (RFPs) Provide order-of-magnitude cost estimates Design phase Conduct engineering design and constructability reviews Lead project meetings including project kickoffs, design workshops and charrettes

1. Sorry, we’ve already conducted our market research under NAICS Code 236220 and based on our analysis of the responses to the market survey we have set the requirement aside under this NAICS for competition among small businesses.

Construction phase Construction Management Construction Inspection Risk Management Engineering Investigation/Site Visits Shop Drawing Review Prepare As-Built Drawings Post Construction Phase Engineering inspection and investigation Develop construction deficiency mitigation plans

In addition, throughout the design/construction lifecycle:

Program/Project Management Project Scheduling & Controls Contract Management Project Administration Commissioning

We find that placing the CMQ services in the hands of an A/E firm experienced in managing projects from the owner’s perspective provides a broader range of services available to the owner. As an A/E and CM we understand all phases of the project and have the engineering and architectural expertise to work with the designer to provide solutions to issues that arise during the construction phase. With engineering and architectural expertise in-house, our CMs and inspectors have the reach-back resources available to solve issues without the need for additional sub-consultants. In addition, our commissioning capability permits us to act as a 3rd party commissioning agent, completely independent of the construction process.

There are many very well-qualified small business operating under NAICS 541330 that have the capacity and experience necessary to perform the work as advertised, and I believe that the NIH would be well-served to consider placing this work under this code.

I would welcome the opportunity to open a dialogue with you concerning this matter. Additionally, if you believe it would be beneficial, I can arrange a visit to your agency to discuss our capabilities and the benefits of contracting for owner’s services with a SDVOSB A/E firm.

2. Could you please confirm the due date to submit proposals for solicitation NIHOF2010227 (CQM services for Renovation of Building 10 F Wing)? The RFP indicates May 31, 2010. May 31, 2010 is a holiday.

2. The proposal response date is changed to noon, June 1, 2010.

3. Could you please advise when the proposal intent response form needs to be submitted?

3. At the earliest convenience.

4. (a) First, as a full solicitation posting, I wanted to confirm that the presolicitation has since passed and the full solicitation is in effect at this time.

(b) Second, I am not sure if we are in the 'Small Business Program' but are registered with the NAICS code - 236220. Is there a way to confirm we are eligible?

4. (a) The solicitation was posted Thursday, April 26, 2010 and the proposal due date is Tuesday, June 1, 2010

(b) The Small Business Size is $33.5 million and is defined in

Federal Acquisition Regulation (FAR) 19.1 (see https://www.acquisition.gov/far/current/html/Subpart%2019_1.h https://www.acquisition.gov/far/current/html/Subpart%2019_1.html#wp1101805

(c) Third, as it reads, the CQM will oversee the CMc and A/E. This bid is for the CQM only, not the other roles. Is that correct?

tml#wp1101805

(c) This is correct. Both the CMc and A/E are under a separate solicitation/contract. This Solicitation is for CQM services only.

5. I am writing you to inquire if any consideration has yet been given to using Gas/Vapor/Particulate Barrier Systems as an alternative/solution to any and all abatement by removal of Asbestos Flooring at this project? Contractors will always prefer to tear everything out which is time consuming and costly. If the NIH expects a Construction Contractor to independently look at alternatives that in addition are preferred by the EPA and also are less costly and time consuming then a specific request for including this alternative needs to be included as an option.

In July 1990 the EPA released “The Management Planners Guideline to Managing Asbestos in Place” [publication #20T-2003]. They defined enclosure as “the construction of an airtight barrier around the asbestos material.” Further, that “wherever possible, non-disruptive management-in-place abatement methods are recommended by the US OSHA and

HUD.”

(Attached EPA Green Book for Detail).

About NAFES Inc:

1. National Asbestos Flooring Encasement Systems Inc. core competency is Asbestos Flooring, exclusively, and the application of our patented Asbestos Barrier System®. We are experts in remediation using management in place technology which is the EPA preferred method over abatement by removal

5. The requirement is not for construction services, but rather construction Quality Management Services. A separate contract will be awarded for construction and it was advertized under Solicitation #NIHOF2010208.

2. Our patented system of encapsulation is the primary method used by the US Postal Service

3. Our System does throughout the country. In addition we are also used by all levels of government, school districts, law enforcement and commercial companies coast to coast.

4. We are a "Green" System in that the Asbestos Flooring does not need to be removed and placed in Landfills.

require containment and allows for next day occupancy using any overlay (Carpet, BioTiles, Ceramic, Wood)

5. EPA preferred, with over 15 years and 1 million sq ft installed without failure at over 100 US Post Offices

6. The cost

(Barrier System and Overlay) is on average less than half (-50%) that of abatement by removal and avoids the inconvenience and costs of downtime.

I have attached our Business Capabilities Brief for your review and I hope that I have given you information that will be of value.

Thank you for giving us/me the opportunity to become a part of your thinking when it comes to your project.

19. Although RFP Page 58 incorporates “FAR Clause 52.230-2, Cost Accounting Standards,” (CAS) please confirm that this solicitation will be exempt from the CAS requirements due to its classification as a small business set-aside, or alternately the small value of the expected award, or alternately the adequacy of price competition (three established exemptions to

CAS).

19. FAR Clauses 52.230-2, 52-230-3 and 52.230-6 do not pertain to small business and are removed from this solicitation.

20. Please list the required certifications, if any, to be held by the CQM or a CQM sub-consultant in the performance of non-structural building enclosure commissioning services.

The CQM or CQM sub-consultant shall be either a Professional Engineer (P.E.) or Registered Architect (R.A.), with a minimum of five (5) years experience with building envelope commissioning, with five (5) references from projects of similar types.

21. Please clarify the role of the Activation Contractor (RFP Page 23). Are the services of the Activation Contractor part of this CQM solicitation (CQM acts as Activation Contractor) or is the Activation Contractor procured separately, and only supervised by the

CQM?

21. The services of the Activation Contractor are part of the CQM contract.

22. Please clarify the anticipated initiation date for Project Phase B. Information regarding the (assumed) start date relative to the initiation of Project Phase A is required to accurately generate a staff phasing plan.

22. The award of the Option - Phase B CQM services is anticipated on or about the same time as the award of Phase A.

23. Please confirm that the Delivery Schedule (P. 35) anticipates Project Closeout to be coincident with Occupancy/Activation in Phase A (157 Days), but longer than Occupancy/Activation in Phase B (96 days for Phase B Closeout compared to 35 days for Phase B Occupancy/Activation).

23. The date for the beginning of the Activation Phase will be revised to 1700 days after award. However; as part of the CMc’s evaluation and during the Pre-construction phase, the Government, working with the CMc contractor and supported by the CQM contractor, will seek to accelerate the schedule for Phase B. Once the schedule has been finalized, the deliverable dates identified for Phase B on page 35 of the CQM contract will be modified accordingly.

24. Please confirm that the Delivery Schedule (P. 35) assumes different Awards for Phase A and Phase B in calculating the Period After Award

– that is, Day 90 for Phase A is different from Day 90 for Phase B.

24. See response to Question # 21. The Pre-Construction CQM services supports the Government’s effort in reviewing and evaluating the CMc performance and deliverables during the Pre-Construction Contract Services is defined in the CMc contract. It is anticipated that the CMc contract will be awarded prior to the award of the CQM contract. The durations list on page 35 represent the Government’s best projections when the CMc’s Preconstruction Services will be completed relative to the projected award for the CQM contract.

25. I’m interested in possibly attending the site walkthrough for solicitation NIHOF2010227 next Thursday but wanted to get a better understanding of the project.

Will the contractor be responsible for purchasing and installing any lab equipment? I can’t seem to find any specification on fbo.gov so I just wanted to make sure.

25. Yes. Please refer to Section C, Paragraph 3.5.3.5 on page 28 for the requirements under this contract.

26. Can the small business (Prime Contractor) use the experience of his larger teaming partner(s) for similar or past experience?

26. The Small Business Prime Contractor must be able to demonstrate the ability to self-perform 15% of the work in accordance with NAICS 236220. Presenting experience of larger team member(s) is acceptable; the experience of the entire team will be evaluated. However, the experience of the team cannot be solely that of the larger team member(s). The small business must demonstrate experience.

27. Are activation services part of CQM services or Third-party?

27. Activation services are included in the scope of work for the

CQM.

28. If the Prime Contractor is a Small Business in a Joint Venture (JV), does the JV need to be registered in the CCR by time of submittal?

28. Yes. A copy of the JV Agreement as well as a DUNS number for the JV shall be submitted at the time of submission. The JV Agreement shall be submitted as part of the Business Proposal.

29. Two different lists for Key Personnel are listed in the solicitation (page 31 and Page 81). Which listing is correct?

29. See Question 18.

30. What is the current status of design for Phase B? 30. Design is complete.

31. Has an Independent Government Estimate (IGE) been done for Phase B or will that be required from the

CQM?

31. Yes, an independent Government Estimate has been prepared for Phase B. Since the CMc contract will be award prior to this contract, the GMP amounts for Phase A & B will be known.

32. What is anticipated for preconstruction services on

Phase A? Phase B? How many design reviews for each Phase? Same question for value engineering workshops?

32. As previously noted the design is completed

33. As the Activation Manager, will the CQM have to pay for new medical/scientific equipment or furniture out-of-pocket and wait for reimbursement from NIH?

33. Yes. Please see 4th to the last paragraph on page 23.

34. Is the listed QA/QC Manager different from the

General Inspector? The pricing sheets seem to use the titles interchangeably.

34. Yes there are two different positions.

35. Gilbane has submitted on the F-Wing CM requirement

Solicitation # NIHOF20102008PS.

35. We cannot stop you from teaming with another firm to pursue the

CQM; however, if your company is the successful offeror for the

Due to our involvement in providing Transition Planning Management & Activation Service at NIH we have been approach by several small businesses to be part of their team on the F-Wing CQMC, Solicitation # NIH OF2010227 set-aside for small business.

Is Gilbane able to support a small business on this CQMC or are we exempted out due to the possibility Gilbane may be selected as the CM?

We have been asked to participate by the small businesses and if Gilbane is selected for the CM requirement they would then replace us with another activation provider, would this be acceptable?

Gilbane does not want to encumber our consideration for the role as CM on The F Wing if this is an option.

I appreciate your consideration and direction on how we should proceed.

CMc then we could not also award the CQM services contract to your team. Regarding the last statement, the technical evaluation board selection would be based on the team at the time of evaluation; so the firms could not then switch to another team member if your firms become ineligible.

36. We would like to submit our qualifications in response to Solicitation NIHOF2010227-- Construction Quality Management Services to Renovate Building 10, F Wing, NIH, Bethesda, MD. The subconsultant we planned to team with for a portion of the work was also worked as part of the design team. Can we still partner with them or that will be a conflict?

36. No. This would be a conflict.

37. Sorry I missed your call. I was unable to attend the pre-proposal meeting last week. Would it be possible to meet with you on site and tour the building?

37. We’ve already completed the site visit. I will put you in touch with the Project Officer; however I cannot guarantee that he will provide you with a tour. You can contact him at appenzellarwa@mail.nih.gov mailto:wayne.appenzellar@nih.gov

Thank you.

38. Phasing: Should proposals be based on the assumption that Phase A (Base Services) could be awarded without the award of Phase B (Option), or more evenly distributed stipulating that both Phases will be executed concurrently? If the CQM is required to complete Phase A alone (without the Phase B Option), it is necessary to include more recourses in the Phase A proposal, in order to satisfy all scope requirements without the benefits (savings) of using resources on both Phases simultaneously.

38. Phase B is an option and should be priced accordingly. This option will be awarded shortly after the Phase A Base award.

39. CQM Offices: What services, furniture and equipment are the NIH and the Construction Contractor required to supply to the CQM to facilitate the CQM’s on-site offices?

39. Section C, paragraph 2.3.3 defines the limit of the Government Services provided.

40. Key Personnel:

(a) Can one candidate fill multiple part-time roles, if they are capable and qualified for multiple positions?

(b) RFP Page 31 (and RFP Attachment 8 Tables A1, A2, B1 and B2) identifies a “General Inspector” as part of the key personnel team, but does not mention a “QA Manager” or a “QA/QC Manager.”

RFP P. 81 and RFP P. 90 mention a “QA Manager.”

40.

(a) Yes. The merit of this will be evaluated by the Technical team.

(b) Attachment #8 will be revised to clarify the positions. The QA manager and QA/QC Manager are the same position.

The General Inspector is different from the QA or QA/QC Manager.

RFP Attachment 8 Tables A3 and B3 identify a “QA/QC Manager.” Are the General Inspector, QA Manager, and QA/QC Manager different terms for the same role? If not, can the roles be filled by the same candidate?

41. Commissioning:

(a)Please provide a definitive scope of work for commissioning.

(b) For example, RFP Page 21 Requires the commissioning of air barriers – is this to be performed using a qualitative method (ASTM E779-03, Standard Test Method for Determining Air Leakage Rate by Fan Pressurization) or quantitative method (ASTM 1827-96, Standard Test Methods for Determining Airtightness of Buildings Using and Orifice Blower Door) or by some other method? If by another method, please state the required tests and/or equipment requirements?

(c) Can a firm currently partnered with the Architect (LSY Architects) as a subconsultant on the design-team for this project also be selected as a sub-consultant on the CQM team?

(d) RFP Attachment 8 Tables A3 and B3 list a possible subcontract for Materials Testing – what Materials Testing (please list specific tests, if any) is required under this CQM Services solicitation?

41.

(a) Under this contract the CQM is required to perform the Building Enclosure Commissioning Services for those systems defined in Section C, Part 3.2.13.

(b) <Wayne>, can you or LSY provide more information?

Is this spelled out in the Design specification. If so we can include them as an attachment>.

(c) No this would be a conflict of interest see response to Question #36.

(d) No material testing is anticipated at this time.

42. (a) How do you anticipate the scope of the Activation Contractor to be priced under this

(a) Add any positions required to support the Activation to solicitation – since Pricing Schedule Tables (RFP Attachment 8) do not list separate personnel for this service and also do not list a subcontract for this service? Is the scope of the Activation Contractor to be provided by the Key Personnel Team?

(b) RFP. P. 23 says “The Activation Contractor will be responsible for… providing trade labor services as required to remove, relocate and install (including disconnecting and connecting of utilities as required) the equipment.” Should Movers be included in this proposal for CQM Services?

(c) If moving services are required, how should they be formatted onto the Pricing Schedule Tables (RFP Attachment 8)?

(d) If moving services are required, please provide more information regarding the extent and nature of the equipment?

(e) RFP P. 28 says “Activation Contractor receives Vendor invoice and makes payment to vendor.” Does this payment come directly from an NIH-based funding source or is it funded by the CQM Contractor on an at-Risk, reimbursable basis? If it is funded by the CQM at-Risk, can you provide an estimated budget for the CQM-purchased equipment and

Attachment #8.

(b) furnishings?

(f) Can you explain the extent of the CAD effort required of the CQM Contractor?

(g) Are existing equipment and new equipment lists being generated by the A/E or are these lists the responsibility of the Activation Contractor?

(h) Is the Activation Contractor using documentation generated during the programming and design phase of the project by the project A/E? If so, this would be an inventory verification process. If not, the Activation Contractor would be generating an equipment list based on the input from the NIH scientific community moving to the new space. Will this data be passed to the A/E for inclusion in the Final Construction Documentation?

43. Several attachments required for the Business Proposal request information of the Company’s Principal Investigator. Who is the Principal Investigator and how does it relate to an offeror’s proposal?

43. Replace the Principal Investigator with your project executive or program manager, etc.

44. The Business Proposal requires that an Offeror submit a copy of the Wage Determination.

Wage Determinations are updated on a routine

44. If your proposal is based on the most recent wage determination you should provide a copy of this wage determination with your proposal.

basis and in fact have been updated since the RFP was issued. Does NIH really want a copy of the Wage Determination included in the RFP to be replicated in an Offerors proposal or do they want the most current Wage Determination publish?

45. As Wage Determinations are continuously updated what is the purpose of including any Wage Determination in the Business Proposal?

45. Wage determinations indicate the minimum wage. If you anticipate wage increases those increases should be indicated in your proposal for each year. In most cases price increases are determined by projected CPI. You should provide the basis for your projected price increase broken out by year.

46. The Business Proposal Attachments show a QC/QA Manager in some places and in others refer to an Inspector. Is this the same position or are they two separate positions that must be included as the Offer?

46. They are two separate positions.

47. The Tasks under each phase do not always align with different parts of the RFP. For example in Section B, Phase 4 is Project Closeout and Phase 3 is Occupancy/Activation, but in Attachment 8, the Task numbers are reversed. Please clarify.

47. Use the Order included in Section B.

48. Are Subcontractor cost information such as Indirect Work Sheets, overhead rates and cost build ups required in the Business Proposal?

48. Yes, but just first tier sub-contractors.

49. If Subcontractor cost information is required, can this be included in a separate volume or should it be included as another attachment in

49. Include your sub-contractor pricing information as an attachment in the Business Proposal.

the Business Proposal?

50. The Business Proposal requires the completion of SF 1442 which is a form normally completed by the Government for Construction Solicitations in which the Governments states requirements such as the need for Bonds, duration the bid is valid, number of copies of bids, etc. Is NIH requesting that the Offeror fill in this data and thereby deciding this information or should this form be deleted in its entirety?

50. Bid, Payment and Performance bonds are NOT required for this contract. Form 1442 is included because this contract is solicited under the construction NAICS. Please only fill out the applicable sections of the Form 1442.

51. The RFP requires that the Offeror complete Section K and include their ORCA Reps and Certs. Since these are identical can one be deleted as a requirement or does NIH really want to see two identical documents?

51. You do not need to complete the full Section K reps and certs;

just a portion. Please read the instruction in the Section K representation and certification for which portion to complete and return along with the ORCA reps and certs.

52. The RFP states that the Option will be awarded ‘shortly’ after the Base. Can NIH further define the meaning of the work ‘shortly’ as it may significantly affect both the Technical and Business Proposals depending if it is a week, a month or a couple of months.

52. Hopefully within 2 weeks of the base award.

53. Owner Contingency is not included in the Attachments for the Price Buildup. Therefore, the Price in Section B will not be equal to any price in any of the Attachments specifically Table 3. Please clarify if NIH wants Offerors to include the Owner Contingency as a line item in the Attachments.

53. No. NIH will add the Owner’s contingency to the Attachments.

54. The Technical Proposal requires a Cost Summary, Attachment 3. This is unusual to include Price or Cost Information within the Technical Proposal as they are normally evaluated completely separately. Please reconfirm that NIH wants Price/Cost information included in the Technical Proposal?

54. Attachment #3 “Technical Proposal Cost Summary” should be included with the Business Proposal attachments.
