QUESTIONS RESPONSES TO QUESTIONS

1. I am writing to obtain clarification on the services defined in the subject solicitation. I note that you are requesting the services of CQM be performed by a “credentialed contractor” under NAICS code 236220.

We are a SDVOSB A/E/C firm with extensive experience performing CM and QA services on medical facilities for DoD. Typically, we perform these services under NAICS code 541330, Engineering Services. Our engineers, inspectors, PMs and CMs are experienced in providing a wide range of Engineering and Construction Phase Services including:

Pre-design phase Facility Planning & Feasibility Studies Space Planning Statements of Work (SOW) Full Requests for Proposals (RFPs) Provide order-of-magnitude cost estimates Design phase Conduct engineering design and constructability reviews Lead project meetings including project kickoffs, design workshops and charrettes

1. Sorry, we’ve already conducted our market research under NAICS Code 236220 and based on our analysis of the responses to the market survey we have set the requirement aside under this NAICS for competition among small businesses.

Construction phase Construction Management Construction Inspection Risk Management Engineering Investigation/Site Visits Shop Drawing Review Prepare As-Built Drawings Post Construction Phase Engineering inspection and investigation Develop construction deficiency mitigation plans

In addition, throughout the design/construction lifecycle:

Program/Project Management Project Scheduling & Controls Contract Management Project Administration Commissioning

We find that placing the CMQ services in the hands of an A/E firm experienced in managing projects from the owner’s perspective provides a broader range of services available to the owner. As an A/E and CM we understand all phases of the project and have the engineering and architectural expertise to work with the designer to provide solutions to issues that arise during the construction phase. With engineering and architectural expertise in-house, our CMs and inspectors have the reach-back resources available to solve issues without the need for additional sub-consultants. In addition, our commissioning capability permits us to act as a 3rd party commissioning agent, completely independent of the construction process.

There are many very well-qualified small business operating under NAICS 541330 that have the capacity and experience necessary to perform the work as advertised, and I believe that the NIH would be well-served to consider placing this work under this code.

I would welcome the opportunity to open a dialogue with you concerning this matter. Additionally, if you believe it would be beneficial, I can arrange a visit to your agency to discuss our capabilities and the benefits of contracting for owner’s services with a SDVOSB A/E firm.

2. Could you please confirm the due date to submit proposals for solicitation NIHOF2010227 (CQM services for Renovation of Building 10 F Wing)? The RFP indicates May 31, 2010. May 31, 2010 is a holiday.

2. The proposal response date is changed to noon, June 1, 2010.

3. Could you please advise when the proposal intent response form needs to be submitted?

3. At the earliest convenience.

4. (a) First, as a full solicitation posting, I wanted to confirm that the presolicitation has since passed and the full solicitation is in effect at this time.

(b) Second, I am not sure if we are in the 'Small Business Program' but are registered with the NAICS code - 236220. Is there a way to confirm we are eligible?

4. (a) The solicitation was posted Thursday, April 26, 2010 and the proposal due date is Tuesday, June 1, 2010

(b) The Small Business Size is $33.5 million and is defined in

Federal Acquisition Regulation (FAR) 19.1 (see https://www.acquisition.gov/far/current/html/Subpart%2019_1.h https://www.acquisition.gov/far/current/html/Subpart%2019_1.html#wp1101805

(c) Third, as it reads, the CQM will oversee the CMc and A/E. This bid is for the CQM only, not the other roles. Is that correct?

tml#wp1101805

(c) This is correct. Both the CMc and A/E are under a separate solicitation/contract. This Solicitation is for CQM services only.

for more information)

5. I am writing you to inquire if any consideration has yet been given to using Gas/Vapor/Particulate Barrier Systems as an alternative/solution to any and all abatement by removal of Asbestos Flooring at this project? Contractors will always prefer to tear everything out which is time consuming and costly. If the NIH expects a Construction Contractor to independently look at alternatives that in addition are preferred by the EPA and also are less costly and time consuming then a specific request for including this alternative needs to be included as an option.

In July 1990 the EPA released “The Management Planners Guideline to Managing Asbestos in Place” [publication #20T-2003]. They defined enclosure as “the construction of an airtight barrier around the asbestos material.” Further, that “wherever possible, non-disruptive management-in-place abatement methods are recommended by the US OSHA and

HUD.”

(Attached EPA Green Book for Detail).

About NAFES Inc:

• National Asbestos Flooring Encasement Systems Inc. core competency is Asbestos Flooring, exclusively, and the application of our patented Asbestos Barrier System®. We are experts in remediation using management in place technology which is the EPA preferred method over abatement by removal

5. The requirement is not for construction services, but rather construction Quality Management Services. A separate contract will be awarded for construction and it was advertized under Solicitation #NIHOF2010208.

• Our patented system of encapsulation is the primary method used by the US Postal Service

• Our System does throughout the country. In addition we are also used by all levels of government, school districts, law enforcement and commercial companies coast to coast.

Not

• We are a "Green" System in that the Asbestos Flooring does not need to be removed and placed in Landfills.

require containment and allows for next day occupancy using any overlay (Carpet, BioTiles, Ceramic, Wood)

• EPA preferred, with over 15 years and 1 million sq ft installed without failure at over 100 US Post Offices

• The cost

(Barrier System and Overlay) is on average less than half (-50%) that of abatement by removal and avoids the inconvenience and costs of downtime.

I have attached our Business Capabilities Brief for your review and I hope that I have given you information that will be of value.

Thank you for giving us/me the opportunity to become a part of your thinking when it comes to your project.

Pre-proposal Meeting NIHOF 2010227 – Building 10 F Wing Renovation – CQM

Date/Location: May 13, 2010, at the Lipsett Auditorium

Aaron Crawford NIH ORF Representatives:

Wayne Appenzellar, AIA

1. Aaron welcomed the attendees and introduced himself as the Contracting Officer for this project.

2. Aaron stated that the most recent Amendment addressing the RFIs was posted on FedBizOpps last night.

3. The last day that the Government will entertain questions is noon on May 24th

4. Aaron also reminded everyone that the proposals are due noon on June 1 . The Government will not respond to questions received after that time.

st.

5. Aaron stated that Wayne Appenzellar, the Project Officer, will provide a brief overview of the Project, followed by a Questions and Answers. Aaron further stated that minutes of this meeting, the handouts, and sign-in sheets would be posted on FedBizOpps.

The proposal shall be in two binders. One for the technical response and one for the business response that contains the cost and pricing information.

Aaron stated that this was to focus the technical review on only technical issues. While technical is more important than costs, cost will be considered after the technical review has been completed.

6. Wayne stated that the project was part of an overall effort to renew portions of the original Building 10. The project will be accomplished in two phases.

Phase A and & B. While the phases will be accomplished together a distinction is made because of the funding source and the availability of space.

7. Wayne reviewed each of the phases. Wayne emphasized that in addition to the work required within the structure that there is also work affecting the exterior envelope. Please refer to the Handout for a detailed explanation of each project phase.

8. Wayne reviewed the project schedule and stated that there are two critical dates. September 2010, the date when ARRA funds have to be obligated, and September 2015, the date when all the funds have to be dispersed.

9. Prior to opening the meeting to questions, Wayne discussed a recent RFI that requested the Government to identify the necessary qualifications for the exterior envelope commission person. Wayne explained that the mechanical system proposed for the renovation requires strict control of humidity levels within the occupied space. Commissioning for the Building Envelope will be a requirement under the CQM contract. It is expected that this position will work closely with the Commissioning agent for the balance of the project.

The Commissioning Agent must be a Registered Engineer or Registered Architect; possess a minimum of 5 years experience specifically in Building Envelope Commissioning; and must provide five (5) references from other projects

2. Question: Are activation services part of the CQM services or Third-party?

Answer:

Activation services are included in the scope of work for the CQM.

3. Question: If the Prime Contractor is a Small Business in a Joint Venture (JV), does the JV need to be registered in the CCR by time of submittal?

Answer:

Yes. A copy of the JV Agreement as well as a DUNS number for the JV shall be submitted at the time of submission. The JV Agreement shall be submitted as part of the Business Proposal.

4. Question: Two different lists for Key Personnel are listed in the solicitation (page 31 and Page 81). Which listing is correct?

Answer:

See response to RFI #18 - The key personnel listed in Section C, paragraph

4.5.2 on page 31 are the positions that require CO approval before they can be removed from the project. The key personnel listed in Section L paragraph 3.a on page 81, and Section M, paragraph a. on page 90 are the key personnel that will be evaluated as part of the Technical Evaluation.
