NIHOF2010205PS – “RECOVERY” Porter Neuroscience Research Center Phase II

Friday, February 26, 2010

QUESTIONS NIH RESPONSES TO QUESTIONS

1 We request a bid extension for the project based on the slow turn around time of document printing by American Reprographics, as mentioned in the prebid.

1) The due date for the receipt of proposals is extended to 9:00 AM EST, Monday, March 15, 2010.

2 In specification section 12500 Part 1.1 (c) Whiting Turner is named as the Construction Manager. Are they providing all the furnishings and are we to exclude this from our bid?

2) Delete Sections 12500 and 12500A from the Construction Manager’s scope of services along with any reference to Whiting-Turner (12500 Part 1.1 (c). Delete scope of services associated with the furnishings, free standing chairs, seating and tables reflected within Drawings AI-1- 40D through AI-1-47F.

3 Question 32 of amendment 1 eliminates the term allowance from buy out contingency definition. Similarly, we would assume that construction contingency is not intended to be an allowance on page 11 section C.7.21.

Please confirm that construction contingency is not an allowance.

3) Confirmed. Construction contingency is not an allowance.

4 The page 83 of the RFP states that proposals shall be submitted on letter size paper. For legibility purposes, please confirm that if it is acceptable to include site logistics plans on 11" x 17" paper properly folded to 8 1/2" x 11" size.

4) This is allowed.

5 In regards to Key personnel and question 25 of amendment #1, please confirm if it is acceptable to submit a different manager/engineer to superintendent ratio as long as the total quantity of key personnel matches the RFP requirements. Our experience tells us that CM's often cross train their engineers/managers/superintendents differently than their competition and as such have slightly different job descriptions/expectations of their employees.

5) The key personnel listed is the Government’s recommended minimum based on our prior experience with similar projects. They key personnel determination is the responsibility of the contractor.

6 6.a. In the RFP, Article L.2.c.4(b)(2) (page 99) indicates “ As soon as 6) a. The Certificate of Current Cost or Pricing Data will be practicable after agreement on price, but before contract award (except for unpriced actions such as letter contracts), the offeror shall submit a Certificate of Current Cost or Pricing Data, as prescribed by FAR 15.406 2.

A Certificate of Current Cost or Pricing Data is included in the Section J Business File Folder issued in Addenda 1, RFI Response, Attachment 7 as one of the attachments to be submitted with the Business proposal. Please clarify this Certificate is not required as part of the initial proposal but part of the final proposal during the Preconstruction Phase Services.

6.b. We are inquiring regarding NIH’s answer to Question A in the Pre- Proposal Conference Meeting Minutes published in Amendment #2:

A. Is this a CAS Compliant Job? Asked Kwaku Gyabaah of Clark Construction.

NIH Answer: Yes, it is a CAS compliant project. Vendors are directed to Federal Acquisition Regulation 52.230-2 to familiarize themselves with these requirements which will be adhered to.

We respectfully request that NIH delete the CAS compliance requirement from the project, as we believe that it will unnecessarily reduce the pool of qualified Offerors for this project, potentially resulting in an award that is not the best value for the Government. We believe that submission and certification of Cost or Pricing data to support negotiation of the Final GMP/Firm Fixed Price is adequate assurance for the Government of the reasonableness of the negotiated price. Since it is the Government’s stated intention that the contract be Firm, Fixed Price following establishment of the Final GMP, we believe that the requirement for CAS compliance is not necessary.

Since this is a Go/No-go threshold for many qualified contractors, we respectfully request that NIH answer this RFI not later than COB, Monday, February 22, 2010.

required for the Final GMP, not with the submission of the proposals for the Target GMP.

6.b. Compliance with CAS is not required at the time proposals are submitted but is required upon contract award if applicable. CAS is not required for business that meet the SBA small business standards.

Since the Target GMP and the Final GMP will contain contingencies, the contract will not be a firm fixed price award, but a fixed price award. Any references in the solicitation to firm fixed price is incorrect.

The Certificate of Current Cost and Pricing Data will not be required until the Final GMP. The requirement for other than cost or price data has been revised. See the revised Pricing Schedules based on divisional pricing and revised budget narrative.

7 In the RFP, Article L.2.c.12b (page 106) states “One copy of the offeror’s (and any proposed subcontractor’s) written travel policy shall be included in the business proposal (original only). If and offeror (or any proposed subcontractor) does not have a written travel policy, the offeror shall so state.” Please verify the Budget Narrative and Supporting Documentation outlined in Addendum 2 supersedes this requirement and the travel policy is

7) Confirmed. Also, see revised budget narrative instructions attached to this amendment.

not required with our Target GMP proposal.

8 Regarding response 1 on page 1 of the Addendum 1 question responses dated 2/17/10, please clarify what needs to be submitted via e-mail from the Business Proposal– just the pricing schedules in Excel format and the small business plan PDF format? Are all other sections of the Business Proposal solely to be submitted via hard copy? Also, it would be helpful to have an Excel file containing the pricing schedule in addition to the Word file provided with Section J in Amendment 1.

8) Submit the Pricing Schedules as an Excel file using the revised Pricing Schedules and budget narrative instructions attached to this amendment.

9 Regarding Question 25 of Amendment 1 and the answer provided by NIH, please confirm that a resume is not required for the General Superintendents on the CMc staff.

9) Confirmed.

10 Form SF1442 states contract time of 1825 calendar days. Please confirm correct time of performance.

10) This is incorrect. Chart on page 7 states total of 42 months; 42 month – 3.5 years = 1,277 days.

11 Please advise whether or not staff resumes, though not included in the page limit for the Technical Proposal, will be evaluated with the Technical Proposal.

11) Staff resumes will be evaluated as part of key personnel.

12 Please confirm that Contract Time is to begin at Notice to Proceed.

12) Yes.

13 Page 91 under Section I Demonstrates Similar Experience states “at least two complex laboratory research facilities…:” Page 92 under section II Relevant Experience notes this section should address the following for the two projects identified. Please advise if two projects are maximum, or what the maximum number of projects are under Technical factors I and II

13) Minimum of two (2) and a maximum of four (4) projects meeting the stated requirements.

14 Page 19, paragraph C.9.2.2 refers to the Construction Site Field Office and indicates that an existing trailer is available for the use of the CMc staff.

Please confirm that this trailer will be large enough to accommodate our entire staff as described on page 93 and will also be used to hold project meetings, subcontractor meetings, etc.

14) Yes, it will house the proposed CMc staff but is shared with the government and the CQM. There is currently one large conference room and one small meeting room, which should be sufficient for these primes but will not be sufficient and thus not available for subcontractor use.

15 Page 19, paragraph C.9.2.3 refers to the Construction Project Utilities and 15) Water and electrical will be available at no cost for indicates that electrical energy will be provided at no cost. Are other utilities such as water, natural gas, steam, etc. also available at no cost?

Furthermore, the paragraph states that electricity cannot be used for heating or cooling purposes. Please clarify what methods are allowed and acceptable to NIH for heating and cooling the building on a temporary basis during the construction phase?

construction. The contractor is responsible for providing temporary cooling and heating as required. If electrical is proposed it will be metered and paid for by the contractors.

16 The first page of the Price Schedule issued in Amendment # 1 has "blank" lines in the "CATEGORY" section with a subtotal for Labor. Is this section to be used for us to list our Key Staff labor?

16) That was the original intent. The Pricing Schedule has been revised to request labor and materials by divisions.

See attached revised Pricing Schedule.

17 Will the NIH be hiring and paying for an independent third party Testing and Inspection Services or is this to be included in the CMc scope of work?

17) The government will provide and pay for a third party materials testing and inspection service through its CQM contractor. However, the cost of retesting for failures shall be borne by the construction contractor.

18 Please confirm that the CMc is responsible for providing only one (1) Quality Control Officer. Can you tell us the minimum qualifications of the Quality Control Officer?

18) The contractor is responsible for providing a QC Officer with knowledge, skills, abilities, experience and authority sufficient to guarantee that the product and services provided by the contractor meet the quality required by the contract documents.

19 Page 105, section 10 regarding Subcontractors directs us to include a commitment letter from each subcontractor along with a large amount of data to support the commitment including a detailed cost proposal in the same format as the offeror's proposal. Your response to Question #7 in Amendment #1 confirms we are to include the subcontractors as part of our submission. This is a tremendous amount of information to include in our proposal considering pricing from our subcontractors will not be received until the last minute on the same date our proposal is due. Instead, may we include a preliminary list of the major subcontractors we intend to solicit cost proposals from without including the commitment letter and all the supporting documentation?

19) While not firm, your subcontractor prices should be a part of your submission. Letters of commitment should be provided. Please note that the Pricing Schedules have been changed to provide prices by divisions and lift the burden of support data for contractors and subcontractors. Also, you must submit a Small Business Subcontracting Plan based on your proposed subcontracting.

20 What is the Level of Detail of the BIM model to be provided by the design team and has the design team developed an AIA E202 LOD matrix as part of their BIM implementation plan? What is the intended Level of Detail for the BIM model to be built and maintained by the CMc?

20) AEI has modeled approximately 98% of the design in 3D utilizing ABS (Autodesk Building Systems). Mechanically, cooling coil condensate drainage from interstitial FCUs are not modeled; plumbing there are only a few pieces of piping not modeled in 3D. No, an AIA E202 LOD matrix has not been developed as the building design was performed in 2006-2008.

21 Can the existing Revit model be provided to the offerors during the proposal phase?

21) No, BIM model is currently being updated with on-going occupancy programming and new sustainability features.

22 Does the as-built BIM model need to mirror the level of detail that the design team is already producing? If so, does this include completely reproducing all of the design documentation (drawing sheets) that has already been produced by the design team?

22) The BIM model should contain all of the information in the architects documents required to provide a full BIM model that can be utilized by the owner for the full range of facilities management.

23 Are all of the Architect's sub-consultants using Revit for all Structural, Mechanical, Plumbing, Electrical, Lighting Telecommunications, Specialty (medical) systems and equipment, furnishings, food service, fire protection, etc.? If so, please confirm similar level of detail is provided in all files.

23) No, the project was designed from 2006-2088 and didn’t have the requirement that all sub-consultants utilize Revit;

only the Architects (core & shell) and interiors are currently modeled in Revit. Reference Specifications Section 01310, paragraph 1.5. (See responses to 20 and 26).

24 Will the design team be updating their Revit/BIM model (for issuing bulletins, RFI's, ASI's, etc.) or will the design team be issuing instructions to the contractor on how to update the construction Revit/BIM model and make all necessary design changes? (Question applies to all phases of the project.)

24) The A/E ownership and maintenance of the BIM Model concludes with the design phase. The A/E works with the CQM to then transfer the BIM model to the CM during the project bidding phase and then supports the CM in construction coordination and clash protection.

25 If the design team is using their Revit BIM model for issuing design changes, is it NIH’s intent that there will then be two "current" Architectural Revit/BIM models for the project, one maintained by the CMc, and one by the Architect?

25) No, it is not NIH’s intent to have two parallel and concurrent Revit/BIM models.

26 Will the design team be using software such as Navisworks or similar to coordinate all building systems as part of their design quality control? If so, will all the building systems be modeled in the appropriate detail (including duct/pipe insulation, sloped pipes, equipment clearances, etc.)

26) AEI has utilized NavisWorks for 3D coordination between disciplines. The ductwork and piping insulation is not modeled but has been taken into account. Not all piping has been modeled as sloped. Equipment clearances are not specifically defined in the model, but have been considered.

27 What is the intended purpose of the as-built BIM model? How will it be used by NIH after project close-out?

27) It will be used as the basis for overall facilities management.

28 Does NIH desire to have an editable Revit/BIM model of all project elements for later use?

28) Yes.

29 Are all building systems required to be modeled in the Revit suite of products, 29) All or just the architectural elements?

30 Note that subcontractors do not typically use Revit for fabrication models as

Revit is not suited well for that purpose. In order to produce a Revit model for all building systems, the subcontractor BIM fabrication models will need to be re-modeled in Revit at the end of the project when the final conditions are known and unchanging. Please advise if such Revit re-modeling is required of the CMc, or if it is acceptable to provide a composite BIM as-built model in Navisworks format with the editable native subcontractor files as reference/back-up.

30) It is acceptable to provide a composite BIM as-built model in Navisworks format with the editable native subcontractor files as reference/back-up.

31 On Sheet D-0-03, General Demolition Note 5 refers the reader to:

“…demolition and sequence of operations…” in project manual. There is no section in the project manual which refers to the demolition. Please advise if this will be provided or if the note is non-applicable.

31) Note is not applicable and should be deleted.

32 On Sheet D-0-03, General Demolition Note 8 prescribes temporary 1-hour-rated partition to be constructed between Phases I and II and maintained until substantial completion. There are areas within existing phase I that are scheduled for demolition, does this work require temporary partitions? If so, please provide construction details, partition locations and phasing information.

32) The existing partition separating Phase 1 and future Phase 2 is not fire rated. One of the first activities to be performed will be to provide a one hour rated partition on the occupied Phase 1 east elevation throughout in the same locations as the existing temporary partition. FR partition to remain in place until new Phase II building is fully sprinklered and protected.

Yes, all reconstruction/reconfiguration work within the occupied Phase 1 building will require temporary partitions for work zone separation/dust control. Phasing diagrams and temporary construction requirements to be developed with selected CM.

33 On Sheet D-0-03, General Demolition Note 8 prescribes temporary 1-hour-rated partition to be constructed between Phases I and II and maintained until substantial completion. The A0 series of drawings indicate a 2-hour construction partition between phases and further refer the reader to phasing diagrams. First, please indicate if construction partitions are to be rated as 1-hour, 2-hour or both (and indicate locations of each). Additionally, please provide phasing diagrams for demolition and temporary partition work.

33) See the response above to 32.

34 Section 02-300-3.4 refers to both Unclassified and Classified excavation. 34) Earthwork shall be bid as unclassified.

Please provide some guidance on which basis the earthwork pricing should follow.

35 Volume 1 ‘Table of Contents’ lists Specification Section 12494 – Roller Shades, however the actual section is not included in the volume. Please advice as to whether Roller Shades will be used on the project.

35) The section was previously provided to American Reprographics but is attached hereto as in file: 12494.pdf

36 Specification 15000 section 3.13 calls for the interior and exterior cleaning of all systems but does not provide a method of cleaning. Specification 15850 page 3.7 requires the ductwork to be protected at all times. Can you clarify the extent of duct cleaning required (supply, return, exhaust systems?) and the method of cleaning expected.

36) Exterior surfaces of installed work shall be cleaned of construction and other dirt to restore to original condition.

Interior cleaning requirements for piping is specified in respective sections. Ductwork must be protected during construction as specified under ductwork section. If construction dirt is found in air handling units, plenums, housings or interior of ductwork, it must be cleaned and restored to original condition by vacuuming, wipedown or other approved methods.

37 Specification 15100 does not indicate the materials required for underground sanitary or storm piping. Please provide a specification for these systems.

37) Material is to be as follows:

1. Cast Iron

a. Pipe: Hub and spigot pipe, service weight ASTM A74

b. Fittings: Hub and spigot fittings, service weight, ASTM A74

c. Joints: Neoprene rubber compression gaskets, ASTM C564.

38 Specification 15120 requires type “K” for the water distribution systems. Is type “L” acceptable? Type “L” copper is the industry standard for these systems.

38) Type K is required by the NIH Design Requirements Manual.

39 Specification 15260 section 1.5 requires technical qualification for High Purity Systems be submitted with the bid. Can this information be provided during the buy-out phase of the project after all pre-construction is complete?

39) No, because the bid amount needs to accommodate the cost of hiring qualified personnel, and the proper paperwork to justify the cost. The total cost of providing the high purity water system must be in the bid.

40 Regarding Specification 15510:

a) Is type “L” copper acceptable for the heating and chilled water systems on pipe sizes 2” and down?

b) Is standard weight steel acceptable for the heating and chilled water piping 12” and larger? Schedule 40 pipe is not

40) Piping materials and methods specified in this section are generally based on NIH requirements. Please follow the specifications.

“standard” wall thickness (per ASME) on pipe sizes 300mm and larger. Schedule 40 pipe is not readily available from Steel Mills above 250mm and is drastically more expensive because the product is never used.

c) Are grooved mechanical joint systems acceptable for any HVAC systems? Section 15120 allows the use of grooved system on domestic water piping 3” and larger.

41 Specification 15520 provides a spec for High Performance Butterfly valves for high pressure applications but does not provide a specification for butterfly valves in standard pressure applications. Please provide a spec for the standard butterfly valve.

41) All butterfly valves shall meet the requirements of high performance butterfly valves.

42 Please confirm that the technical proposal for the Controls Contractor required by section 15900 1.7 is not required during this phase of the project.

42) This proposal will be required prior to NIH accepting a Controls Contractor for the project.

43 From our analysis of the 1/29/10 GMP drawings we feel it is not clear if the existing temporary partition between phase 1 and phase 2 is fire rated.

Please advise if we are to replace this temporary partition with a fire rated partition. If new partition is required, please clarify the location of new barrier and the conflict between the 1 hr and 2hr rated references on the drawings.

43) See the response to 32 above.

44 Drawing C-3-02 - Is there an irrigation system at Ex MLP-6? Are all existing utilities within the LOD indicated on the drawings?
