About this file

This justification and approval document outlines a sole source procurement for proprietary equipment required for a federal construction project. The U.S. Navy is seeking to award a contract to construct a Weapons Generation Facility at Barksdale Air Force Base in Louisiana, with work including installation of six remote targeting engagement system towers. A pre-cast concrete mold developed by Sandia National Laboratories under government contract is required for the tower tops to interface with security systems. Forterra Pipe and Precast is the only qualified supplier that can provide sections made from this proprietary mold. The total cost for the six pre-cast tower tops is approximately $XXX,XXX, comprising a small portion of the overall $XX,XXX,XXX construction contract. The document argues this sole source procurement is justified as modifying the tower top design could impact security system integration and delay the facility's critical nuclear certification.

J&A No. N69450-22-0375

JUSTIFICATION AND APPROVAL

FOR USING OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

The agency is the U.S. Department of the Navy. The contracting activity is Naval Facilities Engineering Systems Command Southeast (NAVFAC SE). The contracting office is NAVFAC SE, Construction Contracting Division, Jacksonville, FL. The requiring activity is the Air Force Global Strike Command, Barksdale Air Force Base (AFB), LA.

2. Description of the Action Being Approved.

The action being approved is the use of brand name specification and a specified supplier source for pre-cast concrete for the top section of the pop-up Remote Targeting Engagement System (RTES) towers for the Weapons Generation Facility (WGF) military construction (MILCON) proiect at Barksdale AFB. The prescribed top section concrete mold was developed by Sandia National Laboratories under a Government contract. The only source available to procure the Sandia mold is Forterra Pipe and Precast, 4310 Pendleton Drive Rapid City, SD 57701, 605-718-4111. The Sandia mold is required for the pre-cast top section of the RTES tower to meet specifications for the tower cap and doors to be installed later by Sandia (under separate Government contract) for the Electronic Security System / RTES installation. All other sections of the RTES base and foundation are cast-in place (CIP) and built to specifications (not brand name or proprietary). Only the RTES tower top section, requires the Sandia mold available only from Forterra Pipe and Precast. The WGF construction contract is planned for FY23 and is being funded with Air Force MILCON funds.

3. Description of Supplies/Services.

This project is for the award of a building construction contract for a 28 Acre complex containing five newly constructed buildings that function as inter-related components. The hardened complex will be contained within three fence lines, secured and armed, and will house an 84,000 SF Weapons Generation Facility (WGF) as the primary facility; the other four support buildings to be constructed total an additional 16,000 SF.

Forterra Pipe and Precast is the only source available for the procurement of the necessary Sandia pre-cast mold for the top section of the RTES towers (6 units) of the WGF facility at Barksdale AFB. . The estimated cost for the top tower section is each tower. The total cost of six (6) pre-cast RTES tower tops is

. The estimated cost of the six RTES towers total, including CIP and precast elements is approximately . The construction contract for the Weapons Generation Facility total is making the six proprietary tower top sections of the total value of the construction contract overall.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority for this acquisition permitting other than full and open competition is 10 U.S.C.

3204(a)(1), “Only one source or limited sources, as implemented by FAR 6.302-1.

5. Rationale Justifying Use of Cited Authority.

Background: The Weapons Generation Facility (WGF) project at Barksdale Air Force Base (BAFB), LA is new Military Construction-Air Force (MCAF) project in support of a new mission for Air Force Global Strike Command (AFGSC). The 84,065 square-foot facility is primarily single story with a 9,658 square foot second story mechanical and electrical utilities support space.

The project includes construction of a primary facility, the Weapons Generation Facility, and supporting force protection facilities - an Entry Control Facility and an Alert Fire Team Facility. There are also two critical utility systems support buildings - a Diesel Generator Building, and a Fire Pump Building. The WGF for BAFB is a hardened, secure, multifunction bomber-specific facility, designed with a series of security and control features. The WGF will feature reinforced concrete to meet the security required for protecting nuclear-capable launch gear. The facility includes a large secure area meeting ICD/ICS 705 requirements and an unsecured portion that includes administrative offices, flight operations desk, conference rooms, and support spaces. The WGF facility supports the AFGSC mission through consolidated, secure weapons generation, nuclear-capable storage, and maintenance. It will also securely and efficiently support generation/operations functions.

Justification:

a) The final facility complex will include building elements (funded by MILCON) integrated with the Electronic Security Systems (ESS) and Remote Targeting Engagement Systems (RTES) (funded by Operations Equipment budget funds). While funded separately, both elements are required to interface seamlessly in order to provide the required protection for the complex and buildings. The RTES tower top pre-cast mold was funded by and developed for DoD, at a cost of approximately and several months of rework to obtain a working mold. The mold is government property. The top of the tower door hardware (Sandia installed) has been designed, built, and tested with concrete sections made from this mold. Sandia has an existing no cost contract with Forterra Pipe and Precast to store and maintain the mold.

b) The RTES towers (6) are strategically located within the WGF compound, and enable Security Forces to control unauthorized movement into the complex. The RTES towers are required in order to provide the required protection for the complex and buildings, and to obtain Nuclear Certification (NC) during design, at pre-operational occupancy and then ongoing throughout the life of the building use.

Specifically, these RTES Towers are an essential part of the four DoD Nuclear Weapon System Surety Standards as stated in DODD 3150.02 that provide positive measures to:

(1) Prevent nuclear weapons involved in accidents or incidents, or jettisoned weapons, from producing a nuclear yield;

(2) Prevent deliberate pre-arming, arming, launching, or releasing of nuclear weapons, except upon execution of emergency war orders or when directed by competent authority;

(3) Prevent inadvertent pre-arming, arming, launching, or releasing of nuclear weapons in all normal and credible abnormal environments; and,

(4) Ensure adequate security of nuclear weapons, as governed by DoDD 5210.41 (Reference (c))

c) The Forterra Pipe and Precast component is the only successfully tested and approved RTES tower top configuration that fully integrates with the approved RTES tower doors hardware. It is also a configuration approved by the Air Force Security Force Command (AFSFC) and AFGSC.

Impact: To develop a new pre-cast concrete mold and supplier would require additional funding and months of time to build and test the mold. After initial testing, a test fitting of the tower cap doors would be required a Diesel Generator Building, and a Fire Pump Building.

The testing is extensive and an alternate product could generate a need for repeat of tests and the risk of findings requiring corrections.

d) Without the use of the Forterra Pipe and Precast pre-cast RTES tower top section, the ability of Security Forces to protect the facilities within the WGF complex via RTES controlled features is compromised, if not eliminated.

e) The nuclear capable nature of the facility requires all essential building systems to receive Nuclear Certification (NC) during design, at pre-operational occupancy and then ongoing throughout the life of the building use. All elements of the RTES system (both MILCON provided and equipment funded) are essential building systems for nuclear certification. No RTES tower top other than the proprietary Forterra Pipe and Precast tower top component will satisfy the functionality requirements necessary for Nuclear Certification of the security in the new facility. Not achieving NC for the facility will prevent full utilization of the WGF by AFGSC which would fail the goals of the WGF project and limit the Air Force’s ability to the defend the nation.

Upon authorization of this action, the specifications will state “Notwithstanding any other provisions of this contract, no other product will be acceptable”.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The proposed action will be synopsized via a Government Point of Entry (GPE) as sole source procurement for proprietary equipment. A sources sought synopsis was not issued as only one manufacturer (Forterra Pipe and Precast) can provide the proprietary equipment (pre-cast RTES tower top) necessary to fulfill these requirements. In accordance with FAR Part 5.102 (a) (6) and FAR Part 6.305, Availability of the Justification (c), the approved justification will be posted with the solicitation.

7. Determination of Fair and Reasonable Cost.

NAVFAC SE will ensure that the price of the Sandia pre cast mold be s fair and reasonable pursuant to FAR Part 15. If necessary, the Government evaluation team will request cost and pricing data; use historical costs currently available for similar work on other contracts; compare the proposed price with the Independent Government Estimate (IGE); compare the contractor’s cost with competitive published price lists; and compare proposed prices received for prices of market research for similar items.

8. Actions to Remove Barriers to Future Competition.

Sandia will work to make the existing mold available for use by the construction contractor selected and that contractor will have the ability to choose a concrete supply company to make the top tower sections from the mold. This is a finite requirement for NAVFAC SE with no anticipated future needs and therefore no actions to increase future competition are warranted.
