0100000 – General Information Spec Item Title Description 1 General Information

1.1 Outline of Services Except where otherwise stated, the Contractor shall furnish all labor, supervision, management, tools, materials, equipment, facilities, transportation, incidental engineering, and other items necessary to provide the services outlined below and described in this Performance Work Statement (PWS) at the U.S. Naval Station, Guantanamo Bay (NSGB), Cuba by means of performance-based contract that is comprised of both Recurring Work and Non-Recurring Work Items.

The PWS is organized into annexes. Annex 1 is "General Information".

Annex 2 contains the on-site project management and administration requirements. Annexes 3 through 18 contain the technical requirements.

The annex numbers are identified as 1 through 18 in the description column, but the full expanded annex numbers include seven digits e.g., Annex 1 expanded number is 0100000 as shown in the header row at the top of this page.

1.2 Acquisition of

Additional Work

The Government reserves the right to acquire additional services at additional locations, within the scope of the annexes and areas included in Spec Item 1.1 Outline of Services, in addition to the services and locations identified in the requirements of this contract. Additional services will be incorporated into the contract in accordance with the CHANGES clause, SECTION I or ordered under the non-recurring work provisions of the contract. Items of work not covered by this contract but within the general intent are considered in the scope of this contract.

1.3 Background Information NSGB is located in the Oriente Province on the southeast corner of Cuba, the base is about 400 air miles from Miami, FL.

Tenant commands of the station include the U.S. Naval Hospital, detachments of the Personnel Support Activity, Naval Atlantic Meteorology and Oceanography Command, Naval Media Center, Naval Communications Station, Department of Defense Dependent Schools, Navy Brig, and Fleet and Industrial Supply Center (FISC), Det NSGB, Joint Task Force (JTF).

Directly supporting the base are offices of the Naval Criminal Investigative Service, Naval Facilities Engineering Comman (NAVFAC), Human Resources Office, Fleet and Family Support Center, Red Cross, and the Navy Exchange and Commissary.

NSGB Mission Pillars are:

Presence

- Maintain U.S. treaty obligations.

- Maintain a naval base for refueling ships.

- Maintain the fence line surrounding the base and the international shipping channel through Guantanamo Bay.

- Maintain a forward presence near the Windward Passage to the Caribbean.

Contingency Logistics

- Maintain port facilities, naval airfield and staging areas on the base in support of U.S. contingency operations in the Caribbean.

Logistic Support

- Provide logistic support to ships and aircraft conducting counter-drug operations in the Caribbean.

- Provide logistic support to Joint Task Force Operations in the Caribbean.

Migrant Operations

- Conduct steady state operations to accommodate up to 40 Migrants (100 with augmentation) at the base.

- To conduct contingency Migrant Ops for up to 400 migrants and to support migrant surge ops for up to 10,000 migrants.

1.4 Navy PBSA Approach The Navy’s approach to performance-based service acquisition (PBSA) includes four component parts which are 1) performance outcomes, 2) measurable standards, 3) consideration of incentives, and 4) performance assessment plan.

1.5 Standard Template Key to implementing the PBSA approach is using a standard template that ensures Navy-wide consistency yet affords appropriate tailoring to meet local needs. This contract conforms to the standard template and has been tailored for this solicitation. NAVFAC intends to use this template-based approach for future service contracts. Offerors shall develop an understanding of the template as part of performing due diligence in reaching an understanding of the Navy’s requirements and expectations.

The standard template contains 18 standard annexes. Annex 1 will always contain General Information that is relevant to the entire scope of the contract. Annex 2 contains Management and Administration requirements that are relevant to the entire scope of the contract. Annexes 3 through 18 and their associated sub-annexes contain the General Information, Management and Administration requirements, Performance Objectives, Related Information, and Performance Standards that are relevant to that technical annex. Except where otherwise stated, Annexes 3 through 18 and their associated sub-annex requirements are not relevant to one another. Within each technical annex and sub-annex, the organization of information and requirements are also standardized. Specification Item 1 will always contain General Information. Specification Item 2 will always contain the Management and Administrative requirements. Specification Item 3 will always contain the Recurring Work requirements.

Specification Item 4 will always contain the Non-Recurring Work requirements. Requirements and standards for higher level specification items apply to all subordinate specification items, e.g., Specification Item 3 standards apply to all recurring work specification items. Specification Item 3.1 is applicable to all 3.1 subordinate specification items.

Specification Items 3.2 and 3.3 are not considered subordinate to 3.1. All costs associated with Annexes 1 and 2 and Specification Items 1 and 2 shall be priced, and their price shall be allocated to the Exhibit Line Items..

1.6 Related Information There are four types of Related Information that can be found in the Description and Related Information columns of the specification as follows:

Informational Notes as used throughout this PWS provides additional information to offerors to be used in developing a thorough understanding of the work to be performed in this contract. Any block of text marked “Informational Notes” throughout Annexes 1 through 18 and their associated sub-annexes are subject to this disclaimer. Offerors may not rely upon the "Informational Notes" as material representations of the Government. Information provided in "Informational Notes" does not create a contractually binding requirement on either party to this contract.

Clarifying Information describes client expectations in a more detailed manner than the Performance Objective and Performance standard alone.

1.7 Verification of

Workload and Conditions

Throughout the PWS, the workload data is generally referred to as being located in Sections C and J. Section C provides data such as descriptions, specifications, and the statement of work. Section J provides data such as system descriptions, maps, floor plans, and tables to represent the type and location of services to be provided.

All facilities, systems, and assets identified in this contract shall be accepted by the Contractor in "AS-IS" condition. The Contractor is fully responsible for all work up to and including the limits of liabilities specified.

As prescribed in FAR 52.237-1, offerors or quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

1.8 Contractor’s Knowledge The Navy expects to receive insightful management from its contractors.

This management will include the knowledge, skills, authority and willingness to use contractor resources to find better ways of serving Navy clients’ strategic and operational goals and objectives. The Navy's use of performance-based objectives evidences this principle. Although performance work statements will typically contain several levels of performance assessment, the Navy wants its contractors to exercise maximum discretion within bounds of prudent risk management to adjust processes and resources needed to reach specified objectives at the highest performance level.

1.9 Technical Proposal

Certification

The Contractor warrants that its proposal incorporated herein by reference will meet or exceed the performance objectives set forth in this contract.

2.1 Definitions and

Acronyms

Definitions and Acronyms are listed in J-0200000-01.

2.2 General Information

2.2.1 Government Regular

Working Hours The Government's regular working hours are from 0730-1700, five days per week, Monday through Friday, except observed Federal holidays.

Exceptions to the regular hours of operation are detailed in subsequent sections of this PWS. Work in certain annexes or sub-annexes require Contractor continuous operations, 24 hours a day, every day of the year including holidays. Shifts shall be limited no more 10 hours per day and 60 hours per week for operations requiring 24 hour staffing. The performance of other work requirements shall be accomplished within the Government’s regular working hours unless the specific work requirement specified herein necessitates otherwise. Any other work outside Government regular working hours requires prior KO approval.

2.2.1.1 Observed Federal

Holidays

The Government observes the following holidays: New Year’s Day, Martin Luther King Jr.’s Birthday, President’s Day, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans’ Day, Thanksgiving Day, and Christmas Day.

2.2.1.2 Restriction to

Contractor Working Hours

The Government recognizes that, because of the isolation of the Naval Base and the added cost to house and feed a work force, there are mutual benefits in allowing contractors to work outside normal working hours.

For example, contractors often work six ten-hour days per week.

Contractor requests to work outside normal working hours, including blanket request, are often approved. However, the KO has full discretion to approve or disapprove, or withdraw approval of, request, and the work will be at no additional cost to the government. If the Contractor desires to work outside normal hours, a request shall be submitted to the KO.

a. The Contractor’s request must be made at least two days in advance (e.g., request received by Government by close of business Wednesday for work on following Saturday). Prior to submitting the request, the contractor must coordinate as needed (such as utility outages) and have all required people and materials for the work that will be performed.

b. A Contractor with quality or safety (including camp and material storage site) problems (as determined by the KO) will usually be restricted to normal working hours.

c. The Contractor shall schedule his work to cause the least amount of interference to normal activities. Conflicts, such as disturbing housing occupants after working hours, may be cause for limiting work to normal working hours. If the Contractor wishes to work outside of the Government's regular working hours for the Contractor’s convenience, the Contractor shall submit a written Request to Work Outside Government’s Regular Working Hours per Section F. Excludes work to be performed during specified hours. All contractor work performed from dusk until dawn shall be performed under contractor provided worksite lighting.

Handheld flash lights shall not be considered sufficient to accomplish appropriate lighting conditions.

2.2.2 Requirements

Hierarchy Requirements or definitions specified in each spec item of this contract apply to subordinate paragraphs. For example, requirements shown in spec item 3.1 would apply to spec items 3.1.1, 3.1.2, 3.1.2.1 and so on.

Likewise, Performance Standards specified at a lower digit level (i.e. spec item 3.1.1, 3.1.2, 3.1.2.1) apply when performance is assessed at a higher tier (i.e., spec item 3.1) based on the composite work requirements.

2.3 General Administrative

Requirements and NSGB Logistics Requirements

2.3.1 Required Conferences

and Meetings

The Contractor shall attend administrative and coordination meetings.

The Contractor shall provide sign-in sheets, prepare minutes of all meetings and submit per Section F for review and comments. Comments received within two working days shall be incorporated into the minutes and a copy of the final revision shall be submitted per Section F for concurrence. Historically, there have been meetings approximately once every two weeks and quarterly partnering meeting. The Contractor shall attend meetings as shown in J-0200000-02.

2.3.2 Training for

Maintenance and Operation of New and Replacement Systems and Equipment

When construction, renovation, or repair work is performed by means other than this contract, the Contractor shall attend Government provided training, as applicable, for maintenance and operation of new and replacement systems and equipment at no additional cost to the Government.

2.3.3 Partnering To increase the likelihood of successful performance of this contract, the Government requires cohesive partnerships with its Contractors and subcontractors. Key stakeholders, including the supported commands who will receive services, principal individuals from NAVFAC, the performance assessment team, and representative(s) of the installation(s) will be invited to participate in the partnering process. Key members of the prime and sub-contractor teams, including senior management personnel must participate. The partnership will draw on the strength of each organization in an effort to achieve quality contract services done right the first time, within the contract price, as scheduled, and without any safety mishaps.

Partnering should accomplish three goals:

- The first goal is to develop a cohesive team with common purpose, commitment and established communication processes.

- The second goal of partnering is contract specific, identifying risks and opportunities for the team to address.

- The third goal is to sustain the Partnership throughout the contract by identifying and addressing issues that affect the Partnership.

2.3.3.1 Formal Partnering The initial session should be scheduled concurrent with the Pre- Performance Conference and held no later than 30 days after award. The initial Partnering Meeting will be at least one day in duration and held Government provided facility as designated by the KO – OR – at a neutral location off the installation that is acceptable to the Contractor and to the Government. Follow-on sessions should be scheduled every three to six months and typically last a half day or less. The frequency, duration, and locations of follow-on sessions should be agreed to by both parties during the initial Partnering Meeting. The Contractor shall pay all costs

0200000 - Management and Administration Spec Item Title Description associated with the partnering effort including facilitator, meeting room, and other incidental items. Before the partnering session, the Contractor shall coordinate with the facilitator the requirements for incidental items (audio-visual equipment, computer(s), two easels, flipchart paper, colored markers, note paper, pens/pencils, colored flash cards, etc.) and have these items available at the partnering session. The Contractor will provide copies of any documents used for the Partnering Meeting for distribution to all attendees. The facilitator must be acceptable to both the Contractor and the Government. The participants shall pay their own costs for meals, lodging, and transportation associated with partnering.

2.3.3.2 Contract Partnering

Administration

Upon award, the ACO will contact the Contractor, supported command(s), Region, and Installation(s) stakeholders, and the performance assessment team to discuss implementation of partnering. Commence discussions with the Contractor to select a facilitator and location that are acceptable to both partners. A partnership agreement, The Charter, should be in place as early as possible so issues arising, even before work begins, can be resolved using the issues resolution process. Replacement of Core Management Team members (stakeholders who attended the initial session and manage the contract work day-to-day) is discouraged since it will disrupt the synergy that has been developed. If replacement of a team member proves to be unavoidable, a follow-on partnering session must be held to officially turn the responsibilities of the position over to the new member.

The Core Management Team consisting of the attendees below must be present during the initial and all follow-on partnering sessions. These are the core mandatory attendees. Other stakeholders may attend if they desire or as recommended by the partners.

2.3.3.3 Contract Partnering

2.3.4 Permits and Licenses The Contractor shall obtain all required permits, licenses, and authorizations to perform work under this contract and comply with all the applicable Federal laws and base regulations. The Contractor shall submit copies of Permits and Licenses per Section F. Permits required include but are not limited to:

Digging/Excavation Hot work Confined Space Landfill Personnel Licenses and Qualifications

Contractors should possess all necessary federal and state certifications, accreditations and licenses for the performance of asbestos abatement projects.

2.3.5 Insurance The Contractor shall submit a Certificate of Insurance per Section F as evidence of the existence of the following insurance coverage in amounts

0200000 - Management and Administration Spec Item Title Description not less than the amounts specified below and in accordance with the FAR Clause 52.228-5, INSURANCE – WORK ON A GOVERNMENT INSTALLATION and FAR Clause 52.228-3 The Defense Base Act (DBA). This insurance must be maintained during the performance period.

2.3.5.1 Certificate of Insurance The Certificate of Insurance shall provide for at least 30 calendar days’ written notice to the KO by the insurance company prior to cancellation or material change in policy coverage. Other requirements and information are contained in the aforementioned insurance clause.

2.3.5.2 Minimum Insurance

Amounts

The Contractor shall procure and maintain, during the entire period of performance under this contract, the following minimum insurance coverage:

Comprehensive General Liability: $500,000 per occurrence

Automobile Liability: $200,000 per person, $500,000 per occurrence, $20,000 per occurrence for property damage

Workmen's Compensation: As required by The Defense Base Act (DBA) and Federal worker's compensation & occupational disease statutes

Employer's Liability coverage: $100,000, except in states where worker's compensation may not be written by private carriers

2.3.6 Protection of

Government Property During execution of the work, the Contractor shall protect Government property. The Contractor shall return areas damaged as a result of negligence under this contract to their original condition at no cost to the Government.

2.3.7 Government

Information Technology (IT) System

The current Government IT System is a legacy system.

2.3.8 Directives, Instructions, and References

Department of Defense (DoD), Secretary of the Navy (SECNAV), Chief of Naval Operations (OPNAV), and other applicable Directives, Instructions, and References are listed in J-0200000-03. The Contractor shall comply with the most current version of directives, instructions, and references including versions published during the term of the contract.

2.3.9 Invoicing Procedures Refer to Section G for invoicing instructions. Refer to clause 5252.232- 9301 in the RFP for Invoicing Procedures Electronic (Feb 2009) and DFARS Clause 252.232-7003 titled “Electronic Submission of Payment Request”.

2.3.10 Forms Forms referenced in this Annex, e.g. accident reporting, and damage reporting are included among the Forms in J-0200000-04.

2.3.11 E-mail and Internet The Contractor shall have e-mail Internet service for their office on the base.

2.3.12 Ocean Freight The Contractor shall provide loading of freight and ocean freight, off-loading, and handling as required, based on the following:

a. Marine Insurance: The Contractor shall furnish Marine insurance, to the extent required.

(1) No ships or vessels may enter the Guantanamo Bay Defense Sea Area except as approved by Commander, U.S Naval Base, Guantanamo Bay, Cuba. Not less than 48 hours prior to departure of vessel from the port of embarkation, the Contractor shall furnish to the Contracting Officer the following information:

(a) Name of vessel.

(b) Place of registry and registry number.

(c) Name, nationality, and address of owner.

(d) Name, nationality and address of operator.

(e) Gross tonnage, length, beams, and draft of vessel.

(f) Nationality and numbers of officers and crew (include crew list).

(g) Number of passengers (include passenger list).

(h) Last port of call prior to entry into Guantanamo Bay Naval Defense Sea Area.

(i) Purpose of visit.

(j) Proposed date of entry and estimated duration of stay.

(2) Passengers and crew will be subject to Base regulations.

(3) Commercial vessels will be permitted to discharge cargo at cargo docks to the extent that space is available.

c. Vessels on Contract to Government

(1) Contract for scheduled every other week shipping services to and from Guantanamo Bay from Jacksonville, Florida, is provided by Schuyler Line Navigation Company LLC for 14 days sailing schedule between Jacksonville, Florida and Guantanamo Bay.

(2) Since these vessels are under Government contract, priority materials for Government agencies may delay receipt of Contractor’s equipment and materials. The cost of containerization, shipping, on loading, and off-loading, is at the Contractor’s expense; and arrangements shall be made directly with the shipping company. Lack of availability of Government contracted transportation will not excuse BOS contractor from material and equipment procurement for Recurring/ Non- Recurring work requirements. “Utilized space can be used be sold by the contractor”

(3) The ocean vessel Contractor is subject to change. If a change in Contractor should occur, the Government is not liable for any additional costs, which may be incurred by the Contractor.

(4) The contractor is under no obligation to use the Government carrier and may use others subject to the terms and conditions of this contract and U.S. Maritime law.

All vessels coming from a US port to a US port it shall have US flags.

EXCEPTIONS: SUBPART 247.5--OCEAN TRANSPORTATION BY

U.S.-FLAG VESSELS.

The contractor shall comply with DFARS 252.247-7023 Transportation of Supplies By Sea.

2.3.13 Contractor

Unaccompanied Employee Berthing - Extended Stay Berthing Facilities (ESBF)

Except for allowed fair market rental units (Family/Management Quarters) contractor employees (unaccompanied status) shall be berthing with the Housing Department, Navy Gateway Inns and Suites Division (NGIS) in ESBF located on both sides of the bay; Windward (WW) and Leeward

(LW).

ESBF:

ESBF primarily consists of multi occupancy rooms with either shared or gang head bathrooms. Due to the lack of berthing on Leeward, all females will be located on Windward.

Costs are based on occupied beds. The current rate is $10.00 per person per bed, regardless of room configurations. Rates are reviewed each March for implementation each October. Should prices increase, the contractor shall receive at a minimum 30 days’ notification. Bed night costs are not negotiable.

Contractors shall be billed monthly for the number of beds assigned to their company. Contractors are charged for beds assigned to employees on leave unless the employee removes all personal property and checks out of the facility. Contractors shall remit payment on or before due dates.

Administrative and late fees apply. Failure to promptly pay can result in eviction from the premises regardless of impact to Contractor ability to perform the contract specifications. Housing makes no guarantee of bed availability or berthing location.

Contractor employees shall not be allowed to grow Gardens in any berthing locations, Designated Contractor Facilities or Laydown areas.

Prior to the berthing of any employees, contractor shall be required to complete a Contractor Berthing Agreement with the NGIS. A copy of this agreement is available at the NGIS management offices located at building 1670. To determine availability, advance registration and notification of berthing requirements is highly recommended, send information via e-mailed to NGIS mail box at ngismail@usnbgtmo.navy.mil, allow 5-10 days for responses.

Utility Rates: In addition to the rates for berthing, the utility rate of $8.52 per day per person will apply, regardless of room configuration. Rates may be adjusted each Fiscal Year. This rate will be billed separately.

2.3.14 Contractor Family/

Management Quarters

For this contract, the Government will provide up to twenty-five (25) family housing units (based on availability) for the Contractor’s use.

These units are reserved for use by accompanied or unaccompanied management/supervisory personnel only. Housing will be assigned as follows: accompanied personnel by family composition with maximum family size of three (3) dependents; unaccompanied personnel assignment will be made based on a minimum of one person per bedroom. If house sharing, accompaniment by dependents will not be allowed. The government will provide family housing units with the following appliances: refrigerator, freezer, stove, dishwasher, microwave, washer, and dryer. All other furnishings other than listed appliances will be provided by the contractor. Issuances of these housing units and rental rates are controlled by the Housing Department, building 2295, phone 757-458-4432. Should the contractor’s assigned units not be fully occupied, the Housing Department will cancel the assignment and return the unit to inventory for other use. Personnel shall abide by all Family Housing instructions, which are not part of this contract but available upon request. Contractors will pay rent under the Fair Market Rental (FMR) Program. Rental rates include trash and maintenance costs. Rental rates are normally adjusted annually based on market appraisal, utilities cost adjustment and/or the annual Consumer Price Index. All family housing units are equipped with electric and water meters. Utilities cost is billed along with monthly rent and is based on established rates and actual consumption. All payments must be remitted via the Department of Treasury’s web portal www.pay.gov.

2.3.15 Transportation of

Personnel

Air travel to and from the base is limited, with demand often far in excess of supply. Rates and availability are subject to change the Government will not be liable for any price adjustments.

Kingstown, and Jamaica; is provided by the Air Mobility Command (AMC) at the contractor’s expense and passage will be in reserved seats.

(2) Emergency leave travel for verified personal emergencies such as death or serious illness of a family member will be authorized to any destination on the next available flight, also chargeable to the Contractor at the international tariff rate.

2.3.16 Food Facilities Contractor personnel may eat at the Navy Exchange food outlets, or at other food service facilities including the Naval Base Galleys on a cash basis at current prices.

2.3.17 Laundry and Dry

Cleaning

The Government will make available laundry and dry cleaning facilities for Contractor personnel and dependents of Contractor personnel at current rates as set forth by the Navy Exchange, Guantanamo Bay, Cuba.

2.3.18 Medical and Dental

Services

Medical and dental services available to the Contractor’s employees are limited in Guantanamo Bay. The Naval Hospital and Naval Dental Clinic are staffed to treat primary DOD personnel. The Contractor shall screen prospective employees with the objective to exclude those with admitted chronic disorders from traveling to Guantanamo Bay.The Contractor shall re-screened employees upon re-entry to Guantanamo Bay from leave (via a Government provided medical screening questionnaire) to determine exposure risk of communicable medical conditions such as but not limited to tuberculosis and report findings to Base Medical per Section F.

The Contractor also shall provide each Contractor employee with annual medical screenings to determine any chronic medical conditions that require treatment and report findings to Base Medical per Section F.

Contractor employee annual medical screenings will be required regardless of length of time of the medical screening from leave. Advise prospective employees of the limited medical and dental services available at Guantanamo Bay; and explain the Contractor’s policy concerning the extent of liability and coverage for required treatment. Every reasonable attempt shall be made to prevent personnel with chronic disorders, which may require treatment, such as cardiovascular defects, tuberculosis, mental health problems, and alcoholism, from being sent to Guantanamo Bay.

The Contractor shall provide and have available, both at the job site and in the berthing areas, first aid for minor and emergency treatment.

Government ground or air ambulance, medevac and medical care, when required, will be billed at the current rates when services are provided.

Any price increases and/or decreases applicable to medical/dental rates/costs will not be subject to economic price adjustment(s) and any increases and/or decreases to these areas of contractor overhead will not be considered and reimbursed pursuant to the changes and disputes clauses to this contract. 2.3.19 Post Exchange and

Commissary Privilege and Recreation

Post Exchange and commissary privileges and recreation facilities will be made available to authorized Contractor personnel and dependents of Contractor personnel in accordance with current base regulations.

2.3.20 Private Aircraft Prior to making shipment of cargo or personnel by private aircraft, the Contractor shall have on record with the Naval Air Station Operations

Officer a valid facilities license. Further, at least 8 working days prior to each such shipment, the Contractor shall notify the KO of his intentions so that appropriate area and flight clearances may be obtained.

2.3.21 Contractor Debts The Contractor shall be liable for debts to the Government incurred by their employees for personal services at Guantanamo Bay, Cuba, including but not limited to private telephone and cable service, medical and dental services, and W.T. Sampson School (DODEA Schools) expenses. If an employee departs the Guantanamo Bay Naval Base without liquidating their debts, sufficient funds to cover their type of obligation will be withheld from the Contractor payments until debts are paid.

The Contractor shall be liable for all debts to the government such as but not limited to utility charges, environmental waste, solid waste, site restoration and facility repairs.

2.3.22 Department of Defense

Education Activity (DODEA) Schools

The Contractor dependents may attend DODEA Schools on a cash reimbursable basis at the prevailing rates. Current rates for the school year are as follows:

2.4 Government-Furnished

Property and Services

In accordance with Section H, paragraph H.10 Govt-Furnished Property, and the following paragraphs, the Government will furnish or make available to the Contractor certain Government-owned facilities, utilities, equipment and services for use in connection with this contract as stated below.

The Government will furnish or make available to the Contractor certain Government-owned facilities and utilities for use in connection with this contract. The use of Government furnished facilities and utilities for other purposes is prohibited. All facilities, materials, and equipment will be provided in “as is” condition, and their use is at the option of the Contractor. If the facilities, materials, and equipment become unusable, or if the Contractor should choose not to use the government furnished facilities, materials, and equipment, the Contractor shall provide the item or items necessary to perform the requirements of this contract at no additional cost to the Government. A list of Government Furnished Property, Materials, and Services is provided in J-0200000-05.

2.4.1 Government-Furnished

Facilities (GFF)

The Government Furnished Facilities are listed in J-0200000-05 and technical Annexes/sub-Annexes for Government-Furnished Facilities. It shall be the Contractor’s option to use these facilities or not. The Contractor shall assume responsibility and accountability for the facilities he elects to use. The Contractor shall maintain all shops, material storage, buildings, structures, and all areas furnished for the performance of this contract in a clean, neat, orderly and sanitary condition. The Contractor shall provide janitorial, painting, maintenance, repairs, and related services. The Contractor shall properly dispose of refuse, waste material, garbage, rubbish, and debris daily.

If the Contractor wants to make any modifications or alterations to Government furnished facilities, he shall obtain written approval from the

Contracting Officer before beginning work. All modifications or alterations approved by the Government will be made at the expense of the Contractor. At the completion or termination of the contract, all facilities shall be returned to the Government in the same condition as received, except for reasonable wear and tear and for approved modifications or alterations performed. The Contractor shall be held responsible for the cost of any repairs caused by negligence or abuse, or by contractor employees.

2.4.2 Government-Furnished

Utilities

The Government will furnish water and electricity at existing outlets required for the work to be performed under the contract. The Contractor shall provide and maintain, at its expense, the necessary service lines from the existing Government outlets to the work site. Provide and maintain backflow prevention devices on connections to domestic water lines and electrical transformer provisions on connections to electric lines. Meet all Federal, State, local, and installation codes and regulations for backflow prevention devices and electrical transformer provisions. Services required by the Contractor, for which there are no available Government outlets, shall be provided by the Contractor at no cost to the Government.

The Contractor is responsible for the cost of all utilities at all Government-provided facilities and any additional Contractor-owned facilities, at prevailing Naval Station rates. The Contractor will be billed directly for all utilities provided to all Contractor occupied facilities. Utility rates billed to the Contractor will be at the following rates. The quantities will be estimated where meters are not provided based on UFC 3-401-05N.

1. Electrical - the current rate for electrical services is $365.62 MWH

2. Water - the current rate for water is $22.04 per KGAL

3. Wastewater (Sewage) - the current rate for sewage services is $3.57 per KGAL, based on 100% of the water consumption

Variations in Rates: Utility rates are subject to change. Changes in one or more utility rates shall not be basis for adjustment to the contract price or a claim unless the deviation from the quoted price for a utility rate exceeds 15%. When a utility rate varies by more than 15%, the contract price will be adjusted to reflect the amount the actual charge exceeds the rate quoted; however, the Government will only be liable for the amount of cost exceeding 15% of the rate quoted. For example, if a quoted rate increases by 16%, the Government will only be liable for 1% of the rate increase. Vice versa if the quoted rate decreases by 16%.

Historical data associated with contracts prior to this solicitation may present data that may not be representative of the requirements specified in this contract.

2.4.3 Government-Furnished

Materials (GFM)

Unless specifically stated otherwise in Section J of any annex or sub-annex, no GFM is provided in this contract.

2.4.4 Government-Furnished

Equipment (GFE)

The Government will not provide or furnish Equipment for this contract.

The contractor shall provide all equipment needed to get material to Naval Station Guantanamo Bay and to job site, place of performance or installed location to complete work requirements, including but not limited to cranes.

Government-furnished equipment includes Government equipment taken into the custody by the Contractor for repair when the unit acquisition cost

Individual components of Government equipment within larger systems contracted for repair or maintenance on a Government installation are considered units for purpose of this section only.

2.4.5 Availability of

Regular filling station pumps at the Navy Exchange Service Station may be utilized by paying the prevailing price at time of purchase.

Note: The Government does not provide low sulfur or ultra-low sulfur diesel fuel/oil. The only diesel fuel/oil that is provided is F76.

2.4.6 Availability of Docking

Services

In accordance with NAVSTA GTMO INSTRUCTION 4082.1A, Docking Services are available at the following rates:

2.5 Contractor-Furnished

Items

Except for items identified as Government Furnished, the Contractor shall provide all labor, supervision, management, tools, materials, equipment, facilities, transportation, incidental engineering, and other items necessary to perform the requirements of this contract. Lack of availability of labor, supervision, management, tools, materials, equipment, facilities, transportation, incidental engineering, or any other item necessary to perform the requirements of this contract shall not relieve the Contractor from the requirements to complete all work within the time limits specified herein. The KO may inspect Contractor-furnished items for adequacy and compliance with contract requirements. Inadequate or unsafe items shall be removed and replaced by the Contractor at no additional cost to the Government. Materials containing asbestos, lead, and polychlorinated biphenyls (PCBs) shall not be brought onsite. Energy efficient tools and equipment shall be used when available.
