About this file

This is a Use and Non-Disclosure Agreement (NDA) template for solicitation #N6817126QN067 related to USS ROSS (DDG 71). The agreement governs the handling of restricted technical data provided by the Government to contractors and prospective contractors submitting proposals.

Recipients of restricted technical data agree to use the information solely for proposal support purposes and may not disclose or release the data to third parties, subcontractors, or suppliers without express written permission from the Contracting Officer. Recipients must implement operating procedures and physical security measures to protect the data from unauthorized release. The agreement requires recipients to accept the data "as is" without warranties and prohibits access by any debarred, suspended, or ineligible individuals or those who have violated U.S. export control laws. Recipients must indemnify the Government against all claims and liabilities arising from misuse or unauthorized disclosure. Non-U.S. companies must submit to U.S. laws, regulations, and jurisdiction. Successful offerors may be required to sign an additional NDA and use data only as permitted under DFARS 252.227-7025, while unsuccessful offerors must destroy all copies of the documentation within 30 days of non-selection and provide a destruction statement to the Contracting Officer. The agreement remains effective from execution through notice of non-selection for solicitation #N6817126QN015, with obligations surviving termination. Enclosure 1 lists five restricted technical references relating to drainage systems, actuators, joiner doors, maintenance procedures, and equipment removal routes for the USS ROSS destroyer.
