Evaluation - Commercial Products and Commercial Services

FAR Clauses Incorporated by Full Text

52.212-2 Evaluation-Commercial Products and Commercial Services. (Deviation 2026-O0038) (Feb 2026)

Evaluation-Commercial Products and Commercial Services (Feb 2026) (Deviation 2026-O0038)

(a) Evaluation factors. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers:

(1) Technical with Past Performance Consideration:

The Government intends to award to the offeror, who has the lowest priced, technically acceptable proposal unless the Contracting Officer is aware of past performance information related to the lowest priced proposal offeror, which indicates that the proposal may not represent the best value to the Government. In that case, the Government reserves the right to consider the past performance of other offerors with technically acceptable proposals, and conduct a price, past performance tradeoff analysis, and award to an offeror that its proposal price is higher than the lowest priced proposal.

A technically acceptable proposal is one that provides pricing on every item specified in the solicitation and meets all requirements. If not priced accordingly, the Contracting Officer may find a proposal unacceptable. If so, the Contracting Officer or Ordering Officer will not consider proposals rated technically unacceptable further for award.

If further past performance evaluation is necessary, the Contracting Officer will evaluate past performance using systems and/or information available to the Government and rating of acceptable or unacceptable will be assigned.

The Government will review internal databases (i.e. Supplier Performance Risk System and SAM Responsibility and Qualifications) to evaluate the quoter's past performance. The Government reserves the right to use other sources of information, as deemed necessary.

One of two possible ratings will be assigned, Acceptable or Unacceptable. Acceptable means the Government has confidence that the Quoter will be able to successfully perform the effort described in the solicitation based on their record of successful performance. Unacceptable means the Government is not confident in the Quoter's ability to successfully perform the effort described in the solicitation based on a record of unsuccessful performance.

(2) Price:

An offeror's quoted pricing will be determined by adding the total for each CLIN in the provided Exhibit A. The Government will evaluate offers for award purposes summing the total price for the entire order.

The Government will evaluate pricing to determine the following:

1. Completeness: All price information/data required in the Solicitation has been submitted.

2. Reasonableness: Price is reasonable to the Government. Reasonableness will be determined by using the price analysis techniques outlined in FAR Part 12.

(b) . A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified inNotice of award the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
