Q4. In reference to specification section 23.16.2.12 (h) (i), (j), (k) do these paragraphs apply to AHU8 since we are only replacing the mixing box to this unit?
A4. AHU-8 shall be removed from (i), (j), and (k) from these sections. For (h), there may be some electrical work related to the mixing box that this could apply to.
(a) Contractor shall be responsible for providing any and all necessary electrical work, including but not limited to: any necessary fuses, larger wiring, conduit, breakers, disconnects, control wiring, sensors, etc. for the new condenser, air handler, and electric heat. Re-use of existing wiring is encouraged where possible and compliant with current codes with the exception of wiring located outdoors for condensers.
(b) Contractor shall provide minimum NEMA 3 outdoor rated electrical disconnect for the evaporator/air handler, to be located in close proximity to the air handler but not mounted to the unit. This applies to AHUs 7, 8, 9, 10, 11 and 12.
(c) Contractor shall provide new NEMA 3R outdoor rated disconnects for the condenser, to be located in close proximity to the condenser. Do not mount disconnect on unit. This applies to AHUs 7, 8, 9, 10, 11 and 12.
(d) Contractor shall replace all exterior conduit and wiring from existing main exterior junction box to condenser# 7, 8, 9, 10, 11, and 12. To include control conduit and wire.
Q5. Can you provide information on the exterior wall panel, specifically the manufacturers information on how to cut the wall panel properly for the enlarged louver size.
A5. It’s a Kal-wal panel. We don’t have any additional information. These panels have been cut for previous jobs without an issue.
Q6. How many systems can be taken out of service at any given time?
A6. All the units may be taken out of service to complete this project, provided Temp cooling has been put in place.
Q7. Will temporary heating or cooling be required?
A7. The Gov’t will provide temporary cooling for the affected units. The Gov’t must be given adequate notice of the Contractors plan (4 weeks minimum) to set up the temp cooling.
Q8. What electrical panel and its location will the new GFI outlets be tied into?
A8. The contractor may utilize the existing circuit on the roof to meet the requirements of Section 23.16.2 (l). The new circuit must be fully installed per code.
Q9. Please confirm that we are supplying electric heat for dehumidification only and not for winter heating of the occupied space.
A9. Yes. The electric heat is for dehumidification only.
Q10. If housekeeping pads are not existing will they be required for the new AHU’s?
A10. Housekeeping pads currently exist for all the existing units. If new units are larger than the existing size, the contractor shall be responsible for modifying the existing pad per SOW Section 23.16.2(f).
Q11. Can you provide the total static pressure that the existing AHU’s were designed for A11. Each unit was designed for 2-inch of static (AHU-8 was also 2-inch of static).
Q12. Will the existing pipe and conduit supports on the roof be reused?
A12. All pipe and conduit supports shall be new.
Q13. Can you please clarify the ductwork insulation scope. Are we insulating only the ductwork disturbed by the equipment replacement or are we replacing all of the insulation on all of the ductwork shown on the attached drawing M2?
A13. Ductwork Insulation shall be installed per SOW Sections 23.16.2.4 (e, f, g, and h).
Contractor shall insulate all ductwork that is disturbed during this work or installed new, as part of this project, and an additional ~480 square foot of damaged duct (miscellaneous locations) on the Supply/return ducts of these units.
Note, per SOW Section 23.16.1 (G), Attachment 10 is provided for information only.
Q14. There are shaded areas on the attached drawing M2 indicating the ductwork to be raised because of existing steel work. Is this part of the scope of work for this project?
A14. No this is not part of the SOW Note, per SOW Section 23.16.1 (G), Attachment 10 is provided for information only.
Q15. Should we include new refrigerant piping?
A15. Yes, all refrigerant piping shall be replaced with new piping. This is included in the demo from SOW Section 23.16.1(a).
Q16. Should we bid thermostats or BAS?
A16. See SOW Section 23.16 Section 3 thru 9. The equipment runs using a Direct Digital Control (DDC) system. All Inputs and outputs shall be wired to the existing DDC panel for each unit on the Roof following applicable code. Room thermostats already exist back to the DDC system.
Q17. Is there a specification for the manufacture of the equipment/units?
A17. The equipment/units shall be provided per the salient features listed in SOW Section 23.16.2.1.
The Gov’t has confirmed that Carrier makes equipment that meets the specs provided.
Q18. Would a week extension to the bid date be acceptable?
A18. No.
Q19. Page 90 section 23.8 DDC Scope of Work. Can you provide contact info for the Automated Logic representative?
A19. No. For Clarification, the contractor shall install and wire all new inputs and outputs, label wires, and run wires to the existing controller located on the roof near the existing AHUs. The Gov’t will terminate the wires in the program and program the DCC in-house. See SOW Section 23.16.3 thru 23.16.9.
Q20. Page 95 section 23.15 Fire protection devices. Can you provide the contact information for the building's fire alarm representative?
A20. No. The existing supply smoke duct dectector shall be replaced and wired new per SOW
23.16.4. This should be a match in kind to the existing one that is installed today.
Q21. Page 97 section Refrigerant systems. If sized correctly can any of the existing refrigerant piping be re-used? If not please confirm all refrigerant piping gets replaced.
A21. No. All refrigerant piping shall be replaced with new piping.
Q22. Page 97 section Refrigerant systems. What are the insulation requirements for the refrigerant piping?
A22. All cold refrigerant piping shall be insulated. Hot piping shall only be insulated for personal protection reasons, depending on the routing of the line sets.
All exterior insulation shall be jacketed for weather protection. (Internal may be jacketed).
Insulation is typically a 1-inch Flexible Elastomeric Pipe insulation.
Q23. Is there an air-balancing scope?
A23. There is no air-balancing scope with these units. However, the mixing boxes need to be sized correctly for the proper airflow required for each unit.

STATEMENT OF WORK
Division 01 – General Requirements
Section 01 11 00 – Summary of Work
1.2 SYNOPSIS: This Statement of Work (SOW) defines the requirement to remove and replace the existing
Bldg 77H Split Systems HP 7, 9, 10, 11 and 12. The new air-handling unit shall consist of installing one 10-ton split system and four 15-ton split systems with a minimum of 5-kilowatts (-KW) of electric heat. The new condenser units shall consist of a multi-stage condenser containing a minimum of two (2) separate independent refrigeration units. Additionally, the contractor shall install new outside-air louvers capable of supplying 100 percent outside air for economizing with associated mixing box and actuated return and outside-air dampers. The contractor shall provide a new controller, run conduit and wire, as required. The contractor shall also install new mixing boxes for HP 7, 8, 9, 10, 11 and 12. Upon completion of the work, the contractor shall deliver a full and complete operating cooling system that is to be fully controlled by the existing Automated Logic Direct Digital Control (DDC) System. The Contractor shall furnish all labor, material, tools, equipment, supplies, testing and supervision to perform this work as described in Section
1.3 SITE LOCATION: The work is located on Government-owned property at the Philadelphia Naval Business Center (PNBC), also known as the Philadelphia Navy Yard. The AHU work is located on top of the Control House inside of Naval Surface Warfare Center Philadelphia Division (NSWCPD) Bldg 77H having street address of 901 Admiral Peary Way, Philadelphia, PA 19112; the companion condensing units are located on the roof of NSWCPD Bldg 756, which is adjacent to and contiguous with Bldg 77H. Bldg 77H is an approximately 170,000 gross square foot industrial building with center high-bay and contains a mixed-use of personnel, warehouse, large-scale test facilities, and laboratory spaces. See SOW Attachment 1 for overall site location within PNBC.
1.4 GOVERNMENT TECHNICAL POINT OF CONTACT (TPOC): The TPOC is a representative of the
NSWCPD Contracting Officer and provides technical and administrative assistance related to the subject contract and work. All scheduling and coordination shall be through the NSWCPD TPOC.
Section 01 14 00 – Work Restrictions
1.5 GOVERNMENT FURNISHED UTILITIES: The Government shall furnish the following utility services for use as may be required for the work to be performed under the contract: electricity and potable water.
Government-furnished electricity may be used by the contractor unless contractor’s use adversely impacts a building’s electrical distribution system and equipment. Information concerning the location of existing outlets may be obtained from the NSWCPD TPOC. The Contractor shall provide and maintain the necessary service lines from existing Government outlets to the site of the work. For the utilities specified above, they shall be furnished at no cost to the Contractor. In the event that the Government is unable to provide the required types of utilities, the Contractor shall arrange for the required utilities.
1.6 PERMITS: The Contractor shall obtain all appointments, licenses, and permits required for the prosecution of the work. The Contractor shall comply with all applicable or relevant and appropriate federal, state, and local laws. Evidence of such permits and licenses shall be provided to the Contracting Officer or his/her representative before work commences.
1.7 INSTALLATION ACCESS, SECURITY, AND CONTRACTOR BADGES AND IDENTIFICATION
1.7.1 No employee or representative of the Contractor shall be admitted to the work site unless the employee has satisfactorily completed an installation-pass application (business/Contractor-employee) and has furnished satisfactory proof that the employee is a citizen of the United States.
The Government Security Office shall approve each installation-pass application before the employee or representative shall be authorized admittance to the work site by NSWCPD.
1.7.2 Contractor and subcontractor personnel shall carry photographic identification (ID) on their person at all times on-site for review by Government Security or Access Control Personnel (ACP) upon request. For each day on NSWCPD property, the contractor shall complete the current version of the NSWCPD COVID-19 Screening and Self-Assessment Questionnaire for each employee. If there are any “Yes” answers, the contractor shall contact the TPOC or the Contracting Officer.
1.7.3 Citizenship Requirements: Work under this contract is restricted to U.S. citizens. No employee or representative of the Contractor shall be admitted to the work site unless he/she furnishes satisfactory proof that he/she is a citizen of the United States. In accordance with current NSWCPD security protocol, contractor employees who hold dual citizenship shall not be granted security clearance to our facilities. Documents acceptable for Proof of Citizenship include:
1.7.3.1 Birth registration card.
1.7.3.2 Certificate of live birth, birth certificate.
1.7.3.3 Certificate of Naturalization.
1.7.3.4 Certificate of registration.
1.7.3.5 DD-214 (Shall Cite Birthplace).
1.7.3.6 DD Form 4 (Contract for Enlistment and Shall Cite Birthplace).
1.7.3.7 DD 1966 (Application for Enlistment).
1.7.3.8 Military discharge papers (shall cite birthplace).
1.7.3.9 Delayed birth certificate.
1.7.3.10 Hawaii certificate of foreign birth.
1.7.3.11 Hospital birth certificate.
1.7.3.12 Marriage license certificate.
1.7.3.13 Merchant marine certificate.

1.7.4 Application for Contractor Identification Badges: The Contractor's employees or representatives who shall be working inside NSWCPD facilities or secure perimeters shall obtain a Contractor's ID badge which can be valid for up to 12 months.
For all Contractor employees or representatives that do not have a CONFIDENTIAL or higher security clearance, the Contractor shall provide a completed SECNAV 5512/1 (DoN Local Population ID Card/Base Access Registration Form) for each employee or representative to the NSWCPD TPOC for CNRMA (Command Navy Region Mid-Atlantic) vetting, review and approval.
Once approved, the Contractor's employees shall report to Security (Building 29) with two forms of identification for issuance of the ID badge. The Contractor shall obtain the required employee ID badges from the Government. The ID badge shall be returned within 5 calendar days to Security (Building 29) when an employee leaves the Contractor's service, when the job is complete, or the ID badge has expired. The Government is not responsible for any cost or lost time associated with obtaining or the use of daily or Contractor ID badges.
One-Day Visitor Badges: The Contractor's employees or representatives can obtain a daily Visitor's badge from the Security desk inside NSWCPD facilities; however, a Government escort shall be required at all times, and the visitor badge shall only be valid for the facility where the badge was issued. The use of a daily visitor's ID badge is not recommended, as a Government escort shall be scheduled in advance and escort's availability is very limited and granted on a case-by-case basis (i.e., availability is minimal and not guaranteed). The Contractor's personnel would have to obtain daily passes, be subject to daily mandatory vehicle inspection, and would have limited access to the installation if using a Visitor badge. The Government is not responsible for any cost or lost time associated with escort availability in conjunction with the use of Visitor’s badges for the Contractor’s employees or representatives.
1.7.5 General Access Requirements and Restrictions: The following access requirements and restrictions apply to work at any NSWCPD facility or secured perimeter:
1.7.5.1 No employee or representative of the Contractor shall be admitted to the site of the work unless they have satisfactorily completed the Application for Contractor Identification Badge process and have furnished satisfactory proof that they are a citizen of the United States. The Government Security Office shall approve each base application form before the employee or representative shall be authorized admittance to the site of work by the Government.
1.7.5.2 The Contractor is responsible to collect and account for all identification badges issued to its personnel at the expiration of the contract, expiration of the badge or when no longer required. Collected badges shall be returned by the Contractor to the NSWCPD Security Office (Building 29).
1.7.5.3 Comply with all security regulations and policy currently in force by the Government Security Office having jurisdiction and as communicated directly by Government Security personnel or as conveyed by the NSWCPD TPOC.
1.7.5.4 Employees or representatives of the Contractor, while working at NSWCPD, shall display the Government issued badge over the front of their outer clothing at all times.
1.7.5.5 Roll up/garage doors shall only be permitted to be opened by Government personnel or Access Control Personnel (ACP). The ACP or Government personnel shall guard the door during the entire time the door is un-secured. The doors shall be secured immediately following its use, unless otherwise permitted by the Command Security Director.
1.7.5.6 Fence gates shall only be permitted to be opened by Government personnel or Access Control Personnel (ACP). The ACP or Government personnel shall guard the gate during the entire time the gate is un-secured. The gate shall be secured immediately following its use, unless otherwise permitted by the Command Security Director.
1.7.5.7 Commercial vehicles (with company logo) that are required to enter the fence line perimeter or enter the building at any NSWCPD facility shall be inspected by the Government Mobile Vehicle Inspection Team (MVIT) currently situated adjacent to Bldg 753 along Langley Avenue prior to entering the property. No personally-owned vehicles (POVs) are permitted within the fence line perimeter of any NSWCPD facility.
Coordinate vehicle inspections with the NSWCPD TPOC.
1.7.5.8 No Contractor or personally-owned cameras, including cell phones, are allowed inside NSWCPD facilities. If photographs are required for design or work records, submit a written request to the NSWCPD TPOC or Contracting Officer to have photographs taken by a Government Official using a Government camera. Photographs taken by the Government shall be reviewed by Security before release to the Contractor.
1.7.5.9 If a security alarm is required to be temporarily disabled for a work activity, the Contractor shall submit a completed Request to Mask Security Alarm form to the NSWCPD TPOC at least three business days in advance of the required date. The NSWCPD TPOC shall coordinate with the NSWCPD Security Office to obtain approval for the request.
1.8 IDENTIFICATION OF CONTRACTOR VEHICLES: The Contractor shall obtain parking passes for company vehicles, if required, from the Contracting Officer. The company name shall be displayed on each of the Contractor's vehicles in a manner and size that is clearly visible. All contractor vehicles shall display a valid state license plate and safety inspection sticker, if applicable, and shall be maintained in good repair and operating condition. See SOW Section 1.6.5.7 above about inspection of contractor commercial vehicles by the Government MVIT.
1.9 OPERATIONAL SECURITY (OPSEC): The Contractor shall protect critical information associated with this contract to prevent unauthorized disclosure. The NSWC Philadelphia Division's (NSWCPD) Critical Information List, (CIL) will be provided on site, if warranted. Performance under this contract requires the contractor to adhere to OPSEC requirements. The Contractor may not impose OPSEC requirements on its subcontractors unless NSWCPD approves the OPSEC requirements. During the period of this contract, the Contractor may be exposed to, use, or produce, NSWCPD Critical Information (CI) and/or observables and indicators which may lead to discovery of CI. NSWC PD's CI will not be distributed to unauthorized third parties, including foreign governments, or companies under Foreign Ownership, Control, or Influence
(FOCI).
CUI correspondence transmitted internally on the contractor's unclassified networks or information systems, and externally, shall be protected per NIST SP-800-171, Protecting Controlled Unclassified Information (CUI) in Non-federal Systems and Organizations. Assembled large components/systems being transported to and from testing areas, other production or government facilities (whether or not on public roadways) shall be in an enclosed van trailer or covered flatbed trailer. Component/System outside storage, staging, and test areas shall be shielded/obscured from public view wherever physically possible.
NSWCPD's CI shall not be publicized in corporate wide newsletters, trade magazines, displays, intranet pages or public facing websites. Media requests related to this project shall be directed to the PCO, and the COR who will forward the required to the NSWCPD Public Release Authority for review.
Any attempt by unauthorized third parties to solicit, obtain, photograph, or record, or; incidents of loss/compromise of government Classified or CI, Business Sensitive, Company Proprietary information related to this or other program must be immediately reported to the contractor's Facility Security Officer and Cognizant Security Office and/or the Naval Criminal Investigative Service, and the NSWC PD Security Division (Code 105.1). Questions concerning these requirements shall be directed to the Procuring Contracting Officer (PCO), and the Contracting Officer Representative (COR) who will forward the request to the NSWCPD Security Division (Code 105.1).
RECEIPT, STORAGE, AND GENERATION OF CONTROLLED UNCLASSIFIED INFORMATION
(CUI) All Controlled Unclassified Information (CUI) associated with this contract must follow the minimum marking requirements of DoDI 5200.48, Section 3, paragraph 3.4.a, and include the acronym "CUI" in the banner and footer of the document. In accordance with DoDI 5200.48, CUI must be safeguarded to prevent Unauthorized Disclosure (UD). CUI export controlled technical information or other scientific, technical, and engineering information must be marked with an export control warning as directed in DoDI 5230.24, DoDD 5230.25, and Part 250 of Title 32, CFR. Nonfederal information systems storing and processing CUI shall be protected per NIST SP-800-171, or subsequent revisions. All transmissions to personal email accounts (AOL, Yahoo, Hotmail, Comcast, etc.) and posting on social media websites (Facebook, Instagram, Twitter, LinkedIn, etc.) are prohibited. Destroy CUI associated with this contract by any of the following approved methods: A cross-cut shredder; a certified commercial destruction vendor; a central destruction facility;
incineration; chemical decomposition; pulverizing, disintegration; or methods approved for classified destruction.
Section 01 30 00 – Administrative Requirements
1.10 SUPERVISION AND CONTRACTOR PERSONNEL: The Contractor shall have at least one qualified supervisor, i.e., Project Superintendent, capable of reading, writing, and conversing fluently in the English language on the work site full-time during all working hours. The Project Superintendent shall have a minimum of 5 years experience with projects of similar size and scope. The Project Superintendent is primarily responsible for managing and coordinating day-to-day production and schedule adherence on the project and shall be on-site anytime work is being performed. The Project Superintendent shall attend (either remotely or in-person) all meetings associated with this project. The Contractor shall provide qualified personnel, mechanics, and subcontractors to perform all work. A minimum of two Contractor personnel are required to perform the functions of Project Superintendent, Site Safety and Health Officer (SSHO), and Contractor Quality Control System Manager (CQCSM); the latter two personnel responsibilities are described in the Subsections below:
1.10.1 Site Safety and Health Officer (SSHO): The contractor shall provide a Safety oversight team that includes a minimum of one (1) Competent Person at each project site to function as the Site Safety and Health Officer (SSHO). The SSHO shall visit the work site daily, unless specified differently in the contract, to perform safety and occupational health management, surveillance, inspections, and safety enforcement for the Contractor. The SSHO’s training, experience, and qualifications shall meet EM 385-1-1 paragraph 01.A.17 and all associated sub-paragraphs. The SSHO may serve as the Superintendent on this project.
1.10.2 Contractor Quality Control System Manager (CQCSM): Provide a CQCSM for the work site to manage and implement the Contractor Quality Control (CQC) program. The CQCSM shall be responsible for overall management of the Contractor Quality Control program and has the authority to act and give direction in all CQC matters for the Contractor. The CQCSM shall have been regularly engaged in work and repair projects of similar type, size, and complexity that has included the major trades executing the work of this contract. The CQCSM shall be familiar with the requirements of EM 385-1-1 and have experience in the areas of hazard identification, safety compliance, and sustainability. The CQCSM may serve as the SSHO on this project; however, the CQCSM cannot perform the duties of Project Superintendent.
Section 01 32 16.00 20 – Small Project Construction Project Schedules
1.11 PROJECT SCHEDULE: Prior to the start of work, the Contractor shall prepare and submit a work schedule to the NSWCPD TPOC. The schedule shall, at a minimum, show contract-award date, Notice-To-Proceed (NTP) date, work activities, submittals, material/equipment delivery, utility outages, on-site work, testing, closeout activities, and Contract Completion Date (CCD). The schedule shall be time scaled and generated using scheduling software. The schedule shall be kept current, i.e., updated and submitted regularly, during this contract, reflecting actual activity progress and plan for completing the remaining work.
1.12 EXECUTION OF WORK: The Contractor’s and subcontractor(’s) work shall be performed during normal duty hours from 0700 to 1600, Monday through Friday, as directed by the NSWCPD TPOC. No work shall be performed after normal duty hours or on Government holidays unless authorized by the NSWCPD TPOC in advance. All access shall be closely coordinated with the NSWCPD TPOC.
Section 01 33 10 – Submittal Procedures
1.13 SUBMITTALS: The Contractor shall submit the pre-work submittals of SOW Section 1.13 below within ten (10) calendar days after award. The Contracting Officer or NSWCPD TPOC may request submittals in addition to those specified when deemed necessary to describe adequately the work covered in the respective sections. Each submittal shall be legible, well-organized, complete, and in sufficient detail to allow ready determination of compliance with contract requirements. Government approval is required for submittals with a "G" designation; submittals not having a "G" designation are for information only “FIO.”
1.13.1 Submittal Procedures: Both “G” and “FIO” submittals shall be transmitted to NSWCPD using a formal Transmittal format. Provide submittals in electronic format, with the exception of material samples. Compile the electronic submittal file as a single, complete document, to include the ENG FORM 4025-R Transmittal Form available for download at:
https://www.publications.usace.army.mil/USACE-Publications/Engineer-Forms/. Note that all instances of the “US Army Corp of Engineers” on the transmittal form shall be interpreted as “Naval Surface Warfare Center Philadelphia Division.” Name the electronic submittal file according to its contents and its revision level (e.g., rev00, rev01, etc.) or submittal date. Use PDF as the electronic format, unless otherwise specified or directed by the NSWCPD TPOC or Contracting Officer.
Provide hard copies of submittals when requested by the Contracting Officer or NSWCPD TPOC.
Submittals requiring Government approval shall be scheduled and made prior to the acquisition of the material or equipment covered thereby.
1.14 PRE-WORK SUBMITTALS: All Submittals shall be approved by the NSWCPD TPOC prior to the start of work.
1.14.1 Pre-work submittals marked with a “G” require Government approval prior to the Contractor's mobilization to the work-site location.
1.14.2 Contractor’s Daily Production Report: See SOW Attachment 2. The Requirements are listed in Section 1.27 below.
1.14.3 Project Schedule - G: Prior to the start of work, the Contractor shall prepare and submit a work schedule to the NSWCPD TPOC per SOW Section 1.10 above.
1.14.4 Requirements for Contractor Lift Operations: See SOW Attachment 3. This shall be completed as required per Section 1.15.
1.14.5 Machinery and Mobile Equipment Checklist: See SOW Attachment 4. This shall be completed as required per Section 1.15 and Section 1.19.2.14.
1.14.6 Activity Hazard Analysis (AHA) - G: in accordance with EM 385-1-1. See SOW Attachment 5 for blank form and sample. See SOW Section 1.19.3 for additional information. The AHA shall cover all aspects of the work.
1.14.7 Accident Prevention Plan (APP) - G: The Contractor shall submit a site-specific APP to the NSWCPD TPOC. The site-specific APP shall outline the job-specific hazards associated with the project scope and reflect the Contractor’s overall safety and health program. At a minimum, the plan shall meet the requirements of the abbreviated Accident Prevention Plan identified in the U. S.
Army Corps of Engineers Safety and Health Requirements Engineering Manual, EM-385-1-1, Appendix A.
1.14.8 All Required Security Forms for Contractor ID, Vetting, and Badging – Prior to the start of work, the Contractor shall identify its personnel who will perform the work on-site and submit corresponding ID, vetting, and badging forms and supporting information. See Section 1.6 above, especially regarding SECNAV Form DD5512 (SOW Attachment 6).
1.14.9 List of proposed Subcontractors – FIO: Provide the NSWCPD TPOC a list of all proposed subcontractors including address, telephone number, point of personal contact, qualifications, and certifications for the completion of project tasks in this SOW.
1.14.10 The contractor shall provide licenses for all HVAC and Electric personnel who shall be working on this project.
1.14.11 List of proposed Products - G: Provide the NSWCPD TPOC a list of proposed Product cut sheets, manufacturer specification sheets, manufacturers installation guidelines, equipment cut sheets, fan curves, etc., and as applicable Safety Data Sheets (SDS) for all materials to be used in the performance of this project. All equipment shall be approved by the government TPOC prior to the start of work. Note that this overall, comprehensive list of proposed products is G; however, some individual items on this list of proposed products may be considered FIO by the NSWCPD TPOC.
1.14.12 Contractor Personnel Qualifications and Certification(s):
1.14.12.1 HVACR Technician - Prior to the start of work, provide Proof of Certification for the lead technician onsite that conforms with the Code of Federal Regulations Title 40, Chapter I, Subchapter C, Part 82, Subpart F. Certification is required for technicians performing repair, maintenance, service, and disposal of appliances containing ozone depleting refrigerant under Section 608 of the Clean Air Act. The Contractor shall provide HVAC technician certification.
1.15 ADDITIONAL SUBMITTALS: Contractor shall make other submittals as required in this Statement of
Work, in addition to the pre-work submittals of Section 1.13 above. In general, the additional submittals include material samples, material information or cuts sheets, Safety Data Sheets (SDS), contractor qualifications, technical manuals, test plans, etc. All submittals other than pre-work submittals shall be submitted by the Contractor a minimum of fourteen (14) calendar days before the start of the particular task or definable feature of work (DFOW) to which the submittal is associated to provide sufficient Government review-and-approval time. One additional submittal is listed below:
1.15.1 Warranty Information – G: Contractor shall submit warranty information guaranteeing all products and workmanship to be free of defects for a minimum of one year after acceptance.
Electric motors shall be free of defects in material and workmanship for a minimum of two years after acceptance.
1.16 CONTRACTOR REQUIREMENTS FOR LIFT OPERATIONS: Contractor shall comply with the requirements of Naval Facilities Command (NAVFAC) P-307, Weight Handling Program Management, and SOW Attachment 3, “Requirements for Contractor Lift Operations” for all work performed with cranes or other machines used to lift equipment or materials. Related to lift and weight-handling operations, contractor shall submit Machinery and Mobile Equipment Check List (SOW Attachment 4) if required.
Section 01 35 26 – Governmental Safety Requirements
1.17 DIRECTIVES: The Contractor and its employees shall comply with all referenced regulations, directives, and instructions. Applicable Department of Defense (DOD), Secretary of the Navy (SECNAV), Chief of Naval Operations (OPNAV), and other directives, instructions, and regulations are available from the Contracting Officer.
1.18 FIRE PROTECTION: The Contractor and its employees shall know where fire alarms are located and how to turn them on. The Contractor shall handle and store all combustible supplies, materials, waste, and trash in a manner that prevents fire or hazards to persons, facilities, and materials. Contractor employees operating critical equipment shall be trained to properly respond during a fire alarm or fire in accordance with activity instructions.
1.19 ENVIRONMENTAL PROTECTION: The Contractor shall comply with all federal, state, and local environmental protection laws, regulations, and standards. The Contractor shall coordinate all environmental protection matters with the Contracting Officer. The Activity Environmental Protection Coordinator or other authorized officials may inspect any of the facilities operated or maintained by the Contractor at any time and without prior notice. If a regulatory agency assesses a monetary fine against the Government for violations resulting from Contractor actions, the Contractor shall reimburse the Government for the amount of the fine and related costs. The Contractor shall clean up any oil or chemical spills resulting from its operations at its own expense. The Contractor shall not create a nuisance or hazard to the health of military or civilian personnel.
1.20 SAFETY REQUIREMENTS AND REPORTS
1.20.1 All work and equipment shall be performed and installed in accordance with local, state, federal, and industry codes, standards, and regulations.
1.20.2 All work shall be conducted in a safe manner and shall comply with all requirements of the U.S.
Army Corps of Engineers Safety and Health Requirements Manual, EM-385-1-1. The Contractor shall be responsible for instructing its employees in appropriate safety measures and shall not permit them to place machines and other equipment in traffic lanes or other locations in such a manner as to create safety hazards. The Contractor shall employ a competent person as defined in EM-385-1-1 to function as the Site Safety and Health Officer (SSHO). The following paragraphs denote minimum safety requirements. Contractor shall consult EM-385-1-1 for additional information or any safety issues not discussed in this specification.
1.20.2.1 Personal Protective Equipment Minimum Requirements
(a) Head Protection: All persons working in or visiting hard-hat areas shall be provided with and required to wear Type I or Type II, Class G meeting the requirements of ANSI Z89.1 Hardhat areas are those areas with potential hazard of head injury.
(b) Clothing: Employees shall wear clothing suitable for the weather and work conditions: the minimum for work sites shall be short sleeve shirt, long pants (excessively long or baggy pants are prohibited).
(c) Protective Footwear: Employees shall wear safety–toed boots meeting ANSI Z41 while working on work sites.
(d) Eye and Face Protection: All eye and face protection shall meet the requirements of ANSI/ASSE Z87.1, employees shall also use eye side protection.
(e) High visibility vests shall be worn when working around work equipment or when working on highways.
1.20.2.2 Display of Safety Information: Within one calendar day after commencement of work, erect a safety bulletin board at the job site. The following information shall be displayed on the safety bulletin board in clear view of the on-site work personnel, maintained current, and protected against the elements and unauthorized removal.
(a) Map denoting the route to the nearest emergency care facility.
(b) Emergency phone numbers.
(c) Copy of Activity Hazard Analysis (AHA).
(d) Occupational Safety and Health Administration (OSHA) 300A form. A copy of this form shall also be given to NSWCPD Safety department.
1.20.2.3 Emergency Medical Treatment: Contractor shall arrange for its own emergency medical treatment. The Government has no responsibility to provide emergency medical treatment.
1.20.2.4 Use of Hand and Power Tools: Hand and power tools shall be of a manufacturer listed by a nationally recognized testing laboratory for the specific application for which they shall be used.
(a) Use, inspection, and maintenance:
1.20.2.4.a.1 Hand and power tools shall be used, inspected, and maintained in accordance with the manufacturers’ instructions and recommendations and shall be used only for the purpose for which designed.
1.20.2.4.a.2 Hand and power tools shall be inspected, tested, and determined to be in safe operating condition before use. Continued periodic inspections shall be made to assure safe operating condition and proper maintenance.
1.20.2.4.a.3 Hand and power tools shall be in good repair and with all required safety devices installed and properly adjusted. Tools having defects that shall impair its strength or render them unsafe shall be removed from service.
1.20.2.4.a.4 Loose and frayed clothing, loose long hair and dangling jewelry (including dangling earrings, chains and wristwatches) shall not be worn while working with any power tools.
(b) Guarding—Power tools designed to accommodate guards shall be equipped with such guards:
1.20.2.4.b.1 All guards shall be functional.
1.20.2.4.b.2 Reciprocating, rotating, and moving parts of equipment shall be guarded if exposed to contact by employees or otherwise create a hazard.
1.20.2.5 Portable Extension Cords: Portable extension cords shall be sized in accordance with manufacturer ratings for the tool to be used and shall be protected from damage. All damaged extension cords shall be immediately removed from service. Portable extension cords shall meet the requirements of National Fire Protection Association (NFPA) 70 and shall contain GCFI in all runs (pigtails allowed).
1.20.2.6 Ladders: All portable ladders shall be of sufficient length and shall be placed so that workers shall not stretch or assume a hazardous position. The top or top step of a stepladder shall not be used as a step unless it has been designed to be so used by the manufacturer. Ladders may be used as work platforms only when use of small hand tools or handling of light material is involved.
1.20.2.7 Fall Protection: Fall protection shall be provided for safe access for all work activities as required. For confined space, fall protection shall be provided for safe access to enter, exit, and potentially emergently be removed from confined space per 29 CR 1910.146.
For above entries, a min of a tripod with winch extraction capabilities shall be used.
1.20.2.8 Lockout/Tag Out: Coordinate all control activities with the designated NSWCPD TPOC. Apply, monitor, and remove proper lockout and tag out devices per contractors established Lockout/Tag Out procedures and 29 CR 1910.147.
1.20.2.9 Asbestos Abatement: No asbestos based products shall be used on this project. If there is potential for activities to disturb ACM, an asbestos abatement plan shall be developed.
The plan shall be in accordance with 29 CFR 1910.1001; 29 CFR 1926.1101; and 40 CFR 61, Subpart M The written plan(s) shall be submitted for acceptance by TPOC and local Safety office before beginning work.
1.20.2.10 Lead Abatement: No lead Paint shall be used on this project. If there is potential for activities to generate unacceptable occupational exposure to LBP, a written lead compliance plan shall be written. The lead compliance plan shall be in accordance with 29 CFR 1910.1025 and 29 CFR 1926.62. The written plan(s) shall be submitted for acceptance by TPOC and local Safety office before beginning work.
1.20.2.11 Sanitation Requirements: Provide drinking water and toilets as needed for work personnel.
1.20.2.12 Fire Protection: Provide two ABC fire extinguishers at the work site to guard against potential fires.
1.20.2.13 Fuel-Powered Tools: When fuel-powered tools are used, they shall not be fueled while running, while hot, or near an open flame.
1.20.2.14 Machinery and Mobile Equipment: The Contractor shall complete an equipment checklist (SOW Attachment 4) for any work equipment (backhoes, lift trucks, bobcats) that shall be used on site.
1.20.3 Activity Hazard Analysis (AHA): The principle purpose of an AHA (SOW Attachment 5) is to reduce the overall risk of the hazards associated with the work. An AHA shall be developed by the Contractor for every operation involving a type of work presenting hazards not experienced in previous project operations or where a new work crew or subcontractor is to perform work. The analysis shall identify and evaluate hazards and outline the proposed methods and techniques for the safe completion of each phase of work. At a minimum, define activity being performed (can use the definable features of work). A definable feature of work (DFOW) is a task which is separate and distinct from other tasks, has the same control requirements and work crews, sequence of work, specific safety and health hazards anticipated (slip or trips, cuts, dust or chips in eyes), control measures (to include personal protective equipment) to eliminate or reduce each hazard to acceptable levels, equipment to be used (hand tools, backhoe), inspection requirements (list the inspection requirements for the activity to ensure the controls are working, and equipment is inspected to ensure proper operation), training requirements for all involved (any unique training required to make the established controls work), and the competent person in charge of that phase of work. The AHA shall be continuously reviewed and, when appropriate, modified to address changing site conditions or operations. The analysis shall be used during daily inspections to ensure the implementation and effectiveness of the activity’s safety and health controls. Activity Hazard Analysis shall be updated as necessary to provide an effective response to changing work conditions and activities.
1.20.4 Accident Reports and Notifications
1.20.4.1 Accident Reports: For recordable injuries, illnesses, and property damage accidents resulting in a least $2,000 in damages, the prime Contractor shall conduct an accident investigation to establish the root cause of the accident, complete the Navy Contractor Significant Incident Report (CSIR), and provide the report to the Contracting Officer within five calendar days of the accident. The Contracting Officer shall provide copies of any required or special forms.
1.20.4.2 Accident Notification: Notify the Contracting Officer as soon as practical, but no later than four hours after any accident meeting the definition of recordable injuries or illnesses, high visibility accidents, or property damage equal to or greater than $2,000.
Information shall include Contractor name, contract title, type of contract, name of activity, installation or location where accident occurred, date and time of accident, names of personnel injured, extent of property damage (if any), extent of injury (if known), and brief description of accident (to include type of work equipment used, Personal Protective Equipment (PPE) used, etc.). Preserve the conditions and evidence on the accident site until the Government investigation team arrives on site and Government investigation is conducted.
1.20.4.3 Definition of a Recordable Injury or Illness: Any work related injury or illness that results in:
(a) Death, regardless of the time between the injury and death, or the length of the illness;
(b) Days away from work;
(c) Restricted work;
(d) Transfer to another job;
(e) Medical treatment beyond first aid;
(f) Loss of consciousness;
(g) A significant injury or illness diagnosed by a physician or other licensed health care professional, even if it did not result as listed above.
1.20.5 The Contractor's workspace may be inspected periodically for OSHA and Navy violations.
Abatement of violations shall be the responsibility of the Contractor and/or the Government as determined by the Contracting Officer. The Contractor shall provide assistance to the Safety Office escort and the federal or state OSHA inspector if a complaint is filed. Any fines levied on the Contractor by federal or state OSHA offices due to safety/health violations shall be paid promptly.
1.20.6 If the Contractor fails or refuses to promptly comply with safety requirements, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop order shall be made the subject of claim for extension of time or for excess costs or damages to the Contractor.
1.20.7 The Contracting Officer shall investigate all complaints of unsafe or unhealthful working conditions received from Contractor's employees, federal civilian employees, or military personnel.
The Contracting Officer shall notify the Safety group of the results of such investigations.
1.21 HOT WORK: For all hot work, a hot-work permit is required and a permit shall be obtained through the
Government Fire Inspector. Requests for hot work permits shall be submitted to the NSWCPD TPOC with a 48-hour notice for review. Hot work in electrical- or mechanical-room space shall require a gas-free test prior to the Government fire inspector granting approval. In accordance with the Government fire inspector’s requirements, the Contractor shall perform this test daily. The Government fire inspector shall approve the instrument used. Fire extinguishers shall be provided by the Contractor at ALL locations where hot work or cutting is performed.
1.22 CONFINED SPACE: The Contractor shall comply with 29 CFR 1910.146 regarding permit-required confined space entry. The contractor shall provide a competent person to write all confined space permits.
