SOLICITATION AMENDMENT 1

The purpose of this amendment is to update the quantities required for Base Year, Option Year 1, Option Year 2, Option Year 3, and Option Year 4. As a result, attachment J-S-1 has been updated accordingly.

SOLICITATION AMENDMENT 2

Q&A

1. Question: RE: N6339421R0017_J-S-1_Pricing_Spreadsheet_Amendment+1, Page 136, “Volume I of the proposal shall include pricing spreadsheets for all CLINs, for all items (with options) as described in

Section B. Spreadsheets shall be in Microsoft Excel format with cells containing working formulas that are visible for Government examination of price buildup and methodology. All pricing shall be proposed in whole dollars.” The Solicitation states suppliers are to assume there is adequate price competition and cost and/or pricing data is not required in accordance with FAR 15.403-1(b). The referenced comment seems to be in opposition to this statement. Are suppliers required to provide working excel sheets, showing the price build-up and methodology of how each CLIN’s unit price was formulated? This seems to be very similar to the requirements of cost and/or pricing data. Can’t the Government determine price reasonableness by comparing each Supplier’s proposal?

Answer: Attachment J-S-1_Pricing_Spreadsheets is to be used as a template for offerors to fill in pricing information as described in Section B. As stated in section L.2.4, on page 136, “If after receipt of proposals, the Contracting Officer determines that adequate price competition does not exist in accordance with FAR 15.403-1 or that only one offer is received, the Offeror shall provide certified cost and/or pricing data as requested by the Contracting Officer.” Certified Cost and/or pricing data is not required. Cost and pricing data, other than certified cost and pricing data is required.

2. Question: RE: Page 137, Section L.2.5., Factor 2 Past Perf (b). RFP Statement – “Include with your proposal submission a copy of the PPQ Cover Sheet.” Will the Government please exclude such pages from the page count?

Answer: The PPQ Cover Sheet will not be included in Volume II Technical (Non-Price) page count.

3. Question: RE: Pages 63 & 64, Section C.9.0 & C.12.2. SOW 12.2 Military Specifications and Standards appears to be a repeat of SOW 9.0 Technical Data Rights. Recommending removal of 12.2 and revising 9.0 to incorporate the last statement in 12.2.

Answer: SOW Section C.9.0 has been updated and SOW Section C.12.2 has been deleted to remove duplicated language. As a result, SOW Section 12 references in CDRL A005 as well as Sections L&M have been updated accordingly.

4. Question: Due to the delay in TDP release, will the Government grant a 3 week extension from receipts of the TDP for final proposal submission? (SEPT 20. 2021 + 3 weeks)

Answer: The Government grants a two-week extension for final proposal submission from 20 September

2021 to 4 October 2021.

5. Question: RE: Page 137, Section L.2.5, Factor 2 Past Perf (d). RFP Statement: “While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.” Will the Government allow the entire CPARS documentation (consisting of multiple pages) to be included as an attachment to the Vol. II Technical (Non-

Price) Proposal and not included in the volume page count?

Answer: The CPARs documentation, which has been uploaded to CPARS, will not be included in Volume

II, Technical (Non-Price) page count.

6. Question: RE: Page 68 Section C.16.1. If an offeror chooses to include full tabloid-size screenshots of the

IMS as an attachment to the Volume II Technical, can they be excluded from the page count?

Answer: Figures and screenshots added as an attachment, will not be included in Volume II Technical

(Non-Price) page count.

7. Question: RE: Page 135, Section L.2.3. The disposition of Technical Data Package and Technical

Drawings paragraph states that Offerors should not transfer the data by any means to a third party.

a. Can an Offeror provide access to the TDP to its subcontractor’s with whom it is seeking quotes?

b. If an Offeror cannot provide the TDP to its subcontractors, does every subcontractor of every

Prime Offeror have to request a TDP CD from NSWWC PHD.

Answer: The Offeror can provide the TDP to subcontractors as long as the subcontractor has an active Joint

Certification Program (JCP) certification. Certifications are searchable on the following DLA site:

https://public.logisticsinformationservice.dla.mil/jcp/search.aspx

8. Question: Does the solicitation TDP take into account any current waivers, NORs, deviations or variances for the current production?

Answer: The TDP provided with the solicitation is the approved TDP for this procurement. The awardee can submit any applicable waivers, deviations or variances for review and approval by the Government during post-award.

9. Question: RE: Page 135, Section L.2.3. For any solicitation sections with “Offeror Fill-Ins” or request for other information or data, should Offeror include in the Volume I Price Proposal only the specific RFP page as filled-in or the complete Section containing such RFP pages as filled in?

Answer: Specific RFP page is acceptable as long as the RFP page and corresponding clause number is clear and visible in the proposal.

10. Question: RE: GFP ATT J-3 provided in PDF does not include all of the information in the Notes column.

Please clarify statements in the Notes section for each listed item.

Answer: Attachment J-3 GFP Attachments has been updated to fully show the notes.

11. Question: RE: Pages 4-58 Section B, Pages 85-86 Section E, Pages 90-99 Section F. Section B, Section E and Section F list “Destination” as FOB, INSPECT AT and ACCEPT AT. Request all to be updated to be

ORIGIN.

Answer: The Government’s requirement is to deliver with FOB Destination terms. However, inspection and acceptance with be at origin and performed by DCMA. Inspection and Acceptance information will be updated upon award based on Contractor’s place of performance.

12. Question: RE: Page 64 Section C.12.2. SOW para 12.2 (Technical Data Rights) states “The Contractor shall prepare the updated drawings, specifications and all related documents with revisions, including the

RFV.” There is also a clause C-243-H003.c that seems to align to this language. Is the Contractor expected to generate NORs and ECPs for this Build to Print contract?

Answer: No, the contractor will not be expected to generate NORs or ECPs. The contract is build-to-print.

If NORs or ECPs are required, the Government will provide them.

13. Question: Is this project considered a new requirement? If this project is not considered a new requirements, who is the incumbent? What was the contract number?

Answer: Yes, this solicitation is considered a new requirement.

14. Question: RE: TDP-MOD 18. 8652182-9 is required by the VLS LCU MOD 18 console as well as the

MOD 15 and 18 kits however the provided TDP did not contain a DWG or PL for this assembly. Please provide missing files.

Answer: The Government will provide P/N 8652182-9 as Government Furnished Equipment (GFE), if needed.

15. Question: RE: TDP – MOD 17 & 18. A revision comparison between the provided MOD 17 and MOD 18

TDP folders resulted in 17 revision differences. The below table outlines these differences (revisions are base + NOR # if applicable). Are contractors expected to maintain the down revs of MOD 17 or are we expected to use the highest REV provided for both MODs?

Answer: Offerors are to use the latest MOD version.

SOLICITATION AMENDMENT 3

Q&A

1. Question: Offeror respectfully requests a thirty (30) day proposal due date extension during which time we hope to acquire the current missing documents, evaluate them and prepare a fully compliant proposal in response to the subject solicitation.

Answer: The proposal due date is extended to 11 October 2021 via solicitation amendment 3

2. Question: Will the gov’t extend the deadline by 2 weeks as our proposal preparation team fully researches technical solution and cost?

Answer: The proposal due date is extended to 11 October 2021 via solicitation amendment 3

3. Question: Our interpretation of the CLIN structure is that the government expects offeror to have the First

Article ready 40 weeks after award. Would the government discuss the time line to need date?

a. Our manufacturing engineers anticipate needing more than 40 weeks to be ready for FAI.

Answer: The first unit is expected to be ready for FAI 52 weeks after award. Section F’s delivery schedule has been updated to reflect this change.

4. Question: Since the incumbent no longer has to address NRE, how does the government want bidders to address NRE?

a. Perhaps amortized in the first CLIN?

b. Accounted for across the initial award year (not option years)?

Answer: This is a firm-fixed-price contract for LCU and associated component kits. The Government will not have a CLIN for NRE.

5. Question: In addition to the test equipment provided as GFE, will the government provide the test procedures as GFI?

Answer: Test procedures are included in the TDPs.

6. Question: Will the government confirm our interpretation of pricing in the 27 Jan 2020 award to the incumbent for Mk 235 Mod 11, part number 7104280-119, and Mk 235 Mod 12, part number 7104280-

129? The government’s answer will be important in helping bidder determine if our offer will be competitive.

Answer: The Government does not have authorization to disclose unit pricing on a different contract.

7. Question: Please advise on the following 12 documents not found in the TDP

8. Question: RE: AMD 0002 Question# 15. Offeror requests a proposal submission extension of a minimum of three weeks from the current due date of 10/4/2021. Our request is due to clarified TDP data not received as of 9/9/2021. The USG response to question 15 was to use the latest MOD versions which would mean the NORs provided with MOD 18 should also be applied to MOD 17. These TDP updates will need to be incorporated into our MOD 17 LCU pricing BOMs and quotes sent out for updated materials.

NOR001 of 8652400 alone has high dollar impact changes to the MOD 17 LCU with various BOM changes such as the 8652407-9 to -19 CCA assembly swap, the addition of multiple cables assemblies, and various qty updates. We are requesting an extension to be able to thoroughly analyze the TDP for these updates and obtain quoted pricing to ensure a compliant proposal submission.

Answer: The proposal due date is extended to 11 October 2021 via solicitation amendment 3.

9. Question: RE: AMD 0002 Question# 11. Please provide further clarification regarding FOB (destination).

Is it the Government's intent for the supplier to price shipping, risk of loss, and title transfer at Destination?

Or is it the Government's intent to use FOB (origin) for inspection acceptance and transfer of title with the

Government responsible for any shipping costs-risk of loss?

Offeror renews request to have shipping terms defined as FOB (origin) (shipping point).

Answer: It is the Government's intent for the supplier to price shipping, risk of loss, and title transfer at

Destination.

10. Question: Please provide clarification on PN 8652182-9 as GFE. Is it the Government's intent to provide as

Government Furnished Material (GFM) and integrate into all LCUs and Spares Kits? Please update Attachment J-3 accordingly, whether determined to be GFE or GFM.

Answer: P/N 8652182-9 will be provided as GFE. Attachment J-3 has been updated accordingly.

SOLICITATION AMENDMENT 4

Q&A

1. Question: Can the Government provide the audit excel files or the indentured parts list text files that include quantities columns?

Answer: The TDP determines the BOM. The Government does not have a separate BOM and one will not be provided.

2. Question: Re: TDP/Attachment 1. In reviewing the TDP, we found what we believe may be some discrepancies between the parts lists provided in the TDP folder and attachment J-1. There seem to be extra parts (a CCA and 28 cables) in the INCO and DEPOT list in J-1.

Answer: The CCAs and 28 cables are not applicable to the LCU, please disregard. The Government’s response and resolution are found in the last two columns of the following table:

3. Question: Re: Exhibit_(A)_CDRLS. According to L-215-H004(a), The Offeror shall complete the “Price

Group” (Block 17) and “Estimated Total Price” (Block 18) of each data item on the Contract Data

Requirements List (CDRL). In Exhibit A, “N/A” has been entered into the “Estimated Total Price”. Is the

Offeror supposed to override the “N/A” in Block 18 with a price in Exhibit A, as well as enter the “Price

Group” in Block 17?

Answer: Exhibit_(A)_CDRL, block 18 with “N/A” was deleted to allow offerors to fill in the appropriate information in accordance with L-215-H004.

4. Question: Re: Solicitation Amendment 3, Question #1. Bid submissions are currently due 11 October 2021.

This is a Federal Holiday. Please confirm due date of 11 October 2021 and that the Government intends on confirming receipt of Bid submittals same day despite the Holiday? Or will the Bid Submission date be extended?

Answer: The proposal submissions have been updated to 12 October 2021 via amendment 4.

5. Question: The Government has confirmed that deliveries are FOB (Destination). Based on Section L 3.0, the Price factor is to be evaluated by “only a price analysis to the extent it is required, in accordance with

FAR 15.404-1(b)(1)." How does the Government intend to evaluate and account for the price variations due to each Bidder’s variable shipment/insurance costs from the Bidder’s place of shipment to Government

Destination point?

Answer: The evaluation methodology for Factor 1 Total Evaluated Price is specified in Section M 3.0.

Adjustments will not be made to account for the various shipping costs offerors may encounter.

SOLICITATION AMENDMENT 5

The purpose of this amendment is to extend the solicitation’s closing date to allow additional questions submitted by industry.

Section B - Supplies or Services and Prices

NOTE A

Stepladder Pricing. Stepladder pricing is utilized in this solicitation to provide Offerors an opportunity to propose different pricing for separate quantity ranges within applicable Contract Line Items (CLINs). Price evaluation of step ladder CLINs will utilize a randomly selected quantity. Notwithstanding the option to propose different unit pricing for different quantities, the Offeror may propose the same unit price for all quantities.

For all option CLINs with stepladder pricing, the Government may unilaterally exercise a given line item more than once. Option CLINs with stepladder pricing may be exercised until the total quantity purchased equals the maximum quantity listed for that option CLIN in Section B.
