About this file
This document is an Attachment J-9 containing Answers to Request for Clarifications No. 01 - 03 for a federal contract opportunity involving naval vessel maintenance. The document addresses three key clarification questions from potential contractors. First, contractors are permitted to propose an alternative (shifted) Period of Performance (PoP) if drydock availability constraints prevent meeting the original timeline, provided they clearly justify the proposed changes. Second, the government clarified the definition of "Contractor Facility", confirming that facilities leased by the contractor and facilities of subcontractors are acceptable, but facilities owned only by the prime contractor are not. Lastly, the government noted that they are self-insured and do not carry commercial Protection and Indemnity (P&I) insurance coverage.

Attachment J-9: Answers to Request for Clarifications No. 01 - 03
QUESTION NO.1:
SPECIFICATION ITEM NO.: N/A
TITLE: Proposing Shifted Period of Performance (PoP) with planning docking period.
In planning docking period during required PoP, currently it might be difficult for us to keep our drydock availability along required PoP. In such case, is it acceptable that contractor submit proposal with PoP shifted along our drydock availability?
ANSWER NO.1:
Contractors may propose an alternative (shifted) POP if they are unable to meet the required PoP due to drydock availability constraints. However, the proposed PoP shift must be clearly justified in the proposal, including an explanation of the scheduling limitations and the proposed new timeline. The Government will review and evaluate such proposals for acceptability based on operational requirements and overall project schedule impacts.
QUESTION NO.2:
SPECIFICATION ITEM NO.: N/A
TITLE: Contractor’s Facility
What is the definition of 'Contractor Facility'? The term, 'Contractor Facility' can be interpreted broadly.
Please confirm whether the following situations fall under the category of 'Contractor Facility.'
a. Facility leased by the Contractor → Yes or No
The Government’s answer is Yes
b. Facility of a subcontractor under contract with the Contractor -> Yes or No
The Government’s answer is Yes
c. Facility owned by the Prime Contractor only-> Yes or No
The Government’s answer is No
ANSWER NO.2:
The Government does not prescribe a specific shipyard arrangement. The offeror may perform the availability at a subcontracted facility (sub shipyard) provided that all requirements of the solicitation are fully met, including quality, schedule, security, and inspection requirements. The prime contractor remains responsible for ensuring compliance with all contract terms and for managing any subcontracted work accordingly.
QUESTION NO.3:
SPECIFICATION ITEM NO.: N/A
TITLE: Protection and Indemnity
Could you please advise us on the vessel's P&I (Protection and Indemnity) insurance?
ANSWER NO.3:
The U.S. Government is self-insured and, therefore, does not carry commercial P&I insurance coverage.
