Section M - Evaluation Factors for Award

Addendum to 52.212-2 Evaluation--Commercial Products and Commercial Services

(a) The Government will award a single firm-fixed-price (FFP) contract to the responsible offeror providing the best value, utilizing a tradeoff source selection process. This acquisition is conducted in accordance with FAR Part 12.

The Government intends to award a contract without discussions with quoters. Accordingly, each quoter should submit its most favorable terms from a price and non-price standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government reserves the right to award a contract to other than the lowest priced proposal if it is in the best interest of the Government.

The Government will first verify that the offeror is a certified Service-Disabled Veteran-Owned Small Business (SDVOSB). If the offeror is confirmed as a certified SDVOSB, the Government will then evaluate the proposal based on the factors outlined below. Proposals from offerors not certified as an SDVOSB will not be evaluated.

The following factors shall be used to evaluate offers:

Factor 1: Technical Capability

The offeror's technical proposal will be evaluated to assess its understanding of and approach to meeting the requirements outlined in the Performance Work Statement (PWS). The Government will evaluate technical based on how well the proposed products or services meet the Government's requirements.

A single, combined technical/risk rating will be assigned for the Technical Capability factor using the adjectival ratings (Outstanding, Good, Acceptable, Marginal, and Unacceptable) and associated risk assessments as defined in the DoD Source Selection Procedures. To be considered for award, a proposal must receive an overall rating of "Acceptable" or higher for the Technical Capability factor.

The Government will evaluate each offeror's proposed use of subcontractors for compliance with FAR 52.219-14, Limitations on Subcontracting.

Proposals failing to comply with this clause will be deemed unacceptable.

Factor 2: Past Performance

The Government will evaluate the offeror's past performance to assess the Government's confidence in the offeror's ability to successfully perform the required effort. This evaluation will consider the recency and relevancy of the offeror's past contracts for similar services.

The Government will consider information from various sources, including the Contractor Performance Assessment Reporting System (CPARS), Supplier Performance Risk System (SPRS), and other sources available to the Government.

A Performance Confidence Assessment rating will be assigned based on the offeror's demonstrated record of contract compliance, quality of service, and adherence to cost and schedule. The ratings are: Substantial Confidence, Satisfactory Confidence, Limited Confidence, No Confidence, and Neutral Confidence.

The past performance of proposed major subcontractors and teaming partners is permitted and will be evaluated. The offeror must clearly describe the role and the percentage/scope of work performed by each entity (prime, subcontractor, or team member) for each past performance reference submitted.

Factor 3: Price

The quoted price will be evaluated on the basis of price reasonableness. The total evaluated price will be the sum of the proposed prices for all contract line items (CLINs) for the base period and all option periods. Although the Technical Capability and Past Performance factors are more significant, price remains a key consideration. The Government reserves the right to award to a higher-priced offeror if the technical and/or past performance advantages are deemed to be worth the additional cost.

(b) . The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the Options (if applicable) basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. The evaluation of options does not obligate the Government to exercise the option(s).

(c) Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
