This is an Amendment 03 to an Announcement of Opportunity (AOI) for Other Transaction Agreement (OTA) N6247326R0072 at MCB Camp Pendleton, providing responses to Requests for Information (RFIs) #29-49 and revising the Award Objective section.

The solicitation seeks vendors to design, manufacture, and construct 10 Bachelor Enlisted Quarters (BEQs) buildings totaling approximately 655,957 square feet through industrialized construction methodologies. The project consists of three building groups: four BEQs in Area 24 accommodating 802 occupants (253,382 SF maximum), three BEQs in Area 13 accommodating 552 occupants (174,470 SF maximum), and three BEQs in Area 41 accommodating 722 occupants (228,105 SF maximum). All construction involves repair by replacement including demolition of existing facilities. The government anticipates shortlisting approximately 5-7 vendors with a design schedule of 9 months and construction completion within 2 years. Foreign-incorporated companies properly registered in SAM.gov may participate subject to Revolutionary FAR Overhaul (RFO) Part 40.202 prohibitions. The project is subject to Buy American Act requirements per RFO Part 25.2, with the government utilizing maximum statutory flexibility for waivers and exemptions; vendors shortlisted to Phase 2 may submit pre-award determinations requests. Projects demonstrating beneficial occupancy or operational status will be considered complete for relevant experience evaluation. The white paper response deadline is 1400 EST on October 1, 2026, with the RFI cut-off date of 1200 EST on September 21, 2026. The government will provide an IC design-standard room layout based on separate government evaluation of 2+0 concepts, requiring awardees to adapt designs per International Building Code, Unified Facilities Criteria, and project-specific requirements while allowing vendor flexibility in module geometries and manufacturing methodologies.

Requests for Information (RFI) Responses #29-49

29. Is a company incorporated outside the United States, but properly registered in

SAM.gov and otherwise meeting the AOI qualification requirements, eligible to submit a White Paper and participate directly as an Offeror/Awardee under this

OTA?

A: A company incorporated outside the United States may be eligible to submit a White Paper and participate directly in this OTA to the extent it is not prohibited under Revolutionary FAR Overhaul (RFO) Part 40.202, Prohibitions and Clause 52.240-91, Security Prohibitions and Exclusions.

These prohibitions are statutorily based and therefore apply to Other

Transaction Agreements.

30. For purposes of the Buy American requirements applicable to this AOI, would volumetric modular building units manufactured outside the United States, including in a DoD qualifying country, be eligible for incorporation into the project?

A: As stated in the Phase I-AOI, this OTA is subject to the Buy American Act and as such, will follow the statutory regulation requirements that can be found at RFO Part 25.2, Buy American – Construction Materials. The

Government intends to utilize the maximum statutory flexibility allowed under the law to grant waivers and exemptions. Vendors shortlisted to participate in Phase 2-RPP may submit requests for Pre-award

Determinations pursuant to the Buy American Act statutory regulation requirements that can be found at RFO Part 25.203 after the Phase 2-RPP has been released to the down-selected offerors and prior to submission of proposals. Post-award determinations may be made pursuant to RFO Part

25.205, but if the Agreements Officer concludes that the vendor should have made the request before agreement award, the Agreements Officer may deny the request. The Government will not evaluate requests for determinations until after the release of the Phase 2-RPP.

31. Alternatively, does the Government require the modular building units themselves to be manufactured in the United States?

A: See response to RFI 30.

32. If foreign-manufactured modular units may be permitted under any applicable exception, waiver, qualifying-country treatment, or other provision, we would appreciate clarification on the applicable conditions.

A: See response to RFI 30.

33. If the completed volumetric modular units are required to be manufactured in the United States, may components or subassemblies manufactured outside the

United States, including in a DoD qualifying country, be incorporated into those

U.S.-manufactured modular units, subject to the applicable domestic-content requirements? If so, we would also appreciate clarification on how the domestic-content calculation would be applied to a volumetric modular unit.

A: As stated in the AOI, this OTA is subject to the Buy American Act and as such, will follow the statutory regulation requirements that can be found at

RFO Part 25.2, Buy American – Construction Materials. The Government will apply the thresholds established in RFO Part 25.201, Policy, when determining domestic manufactured construction materials.

34. Can you please communicate with Industry the estimated release dates for

Request for White Papers for OTA 2, 3 and 4?

A: The estimated release dates for the Request for White Papers for the

OTAs mentioned in ‘NAVFAC Special Notice of FY 2027 Industrialized

Construction Projects for Barracks and Child Development Centers via Other

Transaction Authority (10 USC 2808a)’

) is as follows:

OTA 2: MCI East Barracks – estimated early October 2026

OTA 3: MCI West Barracks – estimated mid-October 2026

OTA 4: Navy CDCs – estimated early October 2026

35. What is the timeline for the release of OTA #2 (MCI East Barracks) and OTA #3

(MCI West Barracks)?

A: See response to RFI 34.

36. If specific dates are not yet available, could you let us know whether either release will overlap with the OTA #1 submission period?

A: See response to RFI 34.

37. The Government is requested to clarify how the Relevant Experience evaluation criteria will be applied given the relatively limited number of vendors currently possessing three completed projects exceeding $50 million each that utilize volumetric modular, hybrid, or Kit of Parts methodologies, especially on military installations or for federal or state government clients. Will the Government consider relevant and transferable experience from firms with demonstrated success delivering large-scale modular construction, advanced manufacturing, prefabrication, design-build, and integrated project delivery programs, where either: a) construction is in progress, but with enough progress to show successful delivery, of b), will projects that are substantially complete, including projects that have achieved beneficial occupancy, turnover, or operational status and are progressing through routine closeout activities, be considered relevant experience for evaluation purposes?

A: Projects that are substantially complete and have achieved beneficial occupancy or operational status will be considered complete.

38. We understand the government will be using Other Transaction Authority for this construction of the BEQ’s.

a. Will the GC be contracting directly to the government or to a third party?

b. If to a third party, can we review a copy of the potential contract?

https://sam.gov/workspace/contract/opp/01f4c64f2229452f8b0d4760b977f43f/view https://sam.gov/workspace/contract/opp/01f4c64f2229452f8b0d4760b977f43f/view

c. If to the government, will it be a typical government contract?

d. Can we review terms and conditions?

A: a. The selected vendor(s) will be awarded an agreement with the

Government.

b. N/A

c. The awarded agreement will be an OTA in accordance with 10 U.S.C. §

2808a.

d. Vendors shortlisted from Phase I-AOI will be sent a Request for Project

Proposal (RPP) which includes Terms & Conditions.

39. While preliminary at this phase can you give any indication if 10 separate buildings will be required for all 655,957 sq ft.? Separate buildings can lose efficiencies in cost and schedule particularly if utilizing a modular system. Would the government consider consolidating into 1 or 2 buildings?

A: During this Phase 1-AOI, the Government will not consider consolidation of the 10 BEQ buildings. Offerors should base their white paper submissions on the 10-building program identified in the AOI. Vendors shortlisted to participate in Phase 2-RPP will receive additional project information and site constraints. At that point, vendors may evaluate the building program, site conditions, and associated requirements as part of their technical approach and may propose building-consolidation concepts for

Government consideration.

40. How many entities do you anticipate shortlisting?

A: Approximately 5 to 7 vendors; however, the Government retains the right to include more or less than this number if necessary.

41. To help evaluate future workload and staff can you give an approximate anticipated schedule for the Design and Construction of the project?

A: 9 months for design and 2 years to complete construction.

42. We understand no architect is currently being proposed, will designers be part of future qualifications?

A: See Evaluation Criteria 1-Relevant Experience. Relevant experience may be demonstrated by the proposed team, and it should reflect the specific role (GC, A/E, IC manufacturer, IC-set/stitch, onsite non-IC construction) each key participant performed.

43. Is it expected all modular systems will meet BEAP requirements or is there design flexibility given a modular system is desired?

A: Proposed modular or industrialized construction systems must address the applicable Building Exterior Appearance Plan (BEAP) requirements. The

Government intends to allow flexibility in the means and methods used to meet the requirements and intent of the BEAP while delivering the facility.

44. Because the U.S. modular construction industry is still relatively immature, with most domestic manufacturing facilities established within the past five years, we recommend revising the definition of a "complete" project to include projects that are fully permitted and actively under construction. At this stage, all designs have been approved by the Authority Having Jurisdiction (AHJ), permits have been secured, and construction activities are underway. Will the Government consider modifying the criterion accordingly? Given the emerging nature of this industry, many large-scale projects that meet the preferred $150 million threshold have not yet reached final completion despite having advanced through permitting, design approval, and construction commencement.

Modifying this criterion would provide the Government with a more accurate assessment of current industry capabilities and experience delivering relevant IC, large-scale infrastructure, and industrial construction projects.

A: Projects that are substantially complete and have achieved beneficial occupancy or operational status will be considered complete.

45. Regarding the Award Objective section on page 3 of the AOI:

“MCB Camp Pendleton, CA (Total ~655,957 Square Feet (SF), 10 Buildings)

• Four (4) Bachelor Enlisted Quarters (BEQs), each 401 rooms (253,382 SF).

Repair By Replacement including demolition of existing.

• Three (3) BEQs, each 261 rooms (174,470 SF). Repair By Replacement including demolition of existing.

• Three (3) BEQs, each 361 rooms (228,105 SF). Repair By Replacement including demolition of existing.”

Could you please clarify how the room counts are intended to be applied to the barracks groupings in the AOI? As written, the use of "each" suggests that the stated room count applies to every building within a given grouping. When compared to the corresponding aggregate square footage requirements, that interpretation appears inconsistent. Please confirm whether the room counts are intended on a per-building basis or for each grouping in total.

A: The room counts and square footages identified in the AOI are intended to apply to each respective building group, not to each individual BEQ within that group. The stated requirement is to maintain the required bed capacity for each repair-by-replacement project. The final billeting-room count will include standard 2+0 billeting rooms and the required accessible and adaptable rooms, as applicable. Accessible and adaptable room allocations may result in a total room count that differs from one-half of the required occupant capacity. Offerors should use the occupant capacity, maximum allowable Gross Floor Area (GFA), and applicable facility criteria as the basis for their technical approach. The Phase 2-RPP will provide additional requirements and clarify the final room program for each building group. The Award Objective section in the AOI has been revised as follows:

FROM:

Award Objective:

If selected for award of an agreement, vendor(s) will be responsible for design, manufacturing, logistic, construction, and commissioning of assigned barracks from listing below:

46. The AOI states vendors will 'utilize barracks room IC design standards provided by DoN'. Could the Government clarify if a standardized room layout/module geometry ('kit of parts') has already been established by the DoN under prior initiatives (e.g., DIU BR-IC or similar), and if Phase 2 awardees will be required to site-adapt this fixed design? Or will awardees be expected to submit and execute their own proprietary room module designs?

A: The Government is evaluating 2+0 concepts under a separate

Government agreement and will provide an IC design-standard room layout, including interior finish requirements, to the vendors shortlisted to participate in Phase 2-RPP. If selected for an award of an agreement, the awardee(s) will be responsible for project specific design and adapting the layout in accordance with applicable International Building Code (IBC), Unified Facilities Criteria (UFC), interior finish requirements, and other requirements identified in this Phase 1-AOI and the Phase 2-RPP. The

Government will conduct project specific design reviews throughout the effort.

47. Will the 'barracks room IC design standards provided by DoN' consist of fully detailed volumetric/kit-of-parts module specifications (a fixed 'building block') that the selected team will site-adapt for MCB Camp Pendleton?

48. Alternatively, does the Government intend for white paper submissions to propose flexible, vendor-proprietary module geometries and factory assembly methodologies?

A: The Government does not preclude flexible, vendor-proprietary module geometries or factory assembly methodologies, provided the resulting design maintains consistency with the Government’s IC design-standard room layout across the U.S. Marine Corps. The intent is to promote a standardized and adaptable room layout while allowing industry flexibility in modular design and manufacturing approaches. Vendors shortlisted to participate in Phase 2-RPP may propose changes or deviations from the

Government-provided layout.

49. For the purpose of evaluating 'Relevant Experience' and 'Technical Approach' under this AOI, should vendors assume the final architectural layout and room module dimensions are already locked into a DoN-standardized prototype kit of parts, requiring the awardee to primarily perform site integration, civil/foundation design, and manufacturing/assembly execution? Or will the offeror’s specific, proprietary module design be evaluated as part of the Phase 2 down-select?

A: For purposes of evaluating Relevant Experience and Technical Approach, offerors should treat the Government-provided architectural layout and room module dimensions as the baseline design criteria. Also, see response to RFI 47.
