EVALUATION

A. BASIS FOR AWARD

1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest price technically acceptable proposal.

2. As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

3. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

4. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award.

An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

B. EVALUATION FACTORS FOR AWARD

1. The solicitation requires the evaluation of price and the following non-price factors:

Factor 1 – Experience Factor 2 – Safety Factor 3 – Past Performance

The distinction between corporate experience and past performance is corporate experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance relates to how well a contractor has performed.

2. Basis of Evaluation and Submittal Requirements for Each Factor.

(a) Price:

(1) Solicitation Submittal Requirements:

The Offeror shall submit one original and five copies, using the Contract Pricing Schedule provided with the Request for Proposal in a sealed envelope separate from the Technical Proposal. The Offeror shall submit the price and the Handling and Administrative Rate (HAR), as a percentage of the FF&E, to account for all design, administrative costs, overhead, bonding fees, administration of subcontractors, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E.

- Standard Form (SF) 1442 (Solicitation, Offer and Award)

- Bid Bond

Failure to submit a Bid Bond conforming to the requirements of the solicitation may result in an Offeror's proposal being rejected as unacceptable.

(2) Basis of Evaluation:

Basis of Evaluation: The Government will evaluate the price based on the total price. The total price to be evaluated will include Base Item 0001A, Base Item 0001B, Option Item 0001, Option Item 0002, Option Item 0003, Option Item 0004, Option Item 0005, and the HAR segment under the FF&E Planned Modification under CLIN 0002. The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in the solicitation. In accordance with FAR 52.217-5, Evaluation of Options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:

(i) Comparison of proposed prices received in response to the RFP.

(ii) Comparison of proposed prices with the IGE.

(iii) Comparison of proposed prices with available historical information.

(iv) Comparison of market survey results.

The estimated price range is between $100,000,000 and $250,000,000

The estimated amount for FF&E is $92,223

Offerors may propose a HAR for the FF&E not to exceed 5%. The proposed HAR is a fixed percentage that will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimated budget amount for FF&E.

Evaluation will include analysis to determine the Offeror’s comprehension of the requirements of the RFP as well as to assess the validity of the Offeror’s approach. Proposals will be evaluated to assess the degree to which proposed price accurately reflects proposed performance.

Any inconsistency, whether real or apparent, between proposed performance and price must be clearly explained in the price proposal. For example, if unique and innovative approaches are the basis for an apparently unbalanced/inconsistently priced proposal, the nature of these approaches and their impact on price must be completely documented. The burden of proof of price reasonableness rests solely with the Offeror.

(b) Technical Factors:

(1) Factor 1, Experience:

(i) Solicitation Submittal Requirements:

Submit Exhibit “A” (Construction Experience Project Data Sheet) under Tab “1.”

Submit a minimum of one (1) and maximum of three (3) relevant construction projects that best demonstrates your experience as a prime contractor on projects that are similar in size, scope, and complexity to the RFP. For purposes of this evaluation, a project will be considered relevant if it consists of one of the following:

- Marine navigation project that includes dredging and dredged material placement of 500,000 cubic yards of material or greater in fill locations above and below sea level.

- Marine navigation project that includes rubble mound breakwater or quarry stone revetment construction with 250,000 tons of rock and gravel material or greater.

- New construction or reconstruction of concrete displacement pile supported marine structure with a construction cost of $25,000,000 or greater.

The Offeror's submitted project or projects must demonstrate experience with the three major aspects for this contract: (1) marine dredging of at least 500,000 cubic yards of material; (2) marine rubble mound breakwater or quarry stone revetment construction with at least 250,000 tons of rock and gravel material; and (3) new construction or reconstruction of concrete displacement pile supported marine structure costing at least $25,000,000.

Exhibit “A” must clearly address how the project meets the above requirements. Projects submitted for the Offeror shall be 100% complete (see definition) within the past ten (10) years of the date of issuance of this RFP.

A project is defined as a construction project performed under a single task order or contract. For multiple award and indefinite delivery/indefinite quantity type contracts, the contract as a whole shall not be submitted as a project;

rather Offerors shall submit the work performed under a task order as a project.

The attached Construction Experience Project Data Sheet (Exhibit “A”) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded; however, total length for each project data sheet shall not exceed one (1) double-sided page (or two (2) single-sided pages).

For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the project requirements of this RFP (i.e.: unique features, area, construction methods).

If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, at least one relevant project shall be submitted for each of the Joint Venture members. Offerors who fail to submit experience for all Joint Venture members shall be rated Unacceptable. Offerors are still limited to a total of three (3) projects combined.

If an Offeror is utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name and DUNS number is not exactly as stated on the SF1442), the proposal shall clearly demonstrate that the affiliate/subsidiary/parent firm will have meaningful involvement in the performance of this contract in order for the past performance information of the affiliate/subsidiary/parent/LLC/LTD member companies to be considered. In particular, the proposal will clearly state the specific commitments of resources of the affiliate/subsidiary/parent/LLC/LTD member that will be located at the worksites and company offices in the city/area of the project. The proposal shall also describe specific roles of the affiliate/subsidiary/parent/LLC/LTD member companies in terms of the work it will either self-perform or manage of behalf of the Offeror in performance of the contract. Any projects submitted in excess of three (3) will not be considered.

The Offeror may utilize experience of a subcontractor that will perform major or “critical aspects” of the requirement to demonstrate construction experience under this evaluation factor. For the purposes of this solicitation, only dredging, rockwork and pile supported structure are defined as major or “critical aspects”. To be considered as experience for the Offeror, the proposal must provide a letter of commitment and an explanation of the meaningful involvement that the subcontractor will have in performance of this contract.

(ii) Basis of Evaluation:

The requirement for acceptability will be based upon the Offeror’s demonstrated experience and depth of experience in performing relevant construction projects submitted by the Offeror.

(2) Factor 2, Safety:

Submit Exhibit “B” (Safety Data Sheet / Safety Narrative) under Tab “2.” For a partnership or joint venture, the submittal requirements above are required for each contractor who is part of the partnership or joint venture;

however, only one safety narrative is required. EMR, DART and TRC rates shall not be submitted for subcontractors

The Offeror shall submit the following information:

(1) Experience Modification Rate (EMR) – Submit data for three previous calendar years (2015, 2016, and 2017).

This rate compares company’s annual losses in insurance claims against its policy premiums. The Offeror may submit an insurance company-provided equivalent rate if no EMR exists. If the Offeror has no EMR or premium, for any year, affirmatively state so and explain why. Any extenuating circumstances that affect the EMR and negative trends shall be addressed as part of the element.

(2) OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) and Total Recordable Case (TRC) Rates - Submit data for three previous calendar years’ (2015, 2016, and 2017). If an Offeror cannot submit OSHA DART and TRC rates, for any year, affirmatively state so and explain why. Any extenuating circumstances that affected the OSHA DART and TRC rate data negatively shall be addressed as part of this element.

(3) Technical Approach for Safety – Describe the plan for safety that will be implemented to evaluate safety performance of potential subcontractors as part of the selection process for all levels of subcontractors. The Offeror shall submit a narrative that fully describes the safety management system that they will use to oversee the safety compliance and performance of self-performed and sub-contractor performed work. The Offeror shall describe any innovative methods that will be employed to ensure and monitor safe work practices at self-performed and all subcontractor levels. Additionally, describe the methodology to execute an effective program that facilitates sound mishap prevention techniques and processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps, including a description of your “Good Catch” Program. A “Good Catch” Program is defined as a program that recognizes and rewards employees for reporting unsafe and/or unhealthful situations and acts to create a climate of trust and safety. The program should also have procedures in place to address deficiencies and unsafe situations immediately and to document those actions accordingly. The technical approach to safety narrative shall be limited to one-double sided page or two single-sided pages.

(ii) Basis of Evaluation:

The safety factor evaluation will collectively consider the following three submittal requirements:

EMR – The Government will evaluate the EMR to determine if the Offeror has demonstrated a history of safe work practices taking into account any negative trends and extenuating circumstances that impact the rating.

OSHA DART and TRC rates – The Government will evaluate the OSHA DART and TRC rates to determine if the Offeror has demonstrated a history of safe work practices taking into account any upward trends and extenuating circumstances that impact rates.

Technical Approach to Safety –The Government will evaluate the degree to which subcontractor safety performance will be considered in the selection of all levels of subcontractors on the upcoming project as well as the degree to which the Offeror’s safety management system will ensure safety compliance of self-performed and subcontracted work, including innovative methods to monitor safe work practices. The Government will also evaluate the Offeror’s methodology to execute an effective program that facilitates sound mishap prevention techniques/processes, employee reporting of unsafe conditions, unsafe activities, and near-miss mishaps including its “Good Catch” Program.

While the Government may elect to use other sources of information in evaluating safety to include, but not limited to OSHA, NAVFAC’s Contractor Incident Reporting System (CIRS) in Enterprise Safety Applications Management System (ESAMS), Contractor Performance Assessment Reporting System (CPARS) and other related databases, the burden of providing detailed, current, accurate and complete safety information regarding these submittal requirements rests with the Offeror.

(c) Past Performance

(1) Factor 3, Past Performance:

Submit Past Performance Questionnaires (Exhibit “C”) and CPARS evaluations under Tab “1” immediately following each of the project data sheets to which they pertain. Submit any other past performance information under Tab “3.”

If a completed Contractor Performance Assessment Rating System (CPARS) evaluation is available, it shall be submitted with the proposal for each project included in Factor 1. If there is not a completed CPARS, submit a Past Performance Questionnaire (Exhibit “C”) for each project included in Factor 1. The Offeror should provide completed Past Performance Questionnaires (PPQ) in the proposal. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact.

Offerors may provide any information on problems encountered and the corrective actions taken on projects submitted under Factor 1 – Experience. Offerors may also address any adverse past performance issues.

Explanations shall not exceed two (2) double-sided pages (or four (4) single-sided pages) in total.

The Government reserves the right to contact references for verification or additional information. The Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor. In addition to the above, the Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of Contractors who are part of a partnership or joint venture identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the Offeror.

Performance award or additional information submitted will not be considered.

(ii) Basis of Evaluation:

This evaluation focuses on how well the Offeror performed on the relevant projects submitted under Factor 1

– Experience and past performance on other projects currently documented in known sources (including interim project performance evaluations). Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.

The Government will consider the currency and relevance of the information, the source of the information, context of the data, and general trends in the Contractor’s performance. This evaluation is separate and distinct from the Contracting Officer’s responsibility determination.

In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
