SECTION 01 30 02.00 20 Page 1 other miscellaneous items to support facility functions.
Fixed furnishings (items that are fixed to the structure), such as drying cages, weapon racks, motorized projection screens, window coverings and lockers are not considered FF&E and are part of the construction contract, Structural Interior Design (SID).
FF&E will be fully integrated with the building systems and finishes.
FF&E is estimated in the following amount: [$XXX,XXX]. The standard Audio Visual (A/V) is estimated in the following amount: [$XXX,XXX]. Estimates do NOT include the Prime Contractor's Handling and Administration Rate
(HAR).
The standard A/V equipment will be included as part of the FF&E package.
The standard A/V equipment package will be identified as a separate line item and may be funded separately from the FF&E.
[Refer to the Interior Design drawings for the FF&E layouts.]
The final FF&E package has been completed and approved. The NAVFAC Interior Designer/Collateral Equipment Manager developed the final FF&E Package.
This effort will not be part of the Prime Contractor's scope of work.
The Prime Contractor will provide the procurement and installation of all Furnishings, Fixtures, and Equipment (FF&E) exactly as designed and specified using NAVSUP Blanket Purchase Agreements (BPAs), General Services Administration (GSA) schedules, and other Federal contracts and complying with priorities found in FAR Part 8.404.
The Prime Contractor will be responsible to validate the final FF&E package and make any pricing updates, finish, material and/or product reselections due to revisions or deviations as a result of discontinued items or approved design changes. The Prime Contractor will update construction drawings to reflect any FF&E revisions/deviations. Any required revisions must be coordinated through the specified dealer(s) for reselection. Submit recommended substitutions to the Contracting Officer and the NAVFAC Interior Designer/Collateral Equipment Manager for approval.
The NAVFAC Interior Designer/Collateral Equipment Manager will approve all SID and FF&E submittals.
FF&E items are subject to the Buy American Act (BAA)/Trade Agreement Act(TAA).
1.3.1 Authorization
The Government will provide separate funding for procurement and installation of the FF&E package. Construction funds will not be used. The FF&E package shall include shipping, freight, handling, and installation costs. Upon receipt of required funding, the Prime Contractor shall be authorized by the Contracting Officer, as a planned modification to the construction contract, to procure and install all final FF&E using Federal Government price schedules (NAVSUP BPAs and/or GSA).
The FF&E modification shall be awarded no later than six months prior to the contract completion date. A minimum of six months is required for the Prime Contractor to purchase, deliver and install the FF&E without impacting the overall completion date of the project. The Prime

Contractor's schedule should assume the award of the FF&E as a modification. No schedule extensions shall be granted if the modification is awarded at least six months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than six months prior to the contract completion date, the Prime Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Prime Contractor demonstrates that sufficient lead time for the FF&E is not available and the Government's award of the modification is in the last six months of the contract.
The amount of the modification will be the actual cost of these items from the Federal Government price schedules (NAVSUP BPAs and/or GSA), including any freight and installation charges from the furniture supplier as well as the Prime Contractor's HAR. The HAR includes all of the Prime Contractor's effort related to storage, coordination, handling, administration of subcontractors, and all other associated costs and profit for the procurement of FF&E. The Prime Contractor will propose in the contract solicitation the FF&E HAR percentage. The Prime Contractor's proposed HAR may not exceed 5 percent of the total FF&E costs, as noted on the Contract Pricing Schedule. No other charges, expenses, fees, markups, etc. will be authorized.
1.4 PROCUREMENT AND INSTALLATION
The Prime Contractor will coordinate the building completion date with the installation dealer(s) specified in the FF&E Package.
The Prime Contractor may anticipate possible manufacturer price increases if order placement is delayed. It is recommended to order the FF&E product once the planned modification is awarded and funds are received to avoid incurring additional costs. Delayed production and delivery dates can be noted at the time of order placement to coincide with building completion dates. Any costs incurred as a result of Prime Contractor delay in order placement will be the burden of the prime contractor.
1.4.1 Use of Blanket Purchase Agreements (BPA) and GSA Schedules
The Prime Contractor will receive a letter of authorization from the Contracting Officer citing the name of the furniture dealer(s) and other information to use when accessing the Federal Government supply sources.
1.4.2 Deposits
The Prime Contractor should anticipate providing a deposit between 30 percent to 50 percent of the FF&E costs when placing their order.
1.4.3 Davis Bacon Wages
The FF&E line item is solely for the procurement and installation of furniture, fixtures, and equipment that are not "built-in" to the facility, but are loose, portable, or mobile. The FF&E is not considered construction; therefore, the Davis Bacon Act is not applicable to the FF&E line item. The workforce for the FF&E installation and delivery shall be separate and distinct from the labor workforce performing the construction effort.
SECTION 01 30 02.00 20 Page 3
1.4.4 Taxes
Exemptions for certain State or Local taxes may be available to the Prime Contractor and/or its subcontractors. The Prime Contractor shall take maximum advantage of all exemptions, including obtaining a resale permit, from State and Local taxation authorities whether available directly to the Prime Contractor or based on an exemption afforded the government. The responsibility for paying applicable taxes rests with the Prime Contractor. State and local taxes to the FF&E line will be included with the subcontractor's quote, if applicable by the state.
As prescribed in FAR 29.401-3, the Contract Specialist will insert FAR clause 52.229-3, Federal, State and Local Taxes, in the construction contract. In accordance with this clause; (i) the contract price includes all applicable Federal, State, and local taxes and duties.and (ii) the government shall, without liability, furnish evidence appropriate to establish exemption from any Federal, State, or local tax when the Prime Contractor requests such evidence and a reasonable basis exists to sustain the exemption.
Any items purchased as building materials such as carpet are taxable.
1.4.5 Bonds
FAR 28.102-1(a) requires that performance and payment bonds be included in all construction contracts exceeding $150,000, except under the conditions listed. In addition, FAR 28.102-2(d) requires the Government to secure additional bond from the Prime Contractor for any contract price increases. Since the FF&E planned modification is not part of the original contract award, the Prime Contractor shall not be required to secure bond for the FF&E at the time the basic contract is awarded. Additional bonding may be required for the award of the FF&E line item at the time of the planned modification (see below).
In accordance with FAR 28.103, the contracting officer may determine that performance and payment bonds for other than construction are warranted and seek additional bond for the FF&E. Should performance and payment bonds be determined necessary, the Contracting Officer shall include this requirement in the solicitation, and is funded as part of the construction contract.
1.4.6 Unique Item Identification (IUID) and Valuation
Unique item identification and valuation is a system of marking and valuing items delivered to DoD that enhances logistics, contracting, and financial business transactions. The IUID policy is mandatory for all DoD contracts that require the delivery of items. An item is a single article or a single unit formed by a grouping of subassemblies, components or constituent parts. The Prime Contractor shall provide DoD Unique item identification, valuation and delivery of data for all required FF&E items for which the government's unit acquisition cost is $5,000 or more.

The Prime Contractor is to provide and coordinate all Building Systems with the furniture plans and furniture installation.
1.4.8 Installation Warranty
All movable furnishings will be installed in accordance with the manufacturer's instructions and warranty requirements. All movable furnishings must be level and aligned. All doors, drawers and accessories must be level and aligned to open, close and otherwise operate smoothly and securely.
All furniture will be installed by the furniture manufacturer's dealer of record and not the Prime Contractor. In addition, installation dealer(s) must be located within a 100 mile radius of the project site unless approved by the NAVFAC Interior Designer/Collateral Equipment Manager. The Prime Contractor will repair, to the Government's satisfaction, any/all damage to any facility finish that is a result of the furniture installation and correct all punch list items for the furniture/furnishings. The Prime Contractor will obtain services of equipment specialists to install the electrical equipment, to include but not limited to televisions, Video Teleconference Equipment, ceiling mounted projectors and mission essential electronic equipment included in the FF&E package.
1.4.9 Ordering Documentation
At a minimum, two copies of all ordering documents prepared or obtained by the Prime Contractor or the furniture dealer shall be provided to the Contracting Officer. Including but not limited to Purchase Orders, Factory Orders and warranty information. One copy will be submitted to the client representative and one copy will be retained with the contract files.
1.4.10 Post Award Changes
After award of the FF&E planned modification, any requests to change the FF&E items must be submitted to the Contracting Officer. The FF&E planned modification has been priced, negotiated, and awarded based on specific line items as detailed in the approved, final FF&E package. These items have been agreed to considering color, specific type and quality of material, price, usable life, etc. The Government will expect and require the Prime Contractor to provide exactly those items. Should changes become necessary, careful consideration is required to ensure that equivalent quality, price and other aspects of the item is maintained, otherwise price adjustments must be negotiated. The Contracting Officer will obtain approval from the NAVFAC Interior Designer/Collateral Equipment Manager, in consultation with the client, for any changes to the FF&E.
The Prime Contractor shall validate pricing prior to contract modification. Cost increases due to authorized GSA schedule price increases shall be allowed prior to the contract modification to purchase the FF&E. Reimbursement for cost increases after contract modification will not be considered.

Quotes for installation and procurement of non-BPA furniture and GSA/Other items are required and shall be procured under the Packaged BPA and GSA schedules regardless of costs.
Use of the BVD Analysis and Performance Criteria is not required for procurements under $150K as long as pricing is solicited by manufacturers that meet the NAVFAC Performance Criteria. The BVD Analysis Project Specific Typical is required indicating workstation layout, finishes, and specific technical requirements. Sources should be reviewed with the NAVFAC Interior Designer/Collateral Equipment Manager for all products during the FF&E Requirements Meeting. Pricing information is not required as part of the FF&E submittal for $3-$150K procurements.
