SECTION 00210
BAS IS OF AWARD AND EVALUATIONS FACTORS
1. BASIS OF AWARD
Selection of contractor(s) will be accomplished using Source Selection Procedures on the basis of Lowest Price Technically Acceptable (LPTA) to the Government, considering price and other factors combined. The LPTA process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. Interested firms are expected to review the RFP and participate in a pre -proposal conference and site visit, provide proposed, and provide proposal information requested to evaluate their technical and past performance factors.
The Government intends to evaluate proposals and award a contract without discussions. If necessary, the Government will conduct discussions with offerors whose proposals have been determined to be within the competitive range. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the range to the greatest number that will permit an efficient competition among the most highly rated proposals.
In accordance with the Naval Facilities Acquisition Supplement (NFAS) regulations, the number of proposals to be evaluated for technical acceptability may be limited to the three (3) lowest priced offers at the discretion of the contracting officer. If the number of proposals to be evaluated is limited, technical proposals shall be provided to the evaluator(s) without any identification of prices or any rank order of prices. If no proposals are found to be technically acceptable within the first group of proposals, then the process described will be conducted again as many times as necessary, until such time as the Government identifies a technically acceptable proposal.
The Government anticipates a single award construction contract. Award of the basic construction contract will be made to the responsible offeror whose proposal, conforming to the solicitation, is determined to be the most advantageous to t he Government considering the technical and price factors. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract; to negotiate with offerors in the competitive range; and to award the contract to the offeror submitting the lowest price technically acceptable offer. Proposals should be submitted initially on the most favorable price and technical terms. Offerors should not assume that they would be contacted or afforded the opportunity to qualify, discuss, or revise their proposal. Firms participating in the pre - proposal conference and site visit will not be compensated for their participation.
2. DEFINITIONS
1. Clarifications are limited exchanges between the Government and offerors that may occur when award without discussions is contemplated.
2. Communications are exchanges, between the Government and offerors, after receipt of proposals, leading to establishment of the competitive range.
3. Competitive Range See Far 15.306(c).
4. Deficiency is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level. See FAR 15.001.
5. Discussions are negotiations conducted in a competitive acquisition. Discussions take place after establishment of the competitive range.
6. Evaluation Notice (EN) is the PCO’s written notification to the offeror for purposes of clarifications, communications, or in support of discussions.
7. Lowest Price Technically Acceptable (LPTA) is a process used in competitive negotiated contracting where the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price. See FAR 15.101-2.
8. Performance Confidence Assessment is an evaluation of the likelihood (or Government’s confidence) that the offeror will successfully perform the solicitation’s requirements; the evaluation is based upon past performance information.
9. Recency, as it pertains to past performance information, is a measure of the time that has elapsed since the past performance reference occurred. Recency is generally expressed as a time period during which past performance references are considered relevant.
10. Relevancy, as it pertains to past performance information, is a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type and subcontract/teaming or other comparable attributes of past performance examples and the source solicitation requirements; ;and a measure of the likelihood that the past performance is an indicator of future performance.
11. Requirements Documents are all aspects of the RFP that convey the needs of the Government to offerors, including the SOO, SOW, PWS, technical requirement documents, and system requirement documents.
12. Requiring Office is the entity (for example, a program management office or other organizational entity) responsible for translating user requirements into the requirements documents within the RFP that communicate those requirements to offerors.
13. Risk, as it pertains to source selection, is the potential for unsuccessful contract performance. The consideration of risk assesses the degree to which an offeror’s proposed approach to achieving the technical factor or subfactor may involve risk or disruption of schedule, increased cost or degradation of performance, the need for increased Government oversight, and the likelihood of unsuccessful contract performance. (For firm-fixed-price contract, the reference to increased cost may be removed from the risk definition.)
14. Source Selection Advisory Council (SSAC) is a group of senior Government personnel who provide counsel during the source selection process and must prepare the comparative analysis of the SSEB’s evaluation results, when directed by the SSA. A SSAC is required for all Source Selections valued at or over $100M.
15. Source Selection Authority (SSA) is the official designated to make the source selection decision.
16. Source Selection Team (SST) is a team that is tailored to the unique acquisition, tasked with carrying out a source selection. Composition of the team generally consists of the SSA, PCO (if different from the SSA), SSAC, SSEB, Advisors, Cost or Price Experts, Legal Counsel, Small Business Specialists, and other subject-matter experts.
17. Significant Weakness in the proposal is a flaw that appreciably increases the risk of unsuccessful contract performance. See FAR 15.001.
18. Source Selection Decision Document (SSDD) is the document that reflects the SSA’s independent, integrated, comparative assessment and decision.
19. Source Selection Evaluation Board (SSEB) is a group of Government and, if needed, approved non-
Government personnel, representing the various functional disciplines relevant to the acquisition.
20. Source Selection Plan (SSP) is a plan that describes how the source selection will be organized, how proposals will be evaluated and analyzed, and how source(s) will be selected.
21. Strength is an aspect of an offeror’s proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.
22. Weakness means a flaw in the proposal that increases the risk of unsuccessful contract performance. See
FAR 15.001.
3. ADJECTIVAL RATINGS/DESCRIPTIONS
Each offeror’s technical factors and past performance will be evaluated separately. Upon the conclusion of the evaluation of the technical factors, an overall non-price factors rating of Acceptable (A) or Unacceptable (U) will be assigned to each offeror’s non-price factors proposal.
• The following adjectival ratings and rating descriptions will be used to assign a rating to each technical factor. Use upper case letter ratings for major technical factor ratings. The addition of plus (+) or minus (-) to an adjective rating is not allowed.
Table A-1. Technical Acceptable/Unacceptable Ratings
Rating Description
Acceptable (A) Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable (U)
Proposal does not clearly meet the minimum requirements of the solicitation.
An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.
The weaknesses and/or deficiencies (as defined below) of each proposal for each non-price evaluation factor which influenced the assigned adjectival rating shall be identified.
Definitions Weakness A flaw in the proposal that increases the risk of unsuccessful contract performance.
Significant Weakness
A flaw that appreciably increases the risk of unsuccessful contract performance.
Deficiency
A material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in a proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
4. EVALUATION FACTORS
1. The solicitation requires the evaluation of price and the following non-price factors:
Factor 1 – Experience Factor 2 – Past Performance Factor 3 – Management Approach and Capabilities of the Offeror Factor 4 – Safety
“The distinction between experience and past performance is experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.”
2. Basis of Evaluation and Submittal Requirements for Each Factor
A. Non-technical Factors:
PRICE
(1) Solicitation Submittal Requirements
The Offeror shall submit their prices using the MS Excel ELIN Price Schedule included in the solicitation as Attachment G, in a separate sealed envelope, as part of Volume I, Price Proposal:
Complete Price ELINs A001 through J013.
(2) Basis of Evaluation
The price evaluation is based on the total estimated quantity specified in the solicitation for the base year performance plus four (4) 12-month option years for a total maximum duration of 60 months which equates to the sum of ELINS A001 through J013 (Attachment G of the solicitation). The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in Section 0210 of the solicitation. In accordance with FAR 52.217-5, Evaluation of Options will not obligate the Government to exercise the option(s). Analysis will be performed by one or more of the following techniques to ensure a fair and reasonable price:
i. Comparison of proposed prices received in response to the solicitation.
ii. Comparison of proposed prices with the independent Government Estimate
iii. Comparison of proposed prices with available historical information.
iv. Comparison of market survey results.
a. Exhibit line item numbers (ELIN) unit prices shall be multiplied by the estimated quantity to determine the total price for each ELIN. In the event the total price for an ELIN does not mathematically equate to the product of the unit price and estimated quantity, the unit price shall take precedence over the total price. The unit price shall be considered the Offeror’s intended bid price for the ELIN.
b. A price that is found to be either unreasonably high or unrealistically low in relation to the proposed work may be indicative of an inherent lack of understanding of the solicitation requirements, or in the case of unrealistically low prices, may pose an unacceptable performance risk, and may result in the overall proposal not being considered for award.
c. The Government may determine that an offer will not be considered if the option prices are significantly unbalanced. Any inconsistency whether real or apparent, between proposed performance and price must be clearly explained in the price proposal. For example, if unique and innovative approaches are the basis for an apparently unbalanced or inconsistently priced proposal, the nature of these approaches and their impact on price must be completely documented. The burden of proof of price realism rests solely with the offeror.
d. Each ELIN shall be priced independent of other ELINS as if it were stand-alone work (unless otherwise noted in the schedule or elsewhere in the solicitation). Proposals that appear to be unbalanced relative to unit prices may not be considered for award.
B. Technical Factors:
FACTOR 1 – EXPERIENCE
(1) Solicitation Submittal Requirements. Provide the following for evaluation under Tab 1 of the Technical Proposal Volume II.
(a) Submit Exhibit “A” (Project Experience Data Sheet) under Tab 1, for each Project.
(b) Submittals: Submit five (5) painting projects that best demonstrates the experience of the Offeror and
Offeror’s team, as identified in the narrative submittal for Factor 1, to include painting of interior and exterior facility surfaces, painting of utilities, elastomeric metal roof restoration, and lead-based paint abatement in accordance with the technical sections and attachments of the solicitation. Desirable project dollar values shall range between a minimum of $2,000 and $750,000.
(c) Projects submitted for the Offeror shall be completed within the past five (5) years of the date of issuance of this RFP. Projects may be submitted if substantially (80%) completed by the date of issuance of this RFP.
(d) A project is defined as a painting construction project performed under a single task order or contract.
Multiple award and IDIQ type contracts (basic contracts from which task orders are issued) are not permissible and will not be evaluated.
(e) The attached Offeror’s Experience Project Data Sheet (Exhibit A – Factor 1 Worksheet) is MANDATORY and SHALL be used to submit project information. Except as specifically requested, the Government will not consider information submitted in addition to this form. Individual blocks on this form may be expanded.
(f) A completed Exhibit A shall be submitted for each project submitted under this factor.
(g) For all submitted projects, the description of the project shall clearly describe the scope of work performed and the relevancy to the scope requirements of this solicitation (at least 3-4 sentences).
(h) If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the Joint Venture entity. If the Joint Venture does not have shared experience, projects shall be submitted for each Joint Venture partner. Offerors who fail to submit experience for all Joint Venture partners may be rated unacceptable. Offerors are still required to submit a total of five (5) projects combined.
(i) If an Offeror is utilizing experience information of affiliates/subsidiaries/parent/LLC/LTD member companies (name is not exactly as stated on the SF1442) that will perform major or critical aspects of the requirements, the proposal shall include relevant experience information of these affiliates/subsidiaries/ parent/LLC/LTD member companies The Offeror must provide a letter of commitment and an explanation of the meaningful involvement that the proposed firm will have in the performance of this contract. Regarding any such submitted project, if the Offeror fails to demonstrate the affiliate/subsidiary/parent firm’s meaningful involvement in the performance of this contract, or fails to make clear the relationship(s), the project will not be considered relevant and will not be evaluated. Offerors are still limited to a total of five (5) projects combined.
(2) Basis for Evaluation: The basis of evaluation will include the Offeror’s demonstrated experience and depth of experience in performing five (5) relevant painting projects as described in the proposal submittal requirements. The assessment of the Offeror’s relevant experience will be used as a means of evaluating the capability of the Offeror to successfully meet the requirements of the RFP.
Proposals with fewer than five (5) relevant painting projects or fail to demonstrate experience as required above will be rated Unacceptable. Any project submitted which is: 1) Fewer than, or in excess of the five (5) required projects; 2) Combined projects (see definition); 3) Not 100% or at least 80% complete within the five-year period specified (see definition); or 4) Outside the scope of work of this solicitation, will not be evaluated.
FACTOR 2 –PAST PERFORMANCE
(1) Solicitation Submittal Requirements. Provide the following in the Technical Proposal Volume II:
(a) Evaluations under Tab 2 immediately following each of the projects, shown for Factor 1, Experience, to which they pertain.
(b) IF A COMPLETED CPARS EVALUATION IS AVAILABLE, IT SHALL BE SUBMITTED
WITH THE PROPOSAL. IF THERE IS NOT A COMPLETED CPARS EVALUATION, the Past Performance Questionnaire (PPQ), Part 1, (Exhibit B) included in the solicitation is provided for the Offeror or its team members to submit to the client for each project included in Factor 1, Experience. AN OFFEROR SHALL NOT SUBMIT A PPQ WHEN A COMPLETED CPARS IS
AVAILABLE.
IF A CPARS EVALUATION IS NOT AVAILABLE, ensure correct phone numbers and email addresses are provided for the client point of contact. The Offeror should provide completed PPQs in the proposal. Offerors shall not incorporate by reference in their proposal PPQs or CPARS previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). The Government may make reasonable attempts to contact the client noted for that project(s) to obtain the PPQ information. However, Offerors should follow-up with clients/references to help ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Kristi Beard via email at kristi.beard@navy.mil prior to proposal closing date.
(c) In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the Offeror’s proposal, inquiries of owner representative(s), and any other known sources not provided by the Offeror.
(d) The Government reserves the right to contact references for verification or additional information. The
Government’s inability to contact any of the Offeror’s references or the references unwillingness to provide the information requested may affect the Government’s evaluation of this factor.
(e) While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
A performance award or additional information submitted will not be considered.
(2) Basis of Evaluation:
(a) Past Performance shall be evaluated when using the LPTA process and will be rated on an “acceptable” or “unacceptable” basis using the ratings in the following table:
Acceptable (A) Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable (U) Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
(b) This evaluation focuses on how well the Offeror performed on the relevant projects submitted under Factor
1 – Experience of the offeror and offeror’s team and past performance on other projects currently documented in known sources. In addition to the above, the Government reserves the right to obtain information for use in the evaluation of past performance from any and all sources including sources outside of the Government. Other sources may include, but are not limited to, past performance information retrieved through the PPIRS using all CAGE/DUNS numbers of Contractors who are part of a partnership or joint venture identified in the Offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), and any other known sources not provided by the Offeror.
(c) Offerors will be rated as acceptable when PPQs/CPARS evaluations and information obtained from any other sources reflect, at a minimum, a satisfactory level of performance considering the following: the contractor’s history of reasonable and cooperative behavior; commitment to customer satisfaction’ record of conforming to specifications and applicable law (i.e., Davis Bacon Wage Determinations/Safety Standards, etc..); quality of workmanship; record of recommending and/or implementing innovative approaches and/or technologies; record of controlling costs; safety performance record; and adherence to schedules.
(d) In the case of an Offeror without record of relevant past performance or for whom information on past performance is not available or so spare that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305(a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability “unknown” shall be considered “acceptable.”
FACTOR 3 –MANAGEMENT APPROACH AND CAPABILITIES OF THE OFFEROR
(1) Solicitation Submittal Requirements. Provide the following for evaluation under Tab 3 of the technical proposal Volume II:
(a) Use the Exhibit C – Factor 3 Worksheet to address the following:
Provide both the single and aggregate bonding capacity of the Offeror (see paragraph (d) below for additional requirements regarding bonding capacity).
Provide an organizational chart identifying all of the Offeror’s key personnel (names, position titles) and team members (affiliates, subsidiaries), if any, responsible for the execution and technical administration of the contract with corresponding lines of authority. It should also indicate the full-time and part-time positions.
Provide the percentage of work that the in-house tradespeople employed by the Offeror will perform as the Prime SDVOSB Offeror in accordance with the RFP requirements.
For the affiliates or other partner members, explain the type of work they will be responsible to perform and the corresponding percentage of work that will be performed by each one. Offerors shall provide a letter of commitment for each affiliate or partner as applicable under separate attachment.
How the Offeror will respond to proposed task orders that may have short notice site visits and/or response times for submitting proposals.
Describe the Offeror’s commitment and capability to manage multiple concurrent task orders in various locations within the area of coverage of this contract.
• If only one Project Manager is proposed to manage this contract, the Offeror will describe how the Project Manager will effectively manage work taking place simultaneously at all installations covered under this contract.
If more than one person is proposed to be Project Manager, indicate how the work is to be divided so it is effectively managed between the different Project Managers.
Provide a detailed description of each Project Manager’s authority, knowledge of, and experience with IDIQ type of contracts, subcontracting coordination, construction safety, quality control, and anti-terrorism standards.
Describe how the Offeror will effectively perform quality control management including how the
Offeror will go about selecting a Quality Control Manager (QCM) who meets the requirements of the RFP.
Submit (under Tab “3”) résumés for the Offeror’s proposed key personnel: Project Manager(s), Quality Control Manager(s), Site Safety Health Officer, and Site Superintendent(s).
(b) Proposals that fail to address all of the elements or submit complete required information under this Factor may be rated Unacceptable.
(c) Offerors shall respond in the space provided on the worksheets using a minimum of 12 pt. Times New
Roman or Arial font. The boxes may be expanded.
(d) The Offeror shall provide a bondability letter from the surety company to demonstrate the minimum single project bonding capacity and aggregate bonding capacity of at least $10,000,000 for the management of multiple concurrent projects at the higher dollar magnitude within the task order range.
The letter will also indicate the current available bonding capacity.
(e) If applicable, the Offeror shall submit a signed copy of a joint venture agreement, partnership agreement, teaming agreement, or letter of commitment for each member of the Offeror’s team identified above (e.g., joint venture partner, parent company, subsidiary, or other affiliated company, etc.).
(a) The basis of evaluation will be the Offeror's management approach and capabilities to be successful on this IDIQ Contract. Management approach is defined as the Offeror's commitment, capability/resources to fulfill the requirements. The management approach also includes the Offeror’s team composition; the quality control process; the authority, knowledge and experience of the Offeror's Project Manager; the qualifications of the key personnel; the percentage of the effort the Offeror will self-perform; and the Offeror’s bonding capacity.
(b) A well developed approach that demonstrates an ability to coordinate and manage several concurrent projects which could result in annual contract awards of $1,000,000 to $6,000,000.
(c) An approach that identifies areas of risk in logistics and resource management, and provides a well thought-out…
