SECTION M - EVALUATION FACTORS FOR AWARD

EVALUATION

A. BASIS FOR AWARD

1. The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contracts; to negotiate with offerors in the competitive range; and to award the contracts to the offerors submitting the lowest priced, technically acceptable offers.

2. As stated in the solicitation, the Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306 (a)). The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. In addition, if the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.

3. The Lowest Price Technically Acceptable (LPTA) process is selected as appropriate for this acquisition because the best value is expected to result from selection of the technically acceptable proposal with the lowest evaluated price.

4. An overall non-price factors rating must be at least “ACCEPTABLE” in order to be eligible for award. An “UNACCEPTABLE” rating in any factor results in the overall non-price factors proposal being rated “UNACCEPTABLE” unless corrected through discussions. An overall non-price factors rating of “UNACCEPTABLE” makes a proposal ineligible for award.

EVALUATION FACTORS FOR AWARD

1. The Technical Proposal will be reviewed, evaluated and rated acceptable or unacceptable based on the five (5) technical evaluation factors. A rating of “unacceptable” under any evaluation factor will result in an “unacceptable” rating overall for the proposal.

a. The solicitation requires the evaluation of price and ‘non price” factors:

Factor 1 – Corporate Experience Factor 2 – Key Personnel Qualifications Factor 3 – Program Management Approach Factor 4 – Safety Factor 5 – Past Performance Factor 6 - Price

2. The distinction between corporate experience and past performance is corporate experience pertains to the types of work and volume of work completed by a contractor that are comparable to the types of work covered by this requirement, in terms of size, scope, and complexity. Past performance pertains to both the relevance of recent efforts and how well a contractor has performed on the contracts.

BASIS OF EVALUATION FOR EACH FACTOR:

FACTOR 1 - CORPORATE EXPERIENCE:

1. Basis of Evaluation: The basis of evaluation will be focused on the firm’s relevant corporate experience in performing contracts and/or task orders of similar size, scope, and complexity to cultural resource services described in Annex 18 of the solicitation. Proposals shall clearly demonstrate relevant corporate experience within the NAVFAC Southwest Area of Responsibility, (geographical areas of Arizona, California, Colorado, Nevada, New Mexico, and Utah).

2. To demonstrate relevant corporate experience, firms shall complete RFP Attachment 1, Project Data Sheets for projects that have been completed or substantially completed (at least 80%) within the past five (5) years of the solicitation closing date. Projects must have a dollar value of at least $30,000. Corporate experience may include projects with the Federal Government, agencies of the state or local governments, and/or commercial customers for the same or similar work covered under this solicitation, but must demonstrate experience with the National Historic Preservation Act of 1966, as amended, Section 110 and/or Section 106. Projects not meeting this size, scope, and complexity criterion will not be considered relevant.

3. Firms shall clearly demonstrate their experience in performing archeological ‘or’ historic (cultural resources) investigations complying with Sections 110 and 106 of the National Historic Preservation Act of 1966, as amended.

To be determined acceptable for Factor 1, firms shall demonstrate experience in federal historic preservation in any four of the cultural resource experience areas noted below (a-h):

a. Phase I Archeological Identification Survey

b. Phase II Archaeological Site Evaluation

c. Phase III Archeological Data Recovery

d. Archeological Monitoring

e. Historic Structure Reports (HSR)

f. Built Environment Historic Resources Survey and Evaluation Investigations

g. Design Guidelines/Historic Building Maintenance Plans

h. HABS/HAER/HALS Documentation

4. Offerors shall provide four (4) completed RFP Attachment 1, Project Data Sheets that fully demonstrate the firm’s knowledge and experience for four (4) different types of cultural resource experience areas among those listed above (a-h). At least two (2) projects must have been performed in California. Projects conducted outside the geographic locations of Arizona, California, Colorado, Nevada, New Mexico and Utah will not be evaluated. All projects submitted must have been performed by the Offeror. If corporate experience is submitted by the Offeror that was performed by a subcontractor, partner, Joint Venture, or team member, their experience will only be evaluated with submission of an executed legally binding agreement with the subcontractor, partner, Joint Venture, or team member.

FACTOR 2 – KEY PERSONNEL QUALIFICATIONS:

1. Basis of Evaluation: Firms will be evaluated based on the qualifications of their proposed key personnel. The evaluation of these personnel will consider education, professional qualifications, and experience in cultural resource services. To be acceptable, the proposed key personnel qualification forms must demonstrate that the proposed individuals meet the minimum requirements specified in Annex 2.6.3.1.

2. The Contractor shall complete RFP Attachment 2, Key Personnel Qualification Sheet, for each of its key personnel. The minimum qualifications for education and experience are set forth in Annex 2.6.3.1. The following positions are considered Key Personnel and shall be employees of the prime contractor.

a) Quality Control Manager (QCM)

b) Contract Manager (CM)

c) Two (2) Principal Investigator Archaeologist (PIA) or Two (2) Principal Investigator Historian (PIH), ‘or’ at least one (1) PIA and at least one (1) PIH

3. If experience/qualifications were obtained under projects listed in RFP Attachment 1, indicate the contract and task order number. The government reserves the right to request verification of any statement in the proposed Personnel Form.

FACTOR 3 - PROGRAM MANAGEMENT APPROACH:

1. Basis of Evaluation: The basis of evaluation for Factor 3 – Program Management Approach will focus on the effectiveness of the offeror’s proposed approach to adequately perform the requirements of this solicitation. For the proposal to be determined acceptable under Factor 3, the offeror must demonstrate sound business and program management practices relating to cultural resource services. In doing so, proposals shall provide the following information:

a. Organization Chart (to include team subcontractors): The organization chart shall demonstrate the proposed program management organizational structure, lines of authority between Key Personnel and Other (non-key) Personnel, and organizational relationships with any proposed subcontractors.

Identify the designated safety, and quality control/assurance representatives.

b. Program Management Approach: Describe the approach that will be employed under the resulting contract. Address the methods of communication within the proposed organization, to include communication with the government personnel. Provide a list of office locations for the Prime, Joint Venture Partner (if applicable), and Subcontractors (if applicable).

c. Quality Assurance/Quality Control Program: Describe how the quality assurance/quality control program is applied throughout the team, including team subcontractors. This approach shall address the Principal Investigators’ responsibility with respects to final editing of and review of all deliverables, and accountability for all content, errors, and omissions.

FACTOR 4 - SAFETY:

1. Basis of Evaluation: The Government is seeking to determine whether the Offeror has an acceptable safety record.

The Government will evaluate the Offeror’s overall safety record as evidenced by the TRC and DART rates, if the Offeror’s plan includes safety in the evaluation and selection of subcontractors, and if the narrative includes a plan to monitor the safety performance of subcontractors during performance. The evaluation will collectively consider the following:

2. OSHA Total Recordable Case (TRC) Rate: The Government will evaluate the OSHA TRC Rate to determine if the Offeror’s OSHA TRC rate is above 4.0 and extenuating circumstances that impact the rates. OSHA TRC rates above 4.0, in any of the previous five years (July 2008 – July 2013), will be considered UNACCEPTABLE, unless an adequate explanation is provided to address the extenuating circumstances that affected the rate.

3. OSHA Days Away from Work, Restricted Duty, or Job Transfer (DART) Rate: The Government will evaluate the OSHA DART Rate to determine if the Offeror’s OSHA DART rate is above 2.0 and extenuating circumstances that impact the rates. OSHA DART rates above 2.0, in any of the previous five years (July 2008 – July 2013) will be considered UNACCEPTABLE, unless an adequate explanation is provided to address the extenuating circumstances that affected the rate.

4. Technical Approach to Safety: The Government will evaluate the narrative to determine if subcontractor safety performance will be considered in the qualification, evaluation, selection, of all levels of subcontractors on the upcoming project, and both the plan to monitor the safety of those subcontractors during contract performance, highlighting what specific management practices will be in place for providing deliberate safety program management and mishap prevention support to those sub-contractors whose EMR is greater than 1.0, whose TRC is greater than 4.0 and whose DART rate is greater than 2.0. Offerors who fail to address either of these items (i.e.

whether the safety performance of subcontractors will be evaluated in the selection process for all levels of subcontractors and whether the safety of those subcontractors will be monitored during contract performance) will be rated UNACCEPTABLE.

1. Basis of Evaluation: The degree to which past performance evaluations and all other past performance information reviewed by the Government (e.g., PPIRS, Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), performance recognition documents, and information obtained from any other source) reflect a trend of satisfactory performance considering:

- A pattern of successful completion of tasks;

- A pattern of deliverables that are timely and of good quality;

- A pattern of cooperativeness and teamwork with the Government at all levels

(Task Managers, Contracting Officers, Auditors, etc.);

- Recency of tasks performed that are identical to, similar to, or related to the task at hand; and

- A respect for stewardship of Government funds

FACTOR 6 - PRICE:

1. Basis of Evaluation: The Government will evaluate price in accordance with FAR 15.404 and DFARS 215.404.

Price evaluation will be based on the total price for ELINs with an estimated quantity. The offeror’s total price will be determined by multiplying the proposed unit price by the estimated quantities for each ELIN and then adding the ELINs together to calculate the total price for the base year and all option periods (See the Revised Schedule of Services and Price Proposal Spreadsheet, Exhibits A-E). The total price will not include ELINs that do not have an estimated quantity. In the event there is a difference between a unit price and the extended total amount, the unit price will be held to be the intended price, and the total for the ELIN will be recomputed accordingly. Offerors shall ensure extended totals are accurate.

2. In addition, all proposed unit prices may be evaluated for unbalanced pricing in accordance with FAR 15.404- 1(g). Unbalanced pricing exists when, despite an acceptable total price, the price of one or more exhibit line items appear to be significantly overstated or understated as indicated by the application of price analysis techniques. An offeror’s proposal may be rejected if the Contracting Officer (CO) determines the lack of balance poses an unacceptable risk to the Government in accordance with FAR 15.404-1(g)(3).

3. The Government intends to evaluate all options and has included the provision FAR 52.217-5, Evaluation of Options (JUL 1990) in Section M of the solicitation. In accordance with FAR 52.217-5, Evaluation of Options will not obligate the Government to exercise the option(s).

4. Price Analysis will be performed by utilizing one or more of the following techniques to ensure a fair and reasonable price:

a. Comparison of proposed prices received in response to the RFP

b. Comparison of proposed prices with the IGCE

c. Comparison of proposed prices with available historical information

Comparison of market survey results
