Any requested changes to the Request for Proposal or clarifications discussed today shall be documented in writing and distributed to all parties prior to submission of proposals.

4. CONTRACTUAL BACKGROUND – Contract Specialist

Solicitation: N62470-22-R-9013 was issued Friday, August 5, 2022. The proposal due date is Monday, October 3, 2022 (2:00 PM EDT). This acquisition will result in a firm-fixed price (FFP)/indefinite delivery indefinite quantity (IDIQ) multiple award contract for the ordering of new, and the overhaul of existing, weight handling equipment (WHE) of varying types and lifting capacities for Navy, Marine Corps and other federal activities worldwide. The contract will be for a not to exceed amount of $60M with a base year and 4 option years.

Each contract awarded has a $10,000 minimum guarantee which will be met by the initial delivery order awarded under each contract. All awardees shall be required to submit competitive proposals for all future delivery orders.

This procurement is a small business set-aside.

This solicitation includes a seed project to be awarded as the first delivery order along with the basic contract. The seed project provides for the design, fabrication, installation, testing, and operational training of One (1) 50T Overhead Electric Traveling Bridge Cranes with Two (2) Top Running Trolleys at Portsmouth Naval Shipyard. The specification requirements for the sample project are contained as Attachment J1 of this solicitation.

Some of the details above will be explained in further detail below by the Project Manager.

The acceptance period for this solicitation shall be no less than 120 calendar days. Section 12 of the SF33 shall conform to the Government’s 120-day acceptance period, unless a longer acceptance period is proposed by the Offeror. Offerors providing less than the minimum 120 calendar days for Government acceptance after the date offers are due may not be considered.

Contract Completion Date: The contract completion date for the seed project is 480 days from contract award including delivery, installation, and Government acceptance.

Wage Determination: This delivery order is subject to the 41 U.S.C. Chapter 65, Contracts for Materials, Supplies, Articles and Equipment Exceeding $15,000 (the statute) and may include construction in connection with on-site work. The Construction Wage Rate Requirements apply to all on-site work and are provided as Attachment J8 to the RFP.

Basis of Award & Source Selection: This procurement will be accomplished using Best Value Source Selection tradeoff procedures and will be conducted in accordance with Part 15 of the Federal Acquisition Regulation (FAR). Award will be made to the responsible Offeror(s) whose offer conforms to the solicitation and represents the best value to the Government, price and non-price related factors

Revised August 2022 Page 5 of 12 considered. The Best Value Source Selection process permits tradeoffs among price and non-price related factors, which allows the Government to accept other than the lowest priced proposal when the perceived benefits of the higher priced proposal merit the additional cost. The tradeoff process is discussed in FAR Part 15.101-1.

Evaluation factors for this acquisition include Corporate Experience, Past Performance and Safety. The relative order of importance of the non-cost/price evaluation factors is the technical factors (Factors 1 and

3) are of equal importance to each other and when combined are equal in importance to the past performance evaluation/performance confidence assessment factor (Factor 2). When the proposal is evaluated as whole, the technical factors and past performance confidence assessment factor combined (i.e., the non-cost/price evaluation factors) are approximately equal to price. The importance of price will increase if the Offeror’s non-cost/price proposals are considered essentially equal in terms of overall quality, or if price is so high as to significantly diminish the value of a non-cost/price’s superiority to the Government. Offerors should respond specifically to the factor submittal requirements as described in the RFP (refer to Section L and Section M of the solicitation). Failure to do so or to deviate from the RFP requirements may result in a less than favorable rating and could prevent an opportunity to receive a contract award if discussions are not conducted.

The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). The Government reserves the right to conduct discussions if deemed necessary.

The Government reserves the right to eliminate from consideration for award any or all offers at any time prior to award of the contract(s); to negotiate with offerors in the competitive range; and to award the contract(s) to the offeror submitting the proposal(s) determined to represent the best value—the proposal(s) most advantageous to the Government, price and other factors considered.

Proposals: Proposals are due on Monday, October 3, 2022 at 2:00PM EDT. As stated in the solicitation, Offerors shall submit one electronic copy of their proposals via the Procurement Integrated Enterprise Environment (PIEE) Solicitation Module at https://piee.eb.mil. Proposals received after the proposal due date and time will not considered or evaluated for receipt of award. The Government will not be responsible for any failure of receipt of the proposals or any failure of the Offeror to verify receipt of the proposals. Any submissions by any other method in place of the PIEE Solicitation Module WILL NOT be accepted and will not be evaluated. In order to submit your proposal on the PIEE Solicitation Portal, Offerors will first need to register for the PIEE ‘Proposal Manager’ role. For step-by-step instructions, see “Vendor Access Instructions” at https://dodprocurementtoolbox.com/site-pages/solicitation-module. It is strongly recommended that Offerors register well in advance of the proposal due date, so there is ample time to resolve potential registration issues that may arise. Proposals should be submitted in two readily severable parts as follows and as stated in the solicitation: Non-Price Proposal and Price Proposal.

Bid Bond Requirement: A bid guarantee in accordance with FAR 52.228-1 is required for this solicitation. If a bond is submitted as the form of guarantee, it shall be submitted on Form 24, Bid Bond, in the amount of 20% or $3,000,000, whichever is less.

Reps & Certs: In order to be eligible for award, prospective Offerors shall register in the Systems for Award Management (SAM) database in accordance with FAR 52.204-7.

Wide Area Workflow (WAWF): WAWF is the Department of Defense’s secure web-based system and is NAVFAC’s method for electronic submission of vendor/contractor invoices, government receipt, acceptance and certification. The successful Offeror will be required to utilize WAWF for invoicing. All payments will be processed electronically through WAWF. The proposal pricing and contract award for

Revised August 2022 Page 6 of 12 the initial seed project delivery order will be based on customary progress payment financing, but the Government will be willing to modify the contract with the successful offeror to use performance-based payments if they are determined to be practical by the contracting officer, the contractor agrees to their use, and adequate consideration is received by the Government.

Debriefing Procedures: Debriefing procedures are discussed in FAR Subpart 15.5. A debriefing is a meeting between Government personnel and successful or unsuccessful offerors to explain the rationale for the contract award decision, explain to unsuccessful offerors why they were not selected for award, instill confidence in offerors that they were treated fairly, assure offerors their proposals were evaluated in accordance with the solicitation and applicable laws and regulations, identify weaknesses in offeror’s proposals so they can prepare better proposals in the future, reduce misunderstandings, instill confidence in the Source Selection process, and avoid the cost to both parties and the potential impact to the Navy’s mission of protests.

A debriefing is not a point-by-point comparison of one offeror’s proposal to another’s proposal. Only the successful offeror’s overall cost or price can be disclosed in the debriefing process.

A debriefing is also not a debate over the award decision or evaluation results.

Debriefings can be done orally or in writing. It is our preference to have oral debriefings so that information can be fully understood through an open dialogue. Due to the administrative burden of duplicating debriefings, an offeror will be afforded only one type of debriefing, written or oral.

Debriefings may take place before contract award (Pre-Award Debriefing) if an offeror is being eliminated from the competitive range or after contract award (Post-Award Debriefing). Offerors should review and understand their rights as they pertain to requesting debriefings and the limitations on information that can be released during a Pre-Award Debriefing versus a Post-Award Debriefing.

Preaward notifications are given to offerors whose proposals fall outside the competitive range to inform them that a decision has been made not to further consider their proposals for award and to prevent them from spending more time, money, and resources pursuing the acquisition from which they are being eliminated.

Within 3 days after award, the Government is required to notify in writing all unsuccessful offerors whose proposals were in the competitive range. The notice must include the number of offerors solicited, the name and address of each offeror receiving an award, the items, quantities, and any stated unit prices of each award. If the quantity of items or other factors makes listing unit prices impracticable, only the total contract price need be furnished. The items, quantities and any stated unit prices for each award must be made publicly available upon request. An offeror may request a debriefing within writing 3 days of being notified that it is being excluded from the competitive range, or that contract award has been made.
