Section L - Instructions, Conditions and Notices to Bidders

INSTRUCTIONS TO OFFERORS

INSTRUCTIONS TO OFFERORS

PART A: GENERAL INSTRUCTIONS

1.0 GENERAL

1.1 Section L contains instructions on how to prepare and submit proposals in response to this solicitation. Nonconformance with these instructions may result in an unfavorable proposal evaluation and elimination from consideration for award.

1.2 The government will base its evaluation on the information presented in the Offeror's proposal. The

Offeror has the burden to submit a proposal that convincingly demonstrates that the Offeror has an accurate understanding of the requirements and the associated risks; that the Offeror has viable solutions for the requirements and potential risk areas; and that the Offeror is able, willing and competent to devote the resources necessary to meet the requirements.

1.3 It is the Offeror’s responsibility to submit a proposal that enables government evaluators to effectively evaluate and substantiate the validity of any assertions set forth in the Offeror’s proposal. Assume the government has no prior knowledge of an Offeror’s facilities and experience. Accordingly, do not simply rephrase or restate the government's requirements. Regurgitating the Statement of Work, any Government Instruction, guideline documents or standards are inadequate and will adversely impact the government’s evaluation assessment of the Offeror.

1.4 Alternate proposals are not acceptable. In addition, taking exception or deviating or requesting waivers (including making assumptions and conditions that may be construed as taking exception, deviation or waiver) from any term or condition of the RFP may make an offer unacceptable, and the proposal unawardable, unless the RFP expressly authorizes such an exception or deviation with regard to that specific term or condition.

1.5 There is no need to repeat information in the same volume or in more than one volume. If an overlap exists, the detailed information should be included in the most logical place and summarized and referenced in other areas. No cost or pricing information other than the information required at Section L.B.1.1(c) should appear in the Past Performance volume.

2.0 PROPOSAL FORMAT

Written proposals must be formatted using a Times New Roman 12-point normal font, no reduction permitted, single-spaced, 1-inch margins all around, and formatted for standard 8.5 x 11 inch paper. All pages should be numbered and labeled according to the proposal volume. Attachments to the proposals shall follow the same format described above. When foldout pages are used, they must not exceed 11 x 17 inches and will be counted as 1 page. Drawings may be provided separately and may be any size, but should be folded to approximately 8.5 x 11 inch standard size and will count as 1 page. Graphs, drawings, graphics, tables and figures shall be presented in no smaller than a 10-point font and shall be labeled. The proposal cover sheet shall include the company name as it appears in the TDPC IDIQ contract and include the CAGE and DUNS codes. BE CONSISTENT!

3.0 PROPOSAL VOLUMES

3.1 All proposals must be UNCLASSIFIED. Each volume of the proposal shall be submitted as one paper original with additional paper and separate Compact Disk Read-Only Memory (CD-ROM) copies as specified in the table below.

3.2 The separate CD-ROM copy of the Past Performance Volume shall be fully compatible with

Microsoft Office 2016 products. Do not submit in .pdf format unless information is not supported by Microsoft Office products (e.g., drawings, attachments such as CDRLs,). Any information provided in portable document format (.pdf), shall be a fully searchable .pdf using the latest Adobe Acrobat on each CD-ROM. . For information not supported by Microsoft Office products (e.g., drawings, attachments such as CDRLs), the Offeror must provide the information in a fully searchable portable document format (.pdf) using the latest Adobe Acrobat on each CD-ROM. Do not submit in copy or picture format and do not submit attachments files (e.g., CPARS, SOW copy, contract document copy) using .jpeg (or similar) or picture copy pasted in a Word document or .pdf. All proposal files shall be fully searchable.

The separate CD-ROM copy of the Price Volume must be provided in or be compatible with Microsoft Office 2016 Word and Excel (if applicable) format, with spreadsheets unprotected and showing all computations and formulas (if applicable.) The price files shall be fully searchable. Each separate CD-ROM is to be labeled for content and the Offeror’s name. If a discrepancy exists between the original paper version of the proposal and a CD-ROM “copy,” the paper original will take precedence.

3.3 Page limitations for each volume are specified in the table below. Proposal pages beyond the specified limit will not be evaluated. Title/cover pages, table of contents, lists of figures/tables, divider tabs, and worksheets do not count towards the page limit.

Volume Number

Volume Title Page Limit Copies Required

1 PAST PERFORMANCE As needed (no page limit)

1 Paper Original 2 Paper Copies 2 CD-ROM Copies

2 PRICE As needed (no page limit)

1 Paper Original 2 Paper Copies 2 CD-ROM Copies

3.4 There is no Technical proposal required or desired.

3.5 Submission of past performance supporting documentation (in accordance with Section L, Part B, 1.2.g) in electronic format only as part of the CD-ROM submission for the Past Performance Volume is acceptable.

4.0 SOLICITATION QUESTIONS

Questions regarding this solicitation shall be submitted in writing with the use of Attachment L-1. Each question or comment should reference the applicable document, page number, and paragraph number. Do not include any proprietary information in your question, because the government will provide the question and answer to all potential Offerors. All questions must be submitted for the solicitation no later than 5:00 pm EDT on 22 July 2019 to Mr. Austin Brookshire, Contract Specialist, at austin.brookshire@navy.mil (407-380-8192) and carbon copy Mr.

Ricardo Elias, at ricardo.l.elias@navy.mil (407-380-4101). The government is under no obligation to try to answer questions received after that date, but may answer the questions if time permits.

5.0 PROPOSAL SUBMISSION

5.1 Clearly mark all packages with the solicitation number. The submission date for the proposal shall be no later than the date and time specified in Block 9 of Standard Form 33 of the RFP. Offerors shall not submit proposals by facsimile or via email.

5.2 Proposals Submitted by Commercial Carrier: Offerors shall submit proposals via United States

Postal Service or through a commercial carrier using the following address:

Naval Air Warfare Center Training Systems Division Code: AIR-2.5.3.1.1 Austin Brookshire Tel. (407) 380-8192 12211 Science Drive Orlando, FL 32826 Solicitation Number: N6134019R0022 mailto:austin.brookshire@navy.mil

5.3 Hand Carried Proposals: Hand carried proposals must be delivered to the address above, attention Austin Brookshire, 407-380-8192. A visit request may be obtained by contacting Mr. Austin Brookshire, Contract Specialist, at austin.brookshire@navy.mil (407-380-8192). Upon arrival to NAWCTSD, please contact Austin Brookshire from the lobby phone. In the event that Mr. Brookshire is not available, please contact the alternate point of contact, Mr. Ricardo Elias, at ricardo.l.elias@navy.mil (407-380-4101).

5.4 Late Proposals:

(a) Definitions. As used in this provision—

“Proposal modification” is a change made to a proposal before the solicitation’s closing date and time, or made in response to an amendment, or made to correct a mistake at any time before award.

“Proposal revision” is a change to a proposal made after the solicitation closing date, at the request of or as allowed by a Contracting Officer.

“Time,” if stated as a number of days, is calculated using calendar days, unless otherwise specified, and will include Saturdays, Sundays, and legal holidays. However, if the last day falls on a Saturday, Sunday, or legal holiday, then the period shall include the next working day.

(b) Amendments to solicitations. If this solicitation is amended, all terms and conditions that are not amended remain unchanged. Offerors shall acknowledge receipt of all amendment to this solicitation by the date and time specified in the amendment(s).

(c) Submission, modification, revision, and withdrawal of proposals. Offerors are responsible for submitting proposals, and any modifications or revisions, so as to reach the government office designated in the solicitation by the time specified in the solicitation.

(1) Any proposal, modification, or revision received at the government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition, and—

(i) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of proposals; or

(ii) There is acceptable evidence to establish that it was received at the government installation designated for receipt of offers and was under the government’s control prior to the time set for receipt of offers; or

(iii) It is the only proposal received.

(2) However, a late modification of an otherwise successful proposal that makes its terms more favorable to the government will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of government personnel.

(4) If an emergency or unanticipated event interrupts normal government processes so that proposals cannot be received at the office designated for receipt of proposals by the exact time specified in the solicitation, and urgent government requirements preclude amendment of the solicitation, the time specified for receipt of proposals will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal government processes resume.

(5) Proposals may be withdrawn by written notice received at any time before award.

(6) Offerors may submit modifications to their proposals at any time before the solicitation closing date and time, and may submit modifications in response to an amendment, or to correct a mistake at any time before award.

(7) Offerors may submit revised proposals only if requested or allowed by the Contracting Officer.

(8) Proposals may be withdrawn at any time before award. Withdrawals are effective upon receipt of notice by the Contracting Officer.

mailto:michael.e.weaver@navy.mil

(9) A written award or acceptance of proposal mailed or otherwise furnished to the successful Offeror within the time specified in the proposal shall result in a binding delivery order without further action by either party.

5.5 Restriction on Disclosure and Use of Data: Offerors that include in their proposals data that they do not want disclosed to the public for any purpose, or used by the government except for evaluation purposes, shall—

(a) Mark the title page with the following legend:

This proposal includes data that shall not be disclosed outside the Government and shall not be duplicated, used, or disclosed—in whole or in part—for any purpose other than to evaluate this proposal. If, however, a delivery order is awarded to this Offeror as a result of — or in connection with — the submission of this data, the Government shall have the right to duplicate, use, or disclose the data to the extent provided in the resulting delivery order. This restriction does not limit the Government's right to use information contained in this data if it is obtained from another source without restriction. The data subject to this restriction are contained in sheets [insert numbers or other identification of sheets]; and

(b) Mark each sheet of data it wishes to restrict with the following legend:

Use or disclosure of data contained on this sheet is subject to the restriction on the title page of this proposal.

6.0 PROPOSAL PACKAGING

The Offeror shall package the proposal volumes in cartons or equivalent packaging containers in the most efficient manner possible, grouping like-volumes to the maximum extent possible. Each container shall be single-person portable. One container shall include all original proposal volumes. Each box shall include a packing slip detailing the contents, to include the solicitation number, volume number, title, and copy number. Also, each box should be stamped or marked “For Official Use Only.”

PART B: SPECIFIC INSTRUCTIONS

1.0 VOLUME 1: PAST PERFORMANCE

1.1 PAST PERFORMANCE SUBMISSION INFORMATION

a) The offeror shall NOT submit past performance contract references that include supporting documentation that isare CLASSIFIED as the Government needs to be able to easily obtain and review information pertaining to past performance. The offeror shall provide a “Past Performance Contract Reference Worksheet,” Attachment L-2.

b) The offeror shall identify a maximum of five (5) relevant government or commercial past performance contract references for the government’s evaluation of the offeror’s relevant recent past performance. Up to three (3) of the five (5) references may be provided for principal team members, with a maximum of two

(2) references provided for a single principal team member. A “principal team member” for purposes of the past performance evaluation factor is defined as a subcontractor, joint venture owner (joint venturer), partnership owner (partner), corporate parent, division, subsidiary, affiliate or vendor that is demonstrably proposed to provide at least 20% of the total contract price (inclusive of options).

An offeror will not receive past performance credit for a proposed principal team member unless the offeror’s proposal demonstrates how the resources of that principal team member – its workforce, management, facilities or other resources – will in fact be provided to perform at least 20% of the total contract price. Merely stating that the offeror has access to the resources of a principal team member is insufficient. The government will not evaluate the past performance of any company other than the prime and principal team member. Thus, the CAGE code, DUNS number, or corporate name and address of a prime or principal team member must match the CAGE code, DUNS number, or corporate name and address on the cover page of the prime’s or principal team member’s past performance contract reference proposed for past performance evaluation.

A prime or principal team member that submits a past performance contract reference with a CAGE code, DUNS number, or corporate name and address on the face page of the past performance contract reference that does not match the prime or principal team member’s CAGE code, DUNS number, or corporate name and address places the government in the undesirable position of being subjected to a potential protest regardless of who receives the award. As such, submitted past performance contract references with a CAGE code, DUNS number, or corporate name and address on the face page of the past performance contract reference that does not match the prime or principal team member’s CAGE code, DUNS number, or corporate name and address will receive a Not Relevant rating and will not be allowed to replace the submitted past performance contract reference with another past performance contract reference for evaluation.

Past performance contract references where supplies and services were sold or transferred between corporate divisions, subsidiaries, or affiliates of a contractor will not be considered unless the interorganizational transfer is identified in the form of a written agreement between the corporate divisions, subsidiaries, or affiliates -- such as a subcontract, purchase agreement, job order, or similar type written agreement – with the prime or principal team member's CAGE code, DUNS number, or corporate name and address on the cover page of the written agreement.

c) The offeror shall complete a table similar to the one below and submit it within this volume. This table should summarize the prime, its principal team members, and subcontractors, joint venture owner (joint venturer), partnership owner (partner), corporate parent, division, subsidiary, affiliate or vendors’ name and proposed price, CAGE Codes / DUNS numbers, (not proposed to perform at least 20% of the total proposed contract price) roles and responsibility as well as their work description, and the % of the total contract price it is identified to propose for the instant solicitation contract.

Offeror:

Contractor Name and Proposed Price CAGE Codes /DUNs Roles &

Responsibilities with Work Description

% of Total Proposed Price e.g. ABC Inc., $20,000,000 12345 ICW Courseware Development

20% (assumes $100M total proposed price)

Total Proposed Price (must add up to 100%) 100%

d) As set forth in Section M of this solicitation, the government will evaluate the relevancy and demonstrated past performance of the past performance contract references to arrive at a Performance Confidence Assessment for the offeror.

e) The government is evaluating past performance of the offeror (i.e., entity identified in Block 15A of Standard Form 33) and any proposed principal team member proposed to perform the instant solicitation requirements proposed to provide at least 20% of the total contract price (inclusive of options)).

f) Any submitted past performance contract reference must contain performance within five (5) years of the RFP release date specified in Block 5 of Standard Form 33 of the RFP. Performance that took place greater than five years from the RFP issuance date will not be considered unless a portion of the performance falls within the five years stated herein. The entire contract period of performance will be considered, even if only a portion of performance falls within the five year period, with the understanding that more recent performance is generally more relevant than less recent performancehas more weight on a Performance Confidence Assessment. Submitted past performance contract references without performance within this specified period will not be considered relevant by the Government.

It is possible that an older past performance contract reference with performance that barely crosses into the five-year period (see above) could be determined Not Relevant, depending upon the work that was actually delivered or provided during that time period. For example, for a trainer or training device delivery contract that also requires courseware delivery, a past performance contract reference that performed trainer deliveries could be determined Not Relevant if the only item delivered during the period of time that crosses into the five-year mark is, for example, initial support services, the trainer services, or the trainer/training device. The offeror shall demonstrate that the relevant items on the past performance contract reference have been delivered.

g) The offeror should provide written consent from its principal team members that will allow the Government to coordinate any of those entities’ past performance issues with the offeror. If the offeror does not submit such written consent, then the Government will address any past performance issues directly with the principal team member and the offeror will forfeit the opportunity to participate in any related discussions.

Consequently, for any principal team members that do not provide such written consent, provide a point of contact name, address, phone number and email address with whom the Government may coordinate past performance issues.

h) The offeror shall forward one (1) copy of the Past Performance Questionnaire (PPQ), Attachment L-3, to the past performance contract reference customer’s Procuring Contracting Officer (PCO), Administrative Contracting Officer (ACO), Program Manager or Technical Point of Contact ─ via email and carbon copy (cc:) to the Contract Specialist identified in Section L A 4.0─ for the following past performance contract references:

• Past performance contract references that do not have CPARS Reports, and

• Past performance contract references where the most recent CPARS Report completed by the Assessing Official is dated more than 12 months prior to the RFP’s release date and is not the final CPARS Report.

The offeror shall make sure that its Government Past Performance POCs are current to avoid any delays in the completion and submission of the PPQs to the Contract Specialist.

All PPQ’s shall be forwarded within 14 calendar days from the RFP release date, with a copy forwarded to the Contract Specialist. The offeror shall include instructions for its government customers to send completed questionnaires within two weeks of the customer’s receipt of the questionnaire to Mr. Austin Brookshire, Contract Specialist, via email at austin.brookshire@navy.mil, and carbon copy to ricardo.l.elias@navy.mil.

The offeror shall NOT complete the PPQ, but submit to its government customer for completion; and then its customer is to return it to Mr. Austin Brookshire directly via email.

i) To evaluate past performance, the government may use information other than information provided by the offeror in its proposal, and may use past performance information obtained from sources other than those identified by the offeror.

j) The offeror has the burden of providing thorough and complete past performance information. It is incumbent upon the offeror to explain the relevance of data provided in its proposal. The government has no duty to search for additional data to cure problems the government finds in the information provided by the offeror. For past performance contract references that are still ongoing in performance, the offeror shall demonstrate that relevant delivery has been made on those contracts.

mailto:austin.brookshire@navy.mil

k) Regardless of relevancy, the offeror shall provide a list of Show Cause Notices, Cure Notices, and

Terminations for Default received on any contract, task order, or delivery order within the past two (2) years of the RFP release date.

l) Provide the information identified below in a Microsoft (MS) Word Table for each of the five (5) references identified.

1 Relevant. The past performance contract reference dollar amount relevant to the scope requirement of the instant solicitation.

1 2 Relevant. Include relevant dollar amount already performed as it relates to scope and magnitude required in this solicitation under paragraph L.B.1.2. below.

2 3 Place of Performance should be the location of the government or contractor’s facility where the predominance of the work was performed.

3 4 The CAGE code, DUNS number, and/or the corporate name and address on the face-page of the prime’s past performance contract reference shall be the same CAGE code, DUNS number, and/or corporate name and address for the prime offeror entity identified in Block 15A of Standard Form 33. Similarly, the CAGE code, DUNS number, and/or the corporate name and address on the face page of the past performance contract reference that is performed by a principal team member shall be the same CAGE code, DUNS number, and/or corporate name and address for the proposed principal team member.

4 5 As part of its Past Performance Volume, the offeror shall provide printed CPARS that are referenced in the table.

5 6 The offeror shall ensure to validate and provide the Past Performance Contract Reference current point of contact person.

m) For a principal team member, compare the scope and magnitude of that principal team member’s contract to the scope and magnitude of the effort the principal team member is proposed to perform for this instant solicitation.

n) Task order (TO) or delivery orders (DO) awarded under Multiple Award Contracts (MACs) will be considered standalone “contracts” for purposes of past performance evaluation. Thus, offerors may not propose an entire MAC as a past performance contract reference.

o) For a single-award indefinite delivery past performance contract, offerors may propose the entire basic contract as a past performance contract reference, or may propose a specific task or delivery order as a past performance contract reference. If an offeror proposes an entire single-award indefinite delivery contract as a past performance contract reference, however, the offeror must provide the past performance information below for the three (3) most relevant delivery orders/task orders issued under that single-award indefinite delivery contract, and those three orders will count as one past performance contract reference. The offeror shall provide a Past Performance Contract Reference Worksheet, Attachment L-2 in support of the above past performance contract references.

1.2 RELEVANCY INFORMATION OF THE PAST PERFORMANCE CONTRACT

REFERENCES

For each past performance contract reference, provide the following information on the “Relevancy Information of the Past Performance Contract Reference Worksheet,” Attachment L-4.

a) Contract Type: Compare the contract type (e.g., FFP, CPFF, CPAF, etc.) of the past performance contract reference to the contract type of this solicitation’s effort.

b) Total Dollar Amount of Past Performance Contract Reference: Compare the total dollar amount of the past performance contract reference to the proposed amount the prime or principal team member is proposing to complete for the instant solicitation requirement. The amount the prime or principal team member is proposing to complete for the instant solicitation requirement shall match the amount identified in Section L.B.1.1.c. The past performance contract reference dollar amount compared to the instant solicitation requirement shall be the dollar amount relevant to the scope requirement reflected above. The instant solicitation (i.e., this solicitation) is estimated at a total of $86 million, inclusive of Options.

c) Relevant Dollar Amount Actually Performed (this is for effort already performed): Compare the Relevant dollar amount of the past performance effort actually performed by the Prime or principal team member under the past performance contract reference to the dollar amount of the effort proposed to be performed by the Prime or principal team member under this solicitation’s effort. The offeror shall express this number in terms of total dollars and in terms of percentage of total effort. If the past performance contract reference is still in performance, provide the relevant amount up to the RFP Release Date stated on block 5 of Standard Form 33 of the RFP, and indicate if a delivery has been completed.

d) Locations and Divisions (include CAGE and DUNS): Compare the location and division of the company that performed the past performance contract reference effort to the location and division of the company that is proposed to perform this solicitation’s effort. Note: Location and Division of the past performance contract reference shall be the same as the Location and Division performing this instant solicitation.

e) Period of Performances: Compare the period of performance of the past performance contract reference to the period of performance actually performed under that past performance contract reference for the prime or principal team member.

f) Compare Similarities: Compare the similarity of the product or service actually performed by the prime or principal team member under the past performance contract reference to the product or service proposed to be performed by the prime or principal team member under this solicitation’s effort in the following two areas:

1. Scope – The offeror shall compare the scope of the work performed in the prime or principal team members’ past performance contract reference’s Statement of Work (SOW), Performance Work Statement (PWS), Statement of Objectives (SOO), and/or Specification, CDRLs, and Contract document to the requirements under this solicitation’s Statement of Work regarding activities in the designing, developing and delivering of interactive courseware (ICW) as defined in Appendix C, “terms and Definitions,” and reflected in the instant solicitation’s SOW Scope paragraph 1.0, Figure 2, following an ADDIE (Analysis, Design, Development, Implementation, Evaluation) process similar to the process reflected in the instant solicitation SOW Scope paragraph 1.0, Figure 1. Please note, analysis effort is not required nor will be considered for evaluation purposes. Supporting SOW paragraphs are Design Phase (SOW 3.3.1), Development Phase (SOW 3.3.2), Implementation Phase (3.3.3), Evaluation Phase (3.3.4) and 3.4, Systems Engineering of the instant solicitation SOW. Please identify whether the Past Performance contract reference requires the delivery of ICW or is a service effort. The prime or principal team member shall include its rationale in the “Relevancy Information of the Past Performance Contract Reference Worksheet,” Attachment L-4, under the “Scope of Effort” Section.

2. Magnitude — The prime or principal team member shall compare the total relevant dollar amount of the past performance contract reference to the amount it is proposing to complete for the instant solicitation requirement (this amount shall match the amount identified in Section L.B.1.1.c). The instant solicitation (i.e., this solicitation) is estimated at a total of $86 million, inclusive of Options.

g) Supporting documentation. To support the prime and principal team members’ comparison of the past performance contract references’ product or service similarities to the instant solicitation’s work, offerors shall provide one copy of the contract or subcontract and its contract line items, Statement of Work, Performance Work Statement, Specifications, Statement of Objectives, and/or Contract Data Requirements Lists (CDRLs). The government does not want to receive invoices, DD250s, or any other document that is not an attachment to the past performance contract reference. The copies of the past performance contract reference shall be provided in fully searchable files (MS Word or .pdf) as required in Sections L. Offerors are required to cite specific paragraphs and Contract CLIN(s) from their provided documentation in the corresponding Attachment L-4 worksheet to support the prime and principal team members’ comparison of the past performance contract references’ similarities to the instant solicitation’s work.

1.3 DEMONSTRATED PERFORMANCE INFORMATION OF THE PAST PERFORMANCE

CONTRACT REFERENCES

a) For each past performance contract reference, the offeror shall provide available CPARS or Past Performance

Questionnaires that address the following demonstrated past performance areas:

Quality of Product or Service. The prime or principal team member’s past performance in the delivery of quality supplies and services, which includes meeting technical requirements.

Schedule. The prime or principal team member’s past performance in meeting schedule requirements, to include on-time or late deliveries, modifications of original schedules.

A "Qualified U.S. Contractor" is a private individual or enterprise (hereinafter described as a "U.S. Contractor") that, in accordance with procedures established by the Under Secretary of Defense for Research and Engineering, certifies as a condition of obtaining export-controlled technical data subject to the Directive from the Department of Defense, that:

(1) The individual who will act as recipient of the export-controlled technical data on behalf of the U.S.

The purpose for which the data are needed shall be described sufficiently in such certification to permit an evaluation of whether subsequent requests for data are related properly to such business purpose.

(3) The U.S. Contractor acknowledges its responsibilities under U.S. export control laws and regulations (including the obligation, under certain circumstances to obtain an export license prior to the release of technical data within the United States) and agrees that it will not disseminate any export-controlled technical data subject to the Directive in a manner that would violate applicable export control laws and regulations.

(4) The U.S. Contractor also agrees that, unless dissemination is permitted by the Directive, it will not provide access to export-controlled technical data subject to the Directive to persons other than its employees or persons acting on its behalf, without the permission of the DoD component that provided the technical data.

(5) To the best of its knowledge and belief, the U.S. Contractor knows or no person employed by it, or acting on its behalf, who will have access to such data, who is debarred, suspended or otherwise ineligible to perform under U.S. Government contracts; or has violated U.S. export control laws or a certification previously made to the Department of Defense under the provisions of the Directive.

(6) The U.S. contractor itself is not debarred, suspended, or otherwise determined ineligible by any agency of the U.S. Government to perform on U.S. Government contracts, has not been convicted of export control law violations, and has not been disqualified under the provisions of this Directive.

Section M - Evaluation Factors for Award

EVALUATION FACTORS FOR AWARD

PART A: GENERAL INFORMATION

1.0 Basis for Award

1.1 The government intends to award a delivery order to the responsible offeror whose proposal conforms to the solicitation’s requirements and is the most advantageous to the government based upon an integrated assessment of the evaluation Factors described further below.

1.2 The government does not evaluate every requirement of the solicitation under Section M of the RFP.

The awarded contractor, however, is required to comply with all requirements of the awarded delivery order.

Regardless of proposal submission requirements, delivery order performance will require execution of all requirements set forth in the delivery order.

1.3 Although the government may waive informalities and minor irregularities in proposals received, the failure to comply with terms and conditions of the solicitation may adversely impact the offeror’s evaluation results, and could result in the offeror being removed from consideration for award.

2.0 Offeror Responsibility to Submit an Unambiguous, Convincing Proposal

2.1 It is the offeror’s responsibility to draft a logical, unambiguous proposal that contains all pertinent information in sufficient detail so that government evaluators are able to meaningfully evaluate the offeror’s entire proposal.

3.0 Formal Source Selection Procedures Do Not Apply

3.1 Companies have informed NAWCTSD at regularly held local industry meetings that they want NAWCTSD to reduce the bid and proposal dollars they spend to respond to NAWCTSD’s solicitations. NAWCTSD does not want to waste its industry partners’ bid and proposal dollars or NAWCTSD’s resources. As a result, this delivery order evaluation and award is a streamlined evaluation and award conducted pursuant to FAR § 16.505. This streamlined evaluation and award contains fewer proposal submission requirements, a reduced page limitation, and is not being conducted using the formal source selection procedures of FAR Subpart 15.3.

3.2 Because this streamlined evaluation and award is not using the formal source selection procedures of FAR Subpart 15.3, procedures such as a competitive range determination, pre-award notifications to offerors excluded from a competitive range, pre-award debriefings, oral or written discussions with all offerors within a competitive range, and requesting final proposal revisions from all offerors included within a competitive range are not required. The identification of deficiencies and weaknesses, the government’s questions and comments, and the offeror’s answers and responses do not constitute discussions, clarifications, communications, or exchanges as used in FAR Subpart 15.3.

3.3 Under FAR § 16.505, the government is required to afford all offerors under the Multiple Award

Contract a fair opportunity to submit an offer and have that offer fairly considered. Accordingly, the government will evaluate each offeror’s proposal fairly, similarly, and in accordance with the solicitation’s evaluation criteria. If the government does not award on initial proposals, however, the government will not establish a competitive range comprised of all of the most highly rated proposals. Accordingly, the offeror’s initial proposal must contain the offeror’s best terms, conditions, and prices. Pre-award debriefings and pre-award notifications of exclusion prior to award are not required under FAR Subpart 16.5, and the government will not provide them.

3.4 After the government has afforded all offerors under the multiple-award contract a fair opportunity to submit an offer and have that offer fairly considered, the government’s selection official may take or direct one or more of the following actions:

(1) award to the offeror whose proposal conforms to the solicitation’s requirements and is the most advantageous to the government based upon an integrated assessment of Section M’s evaluation Factors;

(2) obtain written resolutions or proposal revisions from the offeror whose initial proposal is the most advantageous to the government based upon an integrated assessment of the Section M evaluation Factors and would be awardable under the solicitation’s evaluation criteria but for one or two easily-resolvable deficiencies or clarifications — the resolution of which does not increase the offeror’s proposed total evaluated price set forth in Section B of the delivery order;

(3) obtain price supporting…
