EXPEDITING CONTRACT CLOSEOUT (NAVSEA) (DEC 1995)
(a) As part of the negotiated fixed price or total estimated amount of this contact, both the Government and the Contractor have agreed to waive any entitlement that otherwise might accrue to either party in any residual dollar amount of $500 or less at the time of final contract closeout. The term “residual dollar amount” shall include all money that would otherwise be owed to either party at the end of the contract, except that, amounts connected in any way with taxation, allegations of fraud and/or antitrust violations shall be excluded. For purposes of determining residual dollar amounts, offsets of money owed by one party against money that would otherwise be paid by that party may be considered to the extent permitted by law.
(b) This agreement to waive entitlement to residual dollar amounts has been considered by both parties. It is agreed that the administrative costs for either party associated with collecting such small dollar amounts could exceed the amount to be recovered.

HQ B-2-0016 PROVISIONING TECHNICAL DOCUMENTATION – WITHHOLDING OF PAYMENT (NAVSEA) (SEP 1990)
(a) For the purpose of paragraph (c) of the "PROGRESS PAYMENTS" clause of this contract, if included, the requirement that the Contractor develop and deliver Provisioning Technical Documentation (PTD) is considered to be a "material requirement of this contract," and Contractor failure to make adequate progress in the development of PTD, or to deliver acceptable PTD on a timely basis, may result in reduction or suspension of Progress Payments as provided in said paragraph.
(b) The PTD is considered to be a part of the "Technical Data" specified to be delivered under this contract for the purposes of the "TECHNICAL DATA--WITHHOLDING OF PAYMENT" (DFARS 252.227-7030) clause. The terms and conditions of the clause entitled "LIMITATION ON WITHHOLDING OF PAYMENTS (FAR 52.232-9), if included in this contract, shall not apply to withholding of payment for failure to make timely delivery of the PTD or delivery of deficient PTD.

This entire contract is fixed price.
RMC B-2-0002 PROGRESS PAYMENT RATES
The progress payment rate for this contract is 80 percent for large business and 85 percent for small business.
The unit price that each offeror proposes for each CLIN will become that offeror’s maximum unit price to be used during contract performance. If an offeror proposes a CLIN price in excess of their maximum unit price established on the basic contract when competing for individual delivery orders, that offeror will be considered ineligible for delivery order award. Offerors may use unit prices lower than their established maximums when competing for delivery orders without adversely affecting their eligibility.
Section C - Descriptions and Specifications
STATEMENT OF WORK
C.1. SCOPE OF WORK – APPLIES TO LOT I AND LOT II UNLESS OTHERWISE STATED
C.1.1 The contractor shall furnish the necessary management, material support services, labor, supplies, and equipment deemed necessary to provide marine boatyard and industrial support which includes specific modifications, upgrades, service life extension and repairs to Non-Commissioned boats, craft, lighterage and service craft and their associated systems and periodic maintenance primarily in support of San Diego area Naval Facilities (Naval Base San Diego, Naval Air Station North Island, Naval Amphibious Base Coronado, Naval Outlying Landing Field Imperial Beach, or Naval Surface Warfare Center Port Hueneme)boats, craft, lighterage, and service craft custodians. Lighterage is used here as a general term to include all lighterage, pontoons, and associated systems to include those items listed in Section J under the general listing of lighterage and associated systems. It is anticipated that 98% of the work to be performed on this contract will be the on San Diego area Naval Facilities boats, craft, lighterage, and service craft. Boats, craft, lighterage and service craft to be included are listed in Section J. For the purposes of this requirement, material is defined as, but is not limited to items that may be required to modernize, alter, repair or support boats, craft, lighterage and service craft, associated systems or other items as defined. Support is defined as, but is not limited to, providing manpower and equipment to accomplish alteration installations, repairs, modernizations, testing, stowage, machine shop services, transporting and maintenance task orders for boats, craft, lighterage and service craft. The work is broken out into two (2) different Lots. Lot I is for marine boatyard services and industrial support for boats, craft, lighterage or service craft less than 15 meters or 50 feet in length (by Navy hull designation or Length Overall (LOA)) or less that can be transported via roadway by a trailer. Lot I also includes work on boats, craft, lighterage or service craft less than 15 meters or 50 feet in length (by Navy hull designation or Length Overall (LOA)) or less outside the contractor’s boatyard locally or around the world. Lot II is for marine boatyard services and industrial support for boats, craft, lighterage or service craft greater than or equal to 15 meters or 50 feet in length up to 200 feet in length (by Navy hull designation or Length Overall (LOA)) that can be transported via roadway by a trailer or must be delivered on its bottom (via waterway) and for boats, craft, lighterage or service craft less than 15 meters or 50 feet in length (by Navy hull designation or Length Overall (LOA)), that must be delivered on its bottom (via waterway) (as defined by the Government in the task order). Lot II also includes work on boats, craft, lighterage or service craft greater than or equal to 15 meters or 50 feet in length up to 200 feet in length (by Navy hull designation or Length Overall (LOA)) outside the contractor’s boatyard locally and around the world. The possibility of performing services worldwide, although expected to be minimal, exists. There exists a possibility to view and/or obtain knowledge of Confidential messages or other information during the implementation of this contract that could address boat, craft, lighterage, or service craft location and/or movement.
C.1.2. The resulting Task Order may require multiple line items within the contract. Due to U.S. Navy or other customer commitments and schedules, a significant number of Task Orders may be issued as emergent requirements. The contractor may be required to respond to more than one requirement (simultaneous Task Orders for more than one boat, craft, lighterage, or service craft). A task may consist of a single or multiple vessels.
C.1.3. Required reports and documentation must be compatible with Windows NT Server 4.0 as the standard Network Operating System and MS Office 2000 Professional as the standard Office Software.
C.1.4. The contractor shall interface with and cooperate with other contractors supporting CCD or other activities as requested. SWRMC or another activity may have other engineering, Integrated Logistics Support or Alteration Installation Teams (AIT) performing other assigned work items. Contractors may be required to provide on-site support, interface or installation expertise in support of these work items. Contractors shall provide access to these other Government contractors.
C.1.5. The Government anticipates establishing liquidated damages for certain task orders. The amount of the liquidated damages for such a task order will be stipulated in the Request for Proposal (RFP).
C.1.6. Other Government activities such as user activities, ship’s force, Regional Maintenance Centers, SPAWAR, or NAVAIR may perform repairs or alterations during availability periods for the vessels. Other contractors performing other work as tasked by the Government may perform repairs or alterations during availability periods for vessels. The contractor shall accommodate these activities as required and as outlined in specific task orders.
C.1.7. Alterations may be installed by other activities under contract to SWRMC or other activities separate from work items assigned to contractor(s) using this contract. AIT tasks to other activities may require interface or teaming between contractors to the best benefit of the Government. Alterations that may be included in AIT efforts include, but are not limited to, safety alterations, alterations requiring special skills or tools, alterations best installed by one contractor to meet schedules or those alterations that will result in significant savings to the Government if installed via AIT. Coordination of AIT work and boatyard work may be required during certain periods of industrial work. Definitions of alterations and AIT for purposes of this requirement are provided below as defined by the Fleet Moderation Program Management and Operations Manual, SL720-AA-MAN-010 or the Fleet Modernization Program web site.
a. Alteration: Any change in the hull, machinery, equipment or fittings that involves a change in design, materials, number, location or relationship of an assembly’s component parts whether the change is separate from, incidental to, or in conjunction with repairs.
b. Alteration Installation Team (AIT): A Navy team (military, civilian or civilian contractor team) under the direction of Navy personnel that is trained and equipped to accomplish specific BOATALTs and CRAFTALTs, or temporary modifications on specified boats, craft, lighterage and service craft.
C.1.8. Expertise and experience anticipated to be needed for performance of this contract include, but is not limited to, boats, craft, lighterage and service craft having the following characteristics:
a. Types of Vessels: Standard ship’s boats to high performance advanced craft
b. Structural Material: Steel, aluminum, thin aluminum, composite, wood and inflatable
c. Propulsion Method: Non-self-propelled to gas turbines with waterjets
d. Design Types: Hull, Mechanical, Electrical and Electronic design; basic commercial off-the-shelf to militarized special designs
e. Hull Types: Displacement, semi-displacement, planning, wave piercing, surface effect, SWATH, monohulls, multi-hulls and other specialized one-of-a-kind hull forms
f. Manned and Unmanned vehicles
C.1.9. Specific tasks can include the following functions:
a. Quick Response Support – The contractor shall provide support for meeting emergent, quick response requests to support the needs of designated customers to remove vessels from the water or transport them to their facility, to place in safe condition, to troubleshoot/repair of designated problems and provide reports of findings after investigation of reported system problems. Assist in troubleshooting designated customer’s emergent problems and provide proposed solutions. The contractor shall provide the required skills and trades to accomplish emergent repairs of hull, mechanical, electrical and electronic systems.
b. Pre-Installation Surveys – The contractor shall conduct pre-installation surveys to develop specific installation documentation, to identify specific interferences, plan for installation efforts, prepare proposals and cost estimates and identify any other implementations to a successful installation.
c. Alteration Installation – The contractor shall provide the necessary facilities, equipment, tools, and trade personnel to accomplish hull, mechanical, electrical, and electronic alterations. These installations shall include, but are not limited to, all systems, equipment, and components or other items as identified. Alterations are defined as follows: any change in the hull, machinery, equipment, or fittings that involves a change in design, materials, number, location, or relationship of an assembly’s component parts whether the change is separate from, incidental to, or in conjunction with repairs.
d. Repair – The contractor shall accomplish hull, mechanical, electrical, or electronic or associated systems repair. The contractor shall provide emergency and quick response support to accomplish repairs identified. The contractor shall repair existing equipment or systems including putting the equipment or system back into the original configuration or condition, as shown on existing drawings, technical manuals, technical direction documents, manufacturer’s literature, or other official information.
e. Prototype Installation – The contractor shall provide for all aspects of prototype installations. Prototype installations are defined as the first installation of a new design. The purpose of this effort is to have the contractor work with the Government activity to correct, improve or otherwise validate the installation technical information. This effort by the Contractor is to perform the installation per the task order and provide feedback comments, input, marked-up technical information, marked-up drawings such that future installations will result in more efficient costs to the Government. The contractor shall notify the Government should problems be identified prior to performing the installation where the direction will result in costly mistakes.
f. Quality Control – The contractor is solely responsible for verifying and approving all work performed. The contractor shall develop hull, mechanical, electrical, and electronic tests and inspection criteria for all installations to document satisfactory and safe alteration installations or repairs. All tests shall contain written testing step-by-step procedures, sketches, or other pertinent information with pass/fail criteria. Procedures shall be submitted a minimum of one week prior to performance to allow government review of the document.
g. Logistic Support – The contractor shall provide technical information, logistics documentation, catalog cuts, manufacturer’s part data, commercial manuals, commercial technical information, drawings, sketches, characteristics, specifications, technical write-ups, or purchase descriptions as requested for each installation to allow for the updating of manuals and to allow the Government to develop the proper Integrated Logistics Support (ILS). The contractor shall assist if tasked to accomplish logistics review.
h. Marine Support – The contractor shall provide boatyard support relating to operation, repair, and alterations of vessels. The boatyard shall have access to a crane to allow support services to be accomplished. The contractor shall provide equipment, labor, and general support to accomplish modernization or repairs. The contractor shall provide support services such as water, sewage, compressed air, and electrical power to sustain operation of vessel internal systems. Movement of vessels, equipment, or material within the contractors’ facility is at the contractor’s expense.
i. Craft/Equipment/Material/Transportation/Stowage – The contractor shall provide typical transport support that may include, but are not limited to the following items: retrieve vessel/equipment/material and transport by waterway or other suitable mode of transportation; stow vessel/equipment/material as required in support of customer and work item requirements. While in the contractor’s facility, the contractor shall protect the vessel, systems, equipment, and/or material from inclement weather that could cause damage. The contractor shall provide storage for boats, craft, equipment, or material at the beginning or after completion of a specific task if required by the Government to facilitate Government scheduling and coordination issues.
j. Material Support – The contractor shall purchase, identify, store, and/or stage material identified in the applicable task order or technical documentation. The contractor shall provide and properly store all Contractor Furnished Material (CFM). The contractor shall provide storage for Government Furnished Material (GFM) installations. The contractor shall maintain a current electronic tracking system for material procurement. All parts being used for modernization or repair efforts shall be identified and kitted/bagged and stored by specific task to allow quick easy part identification and to minimize installation time.
k. Test and Evaluation Support – The contractor shall provide procedures, equipment, personnel, and material support required to accomplish Government testing and evaluation of vessels. The contractor shall provide stowage for equipment and vessels as requested in support of testing and evaluation efforts.
l. Research and Development Support – The contractor shall provide support such as technical, production, purchasing and other identified support for research and development projects. The contractor shall provide storage, repair, maintenance, and upkeep of items associated with research and development projects.
m. Periodic and Planned Maintenance Support – The contractor shall provide periodic and planned maintenance support for all systems to maintain the craft in an operational ready condition. This support may be required 24 hours a day, seven days a week on an as needed basis. This support is required to be provided at the location requested by the user activity, which could be anywhere in their operational area.
o. Towing/Trailering. The contractor shall provide services to tow and/or trailer a boat, craft, lighterage or service craft to/from their facility to accomplish repairs, overhauls, or alteration. Towing and trailering shall be invoked accomplished as per requirements of individual specifications from Naval Base San Diego, Naval Air Station North Island, Naval Amphibious Base Coronado, Naval Outlying Landing Field Imperial Beach, or Naval Surface Warfare Center Port Hueneme.
C.1.10. Coordination Process
a. The contractor shall assign one lead for each task order and this contractor person shall coordinate all aspects of the task order with the designated Government representative and vice versa. The contractor lead will keep the Government representatives apprised of schedule, technical, material and financial issues pertain to the task order.
b. All communication shall be through the designated government representative unless otherwise authorized. The contractor’s employees shall not visit vessels or military activity associated with a task order without prior designated government representative approval. All visits shall be during normal working hours, Monday – Friday 0630-1500 and coordinated by the government representative. If required, the government representative shall forward security clearances to military installation for contractor personnel.
c. The contractor shall provide all labor, material, and equipment necessary to accomplish the task order and shall not contact the government or military to use their equipment or personnel to accomplish tasks awarded to the contractor. Lifting slings are considered part of the vessel for hoisting purposes.
C.1.11. Technical Conferences/Review Meetings
a. Contractor and Government representatives shall meet weekly unless agreed to by the Government, while task orders are in place, for the duration of the contract to review the contractor’s performance in providing support under this contract. Meeting times shall be arranged and agreed to by the Government and contractor.
b. Contractor personnel shall be available for informational meetings with technical personnel at government or the contractor’s facility to discuss the direction, progress, results and/or issues that occur during the performance of each task order placed under this contract. Notice for meetings will be given at the beginning of each delivery order as per SI 009-60 and 009-111.
C.2. PERSONNEL
C.2.1. The contractor shall be responsible for the employment of trained and technically qualified personnel in accordance current NAVSEA Standard Items to perform task orders. The contractor, upon request of the Government representative, shall produce the qualifications of an individual to substantiate qualifications to perform the task being worked. In addition, the contractor is responsible for employing and maintaining the personnel, organizational and administrative control necessary to ensure the performance meets or exceeds all contract specification requirements hereunder and as set forth in each individual task order.
C.2.2. Welders must be certified for applicable weld procedures and shall carry their welding certifications with them at all times.
C.3. ORGANIZATION
The contractor must have an organization with the experience and comprehensive understanding to apply management techniques, methods and procedures required to efficiently complete the requirements of this solicitation.
C.4. REFERENCES
In performing the requirements of this contract, the contractor shall comply with all the following references and attachments (Section J) to this solicitation. The contractor shall comply with the latest revision of these documents in effect at solicitation closing and when each option year in invoked. Additionally, in the event that there is any conflict between the references, Naval Standard Items, Local Work Templates, and Standard Work Template take precedence over technical manuals/specifications and other references. Also, when drawings reference other tiered drawings, they are to be followed:
a. Current Fiscal Year NAVSEA Standard Items
b. Available for download at www. Supship.navy.mil (Select “SSRAC Site”)
C.5. FACILITIES
A. The following facility requirements apply to Lot I:
(1) The boatyard must be lockable, fenced, and have daily 24-hour security in accordance with NSI 009-72.
(2) All office, shop, and storage facilities for the contractor may be at a single site or various sites. Lot I contractor(s) sites shall be in San Diego County. Any satellite locations available to support work shall be within San Diego County.; Lot II contractor(s) sites shall be no farther than Long Beach, CA, within Los Angeles County. Any satellite locations available to support work shall be no farther than Long Beach, CA, Los Angeles County.
(3) The facilities shall have the following minimum requirements (NOTE: Boat lengths are by Navy hull designation or Length Overall (LOA)):
(a) Work Area/Storage
(i) Dry enclosed building(s), to work on a minimum of two (2) 7 Meter Rigid Inflatable Boats (RIBs) or two (2) 11 Meter RIBs in length (by Navy hull designation or Length Overall (LOA)) simultaneously. Also, 500 square foot dry enclosed lockable storage for supplies and material.
(ii) Outside storage area, uncovered for storage boats, skids, trailers, equipment and general industrial work on boats. This outside storage shall be large enough to work on two (2) 7 Meter RIBs or two (2) 11 Meter RIBs simultaneously.
(b) Access to waterway with the ability to lift or deploy up to a less than 15 meters or 50 ft. boat, craft, lighterage or service craft via a trailer from a boat ramp or via crane services or other launching/retrieval method.
(c) Services:
(i) Electrical services, shore 120Vac, 1 phase, readily available with a minimum of 50 AMPS.
(ii) Fuel service (diesel and gasoline)
(iii) Fresh water service
(iv) Sewage disposal service
(v) Oily bilge water discharge service
(vi) Compressed Air with a minimum of 90 psi
(d) Lift Equipment – Mobile crane (or similar lifting device), or access to, minimum of one (1) with a capacity of five long tons. The contractor must have the ability to lift all craft in task orders without support from the Government. NOTE: If a boatyard has a travel lift that meets the requirements herein, this will suffice for the crane requirement.
(e) Forklift (one) with a minimum 4,000 lb capacity
(f) General:
(i) Shop – Shop facilities must have the ability to perform the following:
Shipfitting types of work. Cutting (gas, arc and shear), rolling, shaping, grinding and fitting steel and aluminum plates and shapes.
Sheet metal work. Forming, shaping, cutting (gas, arc and shear) and stamping steel and aluminum sheets.
Welding. Welding plates and shapes (steel and aluminum), sheet metal (steel and aluminum) and piping joints and fittings.
Pipefitting. Targeting, fitting, bending, pickling, testing, stress relieving and threading all kinds of pipe (including brazing).
Machinist/Mechanical (shop and marine). Removing, machining, repairing, testing, cleaning, hydraulic flushing and reinstalling shafting, propellers, sea chests, foundations, winches, hoists, davits, deck equipment, pumps, valves and bearings.
Electrical. Installing and checking out wiring, cabling, controllers, switchboards, equipment, motors (including motor rewind and repair), lighting, communications, telephones, solenoids, switches and metering.
Electronics. Removing, repairing, (re)installing and operational testing of electronic equipment.
Woodworking and Composite. Repairing/modifying hulls and items made of wood and/or composite material.
Rigging. Availability of equipment to remove and to install components and equipment.
(ii) General Office(s) – Standard office spaces, conference room. Office must have typical copy machine, computers, FAX machine, telephones, desks and chairs
(iii) Office for Government use if identified on specific task order. Office should have desk, chair, telephone, air conditioning in summer, heat in winter, with typical electrical and lighting. Facility shall have general parking space(s) available for Government use.
(iv) Correspondence between the contractor and SWRMC shall be accomplished via electronic medium. Microsoft Word, Excel, Power Point and Project are the preferred formats.
B. The following facility requirements apply to Lot II (NOTE: Boat lengths indicated are by Navy hull designation or Length Overall (LOA):
(1) The boatyard must be lockable, fenced, and have daily 24-hour security in accordance with NSI 009-72
(2) All office, shop, storage, and waterfront for each contractor may be at a single site or various sites.
(3) The facilities shall have the following minimum requirements;
(a) Storage
(i) Dry enclosed building(s), 5,000 sq. ft., permanent structure, for miscellaneous storage.
(ii) Shore (outdoor) storage area, 20,000 sq. ft. uncovered for storage of boats, skids, equipment and general industrial work on boats.
(b) Dockside Slips:
(i) Dockside slips capable of docking two (2) 135’ LCUs, 10’ draft.
(ii) Navigable water minimum of 10’ depth at mean low water.
(c) Services:
(i) Electrical services, shore power (450V AC, 3 phase, 200 Amps single service; 120V AC, 1 phase 200 Amps single service; 120V AC, 1 phase, readily available)
(ii) Fuel service (diesel and gasoline)
(iii) Fresh water service
(iv) Sewage disposal service
(v) Oily bilge water discharge service
(vi) Compressed Air
(d) Lift Equipment – Mobile crane (or similar lifting device), or access to, minimum of one (1) with a capacity of five long tons. The contractor must have the ability to lift all craft in task orders without support from the Government. NOTE: If a boatyard has a travel lift that meets the requirements herein, this will suffice for the crane requirement.
(e) Forklift (one) with a minimum 5,000 lb capacity
(f) Marine Railway, dry dock, travel lift or similar lifting capability or access to similar lifting capability, or some combination thereof to allow work on a minimum of two (2) 135’ Landing Craft Utility (470,000 lbs. each) simultaneously out of the water. The contractor shall have access to lifting devices to lift all vessels on the task orders without support from the Government.
(g) General:
(i) Shop – Shop facilities must have the ability to perform the following:
Shipfitting types of work. Cutting (gas, arc and shear), rolling, shaping, grinding and fitting steel and aluminum plates and shapes.
Sheet metal work. Forming, shaping, cutting (gas, arc and shear) and stamping steel and aluminum sheets.

Rigging. Availability of equipment to remove and to install components and equipment.
(ii) General Office(s) – Standard office spaces, conference room. Office must have typical copy machine, computers, FAX machine, telephones, desks and chairs
(iii) Office for Government use if identified on specific task order. The contractor shall provide a quality workplace environment that supports program operations, and meets the needs of the Government. Office should have equipment to accommodate at least two Government personnel to include desks, chairs, telephones, air conditioning in summer, heat in winter, with typical electrical, lighting, and telephone service. Facility shall have general parking space(s) (At least two (2)) available for Government use.
(iv) Correspondence between the contractor and SWRMC shall be accomplished via e-mail. Microsoft Word, Excel, Power Point and Project are the preferred formats.
C.6. GENERAL REQUIREMENTS:
The following are applicable to the extent they apply to all repairs, modifications, testing and adjustments. Any cost to comply with these requirements shall be included in the price of the CLINs listed in Section B.
C.6.1. The Contractor Shall:
a. Assure the successful completion of all tasks placed hereunder.
b. Designate those persons authorized to accept/reject verbal orders.
c. Coordinate schedules in the work affected areas with the user activity representative, technical POC, and the Project Manager (PM) during the performance period of the task order. The work effort on task orders shall be coordinated on a daily basis with the user activity representative, technical POC or PM to allow for changing situations to minimize delays and disruptions.
d. Forward all requests for changes in delivery schedules, funding requirements and scope in writing. These requests shall include specific details as to what changes are required and circumstances requiring such and shall be submitted to the Administrative Contracting Officer (ACO) prior to 85% of delivery availability being exceeded.
e. Not respond to new performance requirements until a Task Order or a modification has been signed or verbal authorization has been given by the ACO.
f. Not respond to any requests requiring deviations in technical performance as specified in the task order without obtaining prior approval of the Contracting Officer.
g. Be responsible for inspection of workspaces prior to manning to ensure spaces are available for work to avoid unnecessary delays in day to day work schedule.
h. Provide protection during contamination-producing operations and maintain cleanliness in accordance with NAVSEA Standard Item (NSI) 009-06. Remove, manage and properly dispose of all hazardous material, debris, trash and foreign material resulting from cleaning, removal, installation or any other aspect of task performance in accordance with federal, state and local requirements and SWT 077-001, Hazardous Waste Produced on Naval Vessels; control. This will be required of all tasks performed on this contract whether at a Government facility or at a privately owned facility.
i. Clean, inspect and repair piping flanges exposed by removals. Repair by removing high spots, burrs, abrasions, and foreign matter, where removal can be accomplished by hand tools. Take precautions to maintain phonographic finish on flanges that have it.
j. Ensure personnel are familiar with the requirements of NSI 009-94 when working within a privately owned ship repair facility.
k. Submit a written weekly report detailing the daily events and the progress made during the course of each day to the PM and ship's authorized representative (SAR). Time and location for submission of the weekly report shall be agreed upon at the beginning of each task order and prior to the start of the work. A sample of said report is to be provided to SWRMC prior to the first reporting cycle.
C.6.2. Environmental and Safety Requirements. The Contractor Shall:
a. Consider all insulation, lagging, deck tile, underlayment, gasket shipboard cabling and mastic to be asbestos-containing material (ACM) until it can be established by laboratory analysis, or other reliable methods, that the material does not contain asbestos, in accordance with 29 CFR 1915.1001. Removal, disturbance or disposal of ACM shall be accomplished IAW the requirements of NSI 009-10 and 40CFR Part 61 Subpart M National Emission Standard for Asbestos and San Diego Air Pollution Control District (APCD) 361 series of rules
b. Accomplish confined space entry, certification, fire prevention and housekeeping requirements of NSI 009-07, 009-08, 009-34, 009-35 and 009-70. Maintain area cleanliness and ensure all residues and refuse are removed daily and ensure that general housekeeping is maintained for the duration of the task in the work areas specified on each task order. Ensure that processes or procedures for the removal or disruption of existing toxic or hazardous substances comply with the requirements of 29CFR1910 and 29CFR1915. At a minimum, address the following: exposure monitoring, method of compliance, respiratory protection, protective clothing, housekeeping, hygiene facilities and practices, medical surveillance, employee information and training, signs, and recordkeeping per NSI 009-03.
c. Consider all marine coatings to contain heavy metals (e.g. lead, cadmium or chromium), hexavalent chromium, crystalline silica and/or other toxic or hazardous substances as defined in 29 CFR 1815.1000. Contractor shall make an initial determination of potential employee exposure to toxic or hazardous substances prior to removal of existing non-skid or coatings. Laboratory analysis results of bulk non-skid/paint samples shall be submitted to the PM as soon as possible upon receipt from the laboratory. Monitor the affected areas during work operations to ensure compliance with 29CFR1910 and 29CFR1915. Monitoring shall include adjacent spaces to ensure the work area containments and work practices are effective. Results of surveillance shall be documented and documentation shall be made available to the SUPERVISOR per NSI 009-03. Consider marine paint/nonskid, and abrasive blasting media to contain heavy metals (e.g., beryllium, cadmium, chromium, or lead), hexavalent chromium, crystalline silica and/or other toxic or hazardous substances per NSI 009-32.
d. Contractor shall identify materials that may contain toxic or hazardous substances as listed in Subpart Z of 29CFR1910 that are to be used, removed, or disturbed during work operations. Conduct and document an initial determination of potential personnel exposure to these materials prior to the start of work per NSI 009-03.
e. Consider all solid waste to be removed from a ship under repair to be potentially hazardous waste. This includes liquids generated as a result of hydroblasting operations, and includes wastes not identified under SWT 077-01. The contractor shall review and evaluate all solid waste to determine if that waste is hazardous IAW 40 CFR 262.11.
f. All solid waste with the known potential to be hazardous, including but not limited to non-skid debris, paint chip debris, flooring/debris, and all liquid waste removed from the ship shall be tested by a certified laboratory for metals IAW 40 CFR 261.24, using the Toxicity Characteristic Leaching Procedure (TCLP), Method 1311 in EPA Publication SW-846. Contractor shall submit all laboratory analysis reports to the PM as soon as possible upon receipt from the laboratory. No solid waste removed from the ship shall be transported off the facility until authorized by the PM.
C.7. DETAILED REQUIREMENTS FOR BOTH LOTS – ALL YEARS
C.7.1. Definition of Repair Requirements - The contractor is required to issue Conditions Found Reports as required which include but are not limited to inspecting equipment and/or systems to determine repair options and alternatives, and making recommendations to the Project Manager (PM).
C.7.2. Repair Implementation. The contractor shall provide qualified technicians and tradesman to perform repairs and refurbishment. This effort shall include, but is not limited to, the following:
a. Conduct liaison visits (with Government representative) to coordinate schedules for repairs, equipment removal for repair, and refurbishment or replacement. Repair actions will include the removal and reinstallation of all interferences.
b. Correct deficiencies identified during visits and/or surveys when authorized by the individual task order. Deficiencies identified that cannot be corrected due to operating schedule will be re-scheduled.
c. Provide teams of qualified journeymen level mechanics, and technicians to accomplish repairs onboard vessels. Repair efforts on short notice may be required and will require work efforts to continue around the clock, including weekends and holidays, until completed.
d. Provide subcontracting capabilities, administration, and management to accomplish repairs which may require highly specialized skills beyond the contractor’s internal workforce.
e. Conduct completion inspections, accompanied by authorized Government representative and/or the PM after all repair and/or replacement actions have been accomplished.
f. Provide Quality Assurance Inspections and Certifications for all repair actions accomplished in accordance with this contract and standard industry practices.
g. Repair and refurbishment work efforts will be conducted at locations specified in each task order.
h. During the craft visits, the contractor shall work closely with the PM and authorized Government representative to expeditiously fulfill planned or emergency work requirements and keep them fully informed of the status of work items.
i. Provide the necessary tools, rigs, and test equipment to perform repairs.
j. Provide crane services when required.
k. Provide written reports to PM on all work performed, and test documentation of those results.
C.7.3. Non-Navy Owned Cranes. The following is a list of minimum requirements that contractors shall comply with for all contracts that may result in the use of a crane for the accomplishment of work.
a. The contractor shall notify the contracting officer, in advance, of the intent of bringing a non-Navy owned crane onto a Navy shore installation. All entries shall be through a prearranged entry point.
b. The contractor shall comply with the applicable American Society of Mechanical Engineers (ASME) standards (e.g., B30.5 for mobile cranes, B30.22 for articulating boom cranes, B30.3 for construction tower cranes, and B30.8 for floating cranes). For barge mounted mobile cranes, a load indicating device, a wind indicating device, and a marine type list indicator readable in one-half degree increments are required. In addition, the contractor shall comply with specific naval crane safety and operation regulations/standards specifically required by the Navy shore installation and state or local Government.
c. The contractor shall certify that the crane and rigging gear meets applicable Occupational Safety and Health Administration (OSHA) regulations by providing a Certificate of Compliance. The contractor must cite which OSHA regulations are applicable, e.g., cranes used in cargo transfer shall comply with 29 CFR 1917; cranes used in construction, demolition, or maintenance shall comply with 29 CFR 1926; cranes used in shipbuilding, ship repair, or shipbreaking shall comply with 29 CFR 1915. For cranes at Naval activities in foreign countries, the contractor shall certify that the crane and rigging gear conform to the appropriate host country safety standards. The contractor shall also certify that all of its crane operators working in the naval activity have been trained not to bypass safety devices (e.g., anti-two block devices) during lifting operations. The Certification of Compliance form shall be posted on the crane.
d. For mobile cranes with original equipment manufacturer (OEM) rated capacities of 50,000 pounds or greater, the crane operators shall be designated as qualified by a source that qualifies crane operators (i.e., union, a Government agency, or an organization that tests and qualifies crane operators). Proof of current qualification shall be provided.
e. The contractor shall certify that the crane operator is qualified and trained for the operation of the crane to be used.
f. The contractor shall provide a critical lift plan for each of the following lifts: lifts over 75 percent of the capacity of the crane or hoist (lifts over 50 percent of the capacity of a barge mounted mobile crane’s hoists) at any radius of lift; lifts involving more than one crane or hoist; lifts of personnel; and lifts involving non-routine rigging or operation, sensitive equipment, or unusual safety risks. The plan shall include the following as applicable:
The size and weight of the load to be lifted, including crane and rigging components that add to the weight. The OEM's maximum load capacities for the entire range of the lift shall also be provided.
The lift geometry, including the crane position, boom length and angle, height of lift, and radius for the entire range of the lift. This applies to both single and tandem crane lifts.

The environmental conditions under which lift operations are to be stopped.
For lifts of personnel, the plan shall demonstrate compliance with the requirements of 29 CFR 1926.550(g) For barge mounted mobile cranes, barge stability calculations identifying barge list and trim based on anticipated loading; and load charts based on calculated lists and trim. The amount of list and trim shall be within the crane manufacturer’s requirements.
g. Contractors shall notify the contracting officer as soon as practicable, but no later than four hours after any weight handling equipment (WHE) accident. The contractor shall secure the accident site and protect evidence until released by the contracting officer. The contractor shall conduct an accident investigation to establish the root cause(s) of any WHE accident. Crane operations shall not proceed until the cause is determined and corrective actions have been implemented to the satisfaction of the contracting officer.
h. The contractor shall provide the contracting officer within 30 days of any accident a Weight Handling Equipment Accident Report, consisting of a summary of circumstances, an explanation of causes(s), photographs (if available), and corrective actions taken. These notifications and reporting requirements are in addition to those promulgated by OPNAVINST 5100.23 and related claimant instructions.
C.8. SECURITY REQUIREMENTS
C.8.1. The Department of Defense Contract Security Classification Specification, DD Form 254, (See Attachment 2), itemizes the basic security requirements for this contract.
C.8.2. Accordingly, the Contractor shall be required to have or obtain a Facility Security Clearance, provide classified storage capability, and obtain security clearances for personnel performing under this contract. An applicable DD Form 254, Contract Security Classification Specification, shall be issued with each task order under the contract whenever the basic DD 254 does not provide sufficient classification guidance.
C.8.3. The contractor shall provide clearance information data to SWRMC prior to task order start date. Data to include list of all Contractor personnel supporting the installation, social security numbers, and addresses.
HQ C-1-0001 DATA REQUIREMENTS (NAVSEA) (SEP 1990)
Item 0003 - The data to be furnished hereunder shall be prepared in accordance with the Contract Data Requirements List, DD Form 1423, Attachment Exhibit L, attached hereto.

ACCESS TO PROPRIETARY DATA OR COMPUTER SOFTWARE (NAVSEA) (JUN 1994)
(a) Performance under this contract may require that the Contractor have access to technical data, computer software, or other sensitive data of another party who asserts that such data or software is proprietary. If access to such data or software is required or to be provided, the Contractor shall enter into a written agreement with such party prior to gaining access to such data or software. The agreement shall address, at a minimum, (1) access to, and use of, the proprietary data or software exclusively for the purposes of performance of the work required by this contract, and (2) safeguards to protect such data or software from unauthorized use or disclosure for so long as the data or software remains proprietary. In addition, the agreement shall not impose any limitation upon the Government or its employees with respect to such data or software. A copy of the executed agreement shall be provided to the Contracting Officer. The Government may unilaterally modify the contract to list those third parties with which the Contractor has agreement(s).
(b) The Contractor agrees to: (1) indoctrinate its personnel who will have access to the data or software as to the restrictions under which access is granted; (2) not disclose the data or software to another party or other Contractor personnel except as authorized by the Contracting Officer; (3) not engage in any other action, venture, or employment wherein this information will be used, other than under this contract, in any manner inconsistent with the spirit and intent of this requirement; (4) not disclose the data or software to any other party, including, but not limited to, joint venturer, affiliate, successor, or assign of the Contractor; and (5) reproduce the restrictive stamp, marking, or legend on each use of the data or software whether in whole or in part.
