About this file
This document contains questions and responses related to a federal solicitation for an Indefinite Delivery, Indefinite Quantity (IDIQ) Multiple Award Contract (MAC) for hull, mechanical, and electrical (HM&E) repair, maintenance, modernization, and sustainment requirements of various vessels under Fleet Forces command. The solicitation, N50054-24-R-0003, is issued by the Mid-Atlantic Regional Maintenance Center (MARMC) and is set aside for small businesses. The contract will have a base year with four one-year ordering periods. Key details include:
- The Government will not provide a dollar estimate for the total contract value. However, the solicitation provides labor and material pricing attachments with the current hours and materials estimate.
- The solicitation incorporates requirements for dry dock capabilities within a 50-mile radius of Naval Station Norfolk, but most orders are not expected to require dry docking. Offerors without dry dock facilities may provide a usage agreement.
- The Agency addresses requirements related to Agreement for Boat Repair (ABR) or Master Ship Repair Agreement (MSRA) certification, or demonstration of equivalency.
- Pricing terms include fixed ceiling rates for labor and materials, with opportunities for offerors to propose lower rates.

CONTRACTOR QUESTION 01: According to today's GOVWIN, approximately $6.4M has been awarded (probably the most recent 6 months are lacking) to eight ID/IQ awardees; assume the other two received the minimum guarentee. Does the Government believe that the work awarded in the next contract cycle will exceed these totals? If yes, by how much? Without a larger estimated dollar throughput, I assume that companies will no bid this opportunity due to the cost of developing a winng proposal which very easily can cost up to $750K. This amount to break even has only been reached by three of incumbents. Please advise what MARMC's estimate is for the total anticipated funding for the new contracts.
GOVERNMENT RESPONSE: A dollar figure of the Government's estimate will not be provided. However, the J-1 labor and material pricing attachment provides the current hours and materials estimate broken out by each ordering period. Please refer to this information.
CONTRACTOR QUESTION 02: Most small businesses in Hampton Roads area do not not have drydocking capabilities. Please verify the solicitation is intended for small business with drydocking capabilities.
GOVERNMENT RESPONSE: Most delivery orders to be placed off of this solicitiation's resultant base contract will not necessitate drydocking.
Reminder that solicitation N50054-24-R-0003 incorporates new drydocking requirements in conjunction with the re-compete for the current and soon-to-expire MARMC HM&E MAC-IDIQ requirement awarded in FY-19. To confirm, this solicitation is intended for businesses in the area that have drydocking capabilities, as well as businesses that do not. Remember, the offeror's facilities "shall be located within a 50-mile radius from Naval Station Norfolk, Norfolk
VA".
GOVERNMENT RESPONSE: The term "Messing and Bething Barges" was left on the original copy of the S-1 attachemnt in error. The document has since been updated and reposted to SAM.gov via amendment 0001.
CONTRACTOR QUESTION 03: Is this IDIQ just for Messing and Berthing Barges? Note the Title above, this sheet was posted 23 July to SAM.GOV. Ina ddition under the work scope there is no direct mention of it being just berthing barges?

CONTRACTOR QUESTION 04: This nis a small business set aside but ithe scope calls out for Dry docking capability within 50 NM of Norfolk. Are offerors who have dry docking capabilioty outside 50 NM excluded? In addition if Dry Docking capability is a requirement competition would seem to be limited as a SBSA. Can you further elaborate on DD requirements for this solicitation.
GOVERNMENT RESPONSE: Most delivery orders will not require dry dock capabilities. When dry docking is required, it must be located within a 50 mile radius from Naval Station Norfolk.
GOVERNMENT RESPONSE: A usage agreement would suffice. Most delivery orders will not require a dry dock.
CONTRACTOR QUESTION 05: Can a non ABR/MSR contractor bid on this IDIQ contract ?
GOVERNMENT RESPONSE: Solicitation Section C, Paragraph 1.6 of the solicitation addresses MSRA and ABR requirements- as well as the equivalency requirements for those offerors who are not current MSRA or ABR holders. The same requirements are also addressed in Section L of the solicitation.
CONTRACTOR QUESTION 06: Is the Offeror required to own a Dry-Dock Facility or does a usage agreement suffice? If a usage agreement is sufficient to meet the Dry-Docking requirement, what level of detail does the Government wish the Offeror to provide regarding the third-party’s dry-docking facilities?

CONTRACTOR QUESTION 07: The Dry-Docking Facility requirement listed in Section C 1.2.5.2 was not a requirement under the previous IDIQ contract. What type of work and size/class of vessel is anticipated during the period or performance requiring dry-dock usage?
GOVERNMENT RESPONSE: We are incorporating increased war time readiness into the contract in the event we need to dock a ship. The contract would also cover the periodic docking of TSVs, drydocks, etc.
Most delivery orders will not require a dry dock.
wish the Offeror to provide regarding the third-party’s dry-docking facilities?
CONTRACTOR QUESTION 08: What are the specifications and requirements for the Dry-Docking Facility?
GOVERNMENT RESPONSE: Refer to section C, 1.2.5.2. The specific delivery order will indicate if a dry dock is required and if so, what type of certification of the dock is required. Most delivery orders will not require a dry dock.
CONTRACTOR QUESTION 09: The solicitation states, “Pages shall be formatted to 8.5 X 11 inch paper with one-point margins.” Will the Government confirm one-inch margins as the correct page formatting?
GOVERNMENT RESPONSE: Confirmed. One inch margins are acceptable.
CONTRACTOR QUESTION 10: The solicitation states Attachment J-7 is CNRMCINST 4280.1A, however NAVSEAINST 4280.2C was included on SAM.Gov as the Attachment J-7. This is an older instruction from November 1996. Will the Government confirm CNRMCINST 4280.1A dated 17 February 2021 is the correct instruction?
GOVERNMENT RESPONSE: Correct. NAVSEAINST 4280.2C is out of date and CNRMCINST 4280.1A is current and applies to this solicitation. NAVSEAINST 4280.2C was inadvertently attached to the solicitation, and the J-7 is indeed supposed to be CNRMCINST 4280.1A. The appropriate attachment will mesh with the correct J-7 as part of the next amendment.
CONTRACTOR QUESTION 11: The solicitation states, “To develop the overall rating, the Government’s evaluation will take into account relevant contract information to the requirements of this solicitation submitted by each offeror as part of its proposal including the Past Performance Questionnaires (Attachment J-10) as well as other sources of information.” Past Performance Questionnaires were included on SAM.Gov as Attachment J-5. Will the Government confirm the Attachment numbering?
GOVERNMENT RESPONSE: Confirmed. The correct attachment number should read J-5 vice J-10. This will be corrected via Amendment 0001.
CONTRACTOR QUESTION 14: With regards to Past Performance, the solicitation states, “Yet-to-be performed work and experience prior to the last three (3) years will not be considered.” Will a contract that spans several years, with some work completed over three years ago and some within the last three years, be evaluated in its entirety, or is only the work completed within the past three years considered for evaluation?
GOVERNMENT RESPONSE: Only work completed within the timeframes established in Sections L and M of the solcitation will be evaluated.
CONTRACTOR QUESTION 12: The Solicitation states, "Offers shall provide their Agreement for Boat Repair Number (ABR), or, Master Ship Repair (MSRA). If not a current ABR or MSRA holder, shall demonstrate equivalency by completing and submitting an application, with all required documentation, for an ABR as defined by CNRMCINST 4280.1A.
Documentation shall be provided of an approved Remote Site Performance Plan, if applicable. Additionally, for work to be accomplished at a remote site, offerors shall address personnel to be utilized.” However, CNRMCINST 4280.1A Page 3 Paragraph 5 sub paragraph e states “This instruction cancels the Remote Site Performance Plan…” Would the Government please confirm the requirements for a remote site plan and what documentation is required?
GOVERNMENT RESPONSE: There is no sub paragraph e in paragraph 5 (Policy). MSRA remote site plans are discussed under Under Paragraph 4 (Discussion), e. This instruction cancels the Remote Site Performance Plan, more commonly referred to as a “Remote Site MSRA.” Remote site plans were not in accordance with the intent of the MSRA and created unnecessary confusion in its purpose and execution.
CONTRACTOR QUESTION 13: Section L, Volume II, Element A1 states, "Offers must provide their Agreement for Boat Repair Number (ABR), or, Master Ship Repair (MSRA). If not a current ABR or MSR holder, shall demonstrate equivalency by completing and submitting an application, with all required documentation, for an ABR as defined by CNRMCINST 4280.1A.
GOVERNMENT RESPONSE: Please see the answer to question 12 above.
CONTRACTOR QUESTION 15: May the Offeror provide dry-dock information at the task order level instead of at the MAC-IDIQ Solicitation level?
GOVERNMENT RESPONSE: Section L will be revised via Ammendment 0001 to include a narrative on the Offeror's facility drydocking capabilities if they posess them. More in-depth dry dock information will be addressed at the delivery order level once the specific vessel being repaired is known.

CONTRACTOR QUESTION 21: Under "Temporary Services" please elaborate on the requirement of "Decking service".
GOVERNMENT RESPONSE: The term is referring to protective deck covering.
CONTRACTOR QUESTION 18: The fourth Paragraph under Factor 2 references Past Performance Questionnaires (Attachment J-10).
No J10 attachment was provided. Did the government intend to reference the J5 Attachment- Past Performance Assessment Questionnaire?
GOVERNMENT RESPONSE: Please see the answer to question number 11 above.
CONTRACTOR QUESTION 17: The fully burdened labor rate includes "all wages (i.e. straight time, overtime, shift differential, holiday time, etc.), overhead, general and administrative expenses, all other indirect costs, and profit." Since drydocking facilities require more of an industrial support base which increases overhead costs, will the governmnet consider one fully burdened labor rate for non-drydock required delivery orders and one fully burdened labor rate for drydock required delivery orders?
GOVERNMENT RESPONSE: Only one ceiling rate will be established for labor and material burdens. The Offeror will have the ability to offer a rate lower than the ceilings established if the Offeror feels it is justified for a specific delivery order.
GOVERNMENT RESPONSE: This sentence of the solicitation shall not be changed; requirement will not be struck.
CONTRACTOR QUESTION 19: Para states RCCs and RTRs that are subcontracted for material only shall not be subject to the material burden rate.
KTR disagrees and request this requirement be struck as required G&A/overhead functions to accomplish the procurement such as purchasing, warehouse, and transportation (which cannot be directly charged to a task order) will not be funded with the material burden rate excluded.
CONTRACTOR QUESTION 20: Daily rate for drydocking cannot be priced as requested. Each vessel is unique in size, tonnage, power requirements, number of bilges and voids, etc. with each vessel requiring specific services.
Cost of the dock, lift or pier can be priced per day, and per asset, but supporting services cannot. KTR requests this requirement be revised.
GOVERNMENT RESPONSE: The Government will revise the solicitation, such that the extension rates are to be proposed at the delivery order level for each RFP originating from this IDIQ.
GOVERNMENT RESPONSE: The two listed paragraphs citing "verbal" direction will be revised.
GOVERNMENT RESPONSE: This sentence of the solicitation shall not be changed; requirement will not be struck.
CONTRACTOR QUESTION 23: Please provide the Government's definition of an excusable delay and provide examples. Additionally, please advise why any delay beyond the KTR's control is not compensable.
GOVERNMENT RESPONSE: Excusable delays - (1) acts of God or of the public enemy, (2) acts of the Government in either its sovereign or contractual capacity, (3) fires, (4) floods, (5) epidemics, (6) quarantine restrictions, (7) strikes, (8) freight embargoes, and (9) unusually severe weather. In each instance, the failure to perform must be beyond the control and without the fault or negligence of the Contractor. As for the latter part of the question, whether a delay is considered minor, excusable, or compensable shall be evaluated on a case-by-case basis as they arise.
CONTRACTOR QUESTION 22: Para 4 states "These rates are to be used during the availability's extension period, up to 24 months after the awarded delivery date." KTR disagrees as ship repair is a volatile market with numerus cost factors changing daily. KTR request the requirement be revised to "up to 12 months after the awarded delivery date."
CONTRACTOR QUESTION 26: KTR does not provide pricing with a CFR nor does the KTR discuss pricing with the maintenance team. CFR is written to provide recommendations such as "Issue RCC" or "Issue RTR" with pricing provided on a COPA or RTR to C400. Please revise this requirement to reflect such.
GOVERNMENT RESPONSE: Section C paragraph 1.2.6.1 v "price and supporting data" will be removed from Section C and 1.2.6.1 v 9 "Price and time estimates, and the time frame for which it is valid. The estimates should include premium/acceleration price for the material, subcontractors," will be removed from Section C. Amendment will be issued.
CONTRACTOR QUESTION 16: Can the government estimate what percentage of delivery orders under the MAC-IDIQ will require drydocking facilities?
GOVERNMENT RESPONSE: The Government currently anticipates one TSV vessel or other drydocking need per year. Additional orders may be required if the needs of the Navy shift.
CONTRACTOR QUESTION 24: KTR requests docking plans for vessels to be docked under this HM&E IDIQ to determine capabilities of owned assets.
GOVERNMENT RESPONSE: Docking plans will be provided at the delivery order level. Most delievery orders will not require drydocking.
CONTRACTOR QUESTION 25: Industry does not accept "verbal" direction.
Please change to written or email order by the ACO.
CONTRACTOR QUESTION 27: Para states "…the contractor shall provide a GOVERNMENT RESPONSE: Correction will be made via

CONTRACTOR QUESTION 38: The second sentence on Page 10 states "At no time will the proposed total to be performed by the prime contractor combined with the subcontractor quote, material quote, and applicable burdens be allowed to cost more than it would have, had the prime contractor directly provided all material and labor." KTR disagrees and request this sentence be
GOVERNMENT RESPONSE: This sentence and paragraph will not be revised.
CONTRACTOR QUESTION 32: Please define the Government's definition of a "reasonably apparent" error or omission. A patent defect in specification is not addressed in the FAR, nor is it the KTR's responsibility to correct, therefore leaving the Government no right to hold the KTR responsible for the burden of the Government's omission. Please revise this paragraph to release the KTR's liability for Government provided defective specifications or strike the paragraph in it's entirety.
GOVERNMENT RESPONSE: NAVSEA Clauses will not be revised.
CONTRACTOR QUESTION 33: Section E-246-H011 states the "vessel shall be under the control of the Contractor and Contractor's crew…." during the conduct of required tests and trials. This instruction is in direct violation of NAVSEA Standard Item 009-01 para 3.3.2. Please revise this instruction to reflect the direction of 009-01.
GOVERNMENT RESPONSE: NAVSEA Clauses will not be revised.
Recommend attending SSRAC and propose suggested changes to NAVSEA SI's that way if practicable.
CONTRACTOR QUESTION 34: Para 4 states "Concurrently, the Contractor shall quote a price and delivery time required to complete the additional work."
Please revise this sentence to include "Upon receipt of RCC or direction to draft a RTR, the Contractor shall quote a price and delivery time required to complete the additional work".
GOVERNMENT RESPONSE: This paragraph will be revised to state the following: "During the course of work, the Contractor shall promptly recommend to the Government, in writing, additional work that is discovered via the CFR process. If approved, the Government will generate an RCC or RTR. Please see Section B, Note A, paragraph 6 as well as Section C, paragraphs 1.10.3 - 1.10.5 for RCC/RTR instructions and requirements. RCCs may result in a bilateral or unilateral contract modification. However, the Government has no obligation under this paragraph to issue any Delivery Order modification."
CONTRACTOR QUESTION 35: OSHA modified the Hazard Communication Standard (HCS) under 29 CFR 1910.1200 for replacement of Material Data Safety Sheets (MSDS) with newer Safety Data Sheets (SDS) on 5/25/2012 and required compliance by 6/01/2015. Please revise this paragraph to reflect such guidance.
GOVERNMENT RESPONSE: The clause H-223-N001 will be updated via amendment to reflect the JUL 2024 version of the clause which makes the applicable updates.
CONTRACTOR QUESTION 36: As revised in most MARMC solicitations of late, please incorporate the statement "Not to exceed 10% of the contract value".
GOVERNMENT RESPONSE: Clause will remain as-is for this solicitation. Any liquidated damage amounts and not to exceed figures will be determined at each delivery order solicitation.
CONTRACTOR QUESTION 28: Second sentence states "These availabilities may require urgent work that has the potential to render a barge uninhabitable."
and captured from Solicitation N50054-24-R-0009. As the HM&E IDIQ contract covers numerous types of vessels, designated in Section C para 1.2.4.a, please revise "barge" to "vessel".
GOVERNMENT RESPONSE: Additional clarification will be made via amendment.
CONTRACTOR QUESTION 29: Please revise "the barge" to "the vessel" per initial designation in Section C para 1.2.4.a.
GOVERNMENT RESPONSE: Correction will be made
CONTRACTOR QUESTION 30: The Government states a minor delay of eight (8) hours or less per employee is considered normal and no schedule relief will be provided for a minor delay. The KTR disagrees, especially in the case of a CMAV or EMAV when every hour of production can impact delivery of the vessel. KTR recommends revising this requirement to four (4) hours for CMAVs and EMAVs and eight (8) hours for CNO availabilities.
GOVERNMENT RESPONSE: Minor delays, as defined in this solicitation, shall stay universal in its meaning for all vessels and availabilities within this requirement.
CONTRACTOR QUESTION 37: Electronic Work, Engineering, and Design Support are non-typical trades for a repair activity and should not be included as a direct production function. As a specialty subcontractor will be requisitioned for these functions, please strike Electronic Work, Engineering, and Design Support from the list of included trades.
GOVERNMENT RESPONSE: This paragraph will not be revised, these trades are typically supported by the various contractor facilities.
CONTRACTOR QUESTION 31: Requirements of C-211-H002 conflict with Section C para 1.2.5.2. Please revise C-211-H002 to include third party drydock certification.
GOVERNMENT RESPONSE: The sentence will not be changed. It is clear that dry docking requirements will be at the delivery order level and will be dependent upon the ship, barge, dry dock, small boat, vessel be docked.

provided all material and labor." KTR disagrees and request this sentence be revised as the KTR cannot hold a subcontractor to proposed rates and burden.
In the case of new growth on an awarded contract, the KTR cannot determine overall workload and cannot hold a team on non-billable standby for potential growth. Please strike this requirement.
CONTRACTOR QUESTION 39: Please define/elaborate on requirements for "Transportation" as it applies to daily rates included in additional performance days.
GOVERNMENT RESPONSE: The term transportation is associated with movement; for example, moving personnel/materials etc. The question is not specific enough for a specific response.
CONTRACTOR QUESTION 41: Please advise the Government's intent for inclusion of this clause as MARMC typically provides a Messing and Berthing Barge as required with a supplemental work item to moor and maintain said Barge.
GOVERNMENT RESPONSE: This clause is included in the event a delivery order requires berthing barge support.
GOVERNMENT RESPONSE: This language will remain as written, as it pertains to emergent work discovered after hours. As is stated in the paragraph cited, the Contracting Officer will follow-up with written notification within 24 hours of such an instance.
CONTRACTOR QUESTION 40: Please replace "verbal authorization" with "email authorization" in both paragraphs.
